Shoreline Stabilization
1) The bulkhead and riprap alignment shall strictly adhere to the alignment depicted in the attached
workplan drawing dated "revised" 8/15/05. The permittee shall stake the alignment and have the
alignment verified by a representative of the Division of Coastal Management within a maximum of 30
days prior to the start of any construction,

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
Signed by the authority of the Secretary of DENR and the
Chairman of the Coastal Resources Commission.
This permit shall be accessible on-site to Department
personnel when the project is inspected for compliance.

The bulkhead shall bc constructed prior to any backfilling activities.
The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other
suitable materials approved by department personnel. No excavation or other land disturbing activities
is permitted except for that which shall be required for the construction of the bulkhead wall, riprap,
deadmen cables, etc. This permit does not authorize any excavation waterward of the approved
alignment.
5) The rip rap material shall be free from loose dirt or any pollutant. It shall be of a size sufficient to
prevent its movement from the approved alignment by wave or current action.

The alignment of the approved riprap shall not extend more than 8 feet from the approved bulkhead
alignment at any point along its alignment.

The rip rap material shall consist of clean rock or masomy materials such as but not limited to granite,
marl, or broken concrete.
8) All fill material shall be clean and free of any pollutants except in trace quantities.
9) All backfill material shall be obtained from a high ground source and confined behind the permitted
bulkhead.
10) No backfill material shall be placed within 30 feet of the normal water line, except that which shall be
used to backfill the area behind the permitted bulkhead.
Sedimentation and Erosion Control
11) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.). At a minimum, a silt fence shall be properly installed immediately
landward of the bulkead cap immediately following completion of backfilling activities.
12) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion
within thirty days of project completion.
Docking Facility
13) Unless specifically altered herein, this permit authorizes only the 6ft. x 150 ft. pier with a 10 ft. x 36 ft.
platform and 2 mooring pilings, all specifically set forth in the permit application and attached workplan
drawing. No other structure, whether floating or stationary, shall become a permanent part of this
docking facility without permit modification. No non-water dependent uses of structures shall be
conducted on, in or over public trust waters without permit modification.

The docking facility and associatl'd structures shall have a minimum setback distance of 15 feel between
:.my parts of the structure and the adjacent property owncr's riparian acccss corridor, which is
determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel
line that intersects with the