Approval of 401 Water Quality Certification (GC3400) with Additional Conditions
Dear Mr. McGowan:
You have our approval, in accordance with the attached conditions, to place fill material within or
otherwise impact 0.0025 acres of non-vegetated wetlands (Silver Lake bottom), dredge 0.074 acres of
non-vegetated wetlands (Silver Lake bottom) and shade 0.024 acres of non-vegetated wetlands (Silver
Lake bottom) to replace an existing 7 slip pier with a 10 slip pier and replace an existing bulkhead as
described in your application received by the Division of Water Quality (DWQ) 401 Oversight/Express
Review Permitting Unit on September 7,2005. After reviewing your application, we have determined
that the Division of Water Quality (DWQ) General Water Quality Certification Number 3400 covers
these water impacts. This Certification allows you to General Permit No. 198000291 when issued by the
US Army Corps of Engineers (USACE). In addition, you should get or otherwise comply with any other
federal, state and local requirements before you go ahead with your project including (but not limited to)
erosion and sediment control regulations and CAMA. Also, this approval to proceed with your
proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon
expiration of the 404 or CAMA Permit.
This approval is for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application. If the property is sold,
the new owner must be given a copy of this Certification and approval letter and is thereby responsible for
complying with all conditions. If total fills for this project (now or in the future) exceed one acre of
wetland or ISO linear feet of stream, compensatory mitigation may be required as described in 15A
NCAC 2H .0506 (h). This approval requires you to follow the conditions listed in the attached
certification and any additional conditions listed below.
The Additional Conditions of the Certification are:

2. Certificate of Completion
Upon completion of all work approved within the 40 I Water Quality Certification or applicable
Buffer Rules, and any subsequent modifications, the applicant is required to return the attached
certificate of completion to the 401 Oversight/Express Review PennittiDg Unit, North Carolina
Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650.
3. Water Quality Certification
The proposed project must comply with all of the conditions of General Water Quality
Certification (GC) 3400.
Violations of any condition herein set forth may result in revocation of this Certification and may result in
criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct
impacts to waters as depicted in your application and as authorized by this Certification, shall expire upon
expiration of the 404 or CAMAPennit.
If you do not accept any of the conditions of this Certification (associated with the approved water
impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that you
receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the
North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a
hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

Environmental Setting
The project site is located adjacent HWY 12, in the village ofOcracoke, on the east side of
Silver Lake Harbor off the Pamlico Sound on Ocracoke Island in Hyde County, North Carolina. The
site is located within the designated National Historic District. The 0.34-acre project site is a
commercial business with the building having a retail shop on the first floor and a 6-room motel on
the second story. HWY 12 divides the-.34-acre site. The commercial building and associated
parking are on the west side ofHWY 12 adjacent Silver Lake and the septic tank and drain field are
on the east side. The commercial business is known locally as Joyce's ofOcracoke. Currently, the.
motel property has an existing 5' x :tI22', seven slip pier on Silver Lake. The conunercial property
has 54 linear feet of shoreline on Silver Lake. The entire property adjacent Silver Lake is covered
with impervious surface, either a concrete parking area or roofline of the existing building. There is
a private residence also located on the first floor of the same building. It is located on the end of the
building facing/adjacent Silver Lake. This residence is located on a lot with 27' fronting Silver
Lake. The lot appears to have been subdivided out of the motel property years ago. This private
residential property has an existing pier and boatlift. Typical of most commercially developed
properties adjacent Silver Lake, the riparian area is somewhat congested with piers and mooring
piles. The property to the south of the adjoiIiing residential property has a pier and nonconforming
building over Silver Lake. This pier is used to moor commercial fishing vessels, charter and sight
seeing vessels. A gift shop occupies the property to the north of the project site. It also has a pier
over Silver Lake. The shoreline at the project site has an existing concrete bulkhead with riprap
covering the bottom, below the normal water level, at the base of the bulkhead. \Vater depths deepen
gradually from 1.5' at the bulkhead to 7' appro.ximately 70' offshore. Although shellfish, oysters and
clams, inhabit this area, Silver Lake remains closed to harvest. The Division of Water Quality
classifies Silver Lake as SC waters.
Project Description
The applicant proposes to relocate and replace the existing 5' x :t122', 7 slip pier with a 5' x
162' ten slip pier. The proposed pier will be constructed on the riparian line on the south side ofthe
property. Five 2'x 10' finger piers and a 6' x 22' platform will service the ten slips on the north side
of the main pier structure. The applicant proposes to excavate an area 46' wide by 70' long adjacent
to and offshore the existing bulkhead to a final depth of 7' deep. The excavation is to be
accomplished mechanically with a long reach excavator placing the material in a dump truck to be
hauled offsite. The applicant proposes to either stack the material on the upland area across HWY
12 designated as a septic tank repair area or haul it offsite. The applicant also proposes to replace the
existing concrete bulkhead with a new bulkhead constructed with either wood of vinyl sheet pile.
The bulkhead alignment is proposed to be 2' waterward of the existing concrete bulkhead.
Environmental Impacts
The project as proposed will result in the excavation of3,220 ft2 of Silver Lake bottom. The
proposed pier and platform will shade 1,042 ft2 of Silver Lake bottom. Replacement of the existing
bulkhead will result in the filling of 109 ft2 of Silver Lake bottom. Localized short-term turbidity
will result from the excavation work, bulkhead replacement and installation of the pier.

Enclosed please find my completed application for the renovations and replacement
docks and bulkhead at Joyce's Of Ocracoke.
It is my plan to move the existing location of the pier to the South approximately 13
~ the property line between Marian Keech and myself. Property previously held by
r Marian Dilday. We will no longer allow side to docking along the South side of
. dock. Instead we will move all of the existing 10 slips to the North side of the dock and
. - the slips on a diagonal to allow for easer access. The pier will be extended
. . lately 34 feet to be in line with the Community Store docks on the South side and
'Anchorage Inn Marina docks on the North side.
I will build a new wood pilings and vinyl sheeting bulkhead to cover the existing 35
- old concrete and rip rap bulkhead. I also plan to excavate an area approximately 45
~- by 70 feet by 3.5 feet next to the bulkhead to give the area an average depth of 7 feet. I
do the excavation by means of long reach excavator and barge, placing the spoils in a
truck and then placed either on an existing drain field repair area on the property or
the contractor haul it off-site to a disposal area that you approve at the time.

This permit, issued on JflnlIflry 10, 200tl , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility
1) The permitted pier shall not extend into Silver Lake more than 150 feet.
2) In order to ensure compliance with condition No.1 of this permit, an as-built survey shall be performed
on the docking facility, and copies of the survey shall be provided to the Division of Coastal
Management, within 60 days of completion of construction.
3) Should the adjacent property to the south be sold prior to the initiation of construction, the permittee
shall be required to obtain a signed riparian corridor waiver from the new property owner prior to the
placement of any structures within the IS-foot riparian corridor.
(See attached sheets for Additional Conditions)
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
Signed by the authority of the Secretary of DENR and the
Chairman of the Coastal Resources Commission.
Any maintenance work or project modification not covered
hereunder requires further Division approval.

ADDITIONAL CONDITIONS
4) This permit authorizes only the docks, piers, and other structures and uses located in or over the water
that are expressly and specifically set forth in the permit application. No other structure, whether
floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non-water dependent uses of structures may be conducted on, in or over public trust
waters without permit modification.
5) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the pennitted structure.
6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
7) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
8) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the pu?lic
interest.
9) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
10) This permit authorizes a maximum of ten boat slips.
NOTE:
Any proposal to add one or more additional boat slips to the authorized lO-slip facility shall
require that the docking facility be classified as a marina, and will therefore require a review
under the N.C. Environmental Policy Act (NCEPA).
Excavation
11) No excavation shall be permitted outside the area referenced on the attached workplan drawings labeled
revision #1 dated received 12120/05.
12) Excavation shall not exceed 7 feet below the normal high water level. In no case shall the depth of
excavation exceed the depth of connecting waters.
13) There shall be no excavation activities within an area 15 feet from the riparian line and a minimum of 15
feet seaward from the existing bulkhead in an effort to prevent undermining of the bulkhead on
adjoining properties.

Spoil Disposal
All excavated materials shall be confined above normal high watcr and landward of regularly or
ilTegularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of
solids into any marsh or sUlTounding waters.
The disposal area shall be properly graded and provided a ground cover sufficicnt to restrain erosion
within 30 working days of project completion.
16) The spoil material shall be disposed of in an upland location that has receivcd prior approval from a
representative of the Division of Coastal Management.
Easement
17) Prior to construction of any ncw boat slips or other docking facilities under this permit, the permittee
must apply for and receive an Easement from the Department of Administration's State Property Office
as required under N.C.G.S. 146-12(e).
Shoreline Stabilization
18) The bulkhead shall be constructed prior to any backfilling activities.
19) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
20) The bulkhead shall not extend waterward more than 2 feet from the existing bulkhead.
21) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other
suitable materials approved by Department personnel.
22) A silt fence shall be properly installed immediately landward of all bulkhead caps immediately
following completion of backfilling activities.
23) No backfill material shall be placed within 30 feet of the normal high water line, except that which will
be used to backfill the area behind the permitted bulkhead.
. 24) All backfill material shall be obtained from a high ground source and confined behind the permitted
bulkhead.
25) The backfill material shall be clean and free of any pollutants except in trace quantities.

General
The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon
due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions
caused thereby, without expense to the United States or the state of North Carolina. No claim shall be
made against the United States or the state of North Carolina on account of any such removal or
alteration.
27) No vegetated wetlands shall be excavated or filled, even temporarily.

This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 946-6481 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non-water
dependent activities are not authorized within 30 feet of the normal high water level.
The permittee and/or his contractor is urged to meet with a representative of the Division prior to
project initiation.
The N.C. Division of Water Quality has authorized the proposed project under General Water
Quality Certification No. 3400 (DWQ Project No. 051709), which was issued on 10/27/05.
The U.S. Army Corps of Engineers has assigned the proposed project COE Action rd. No.
200511906.
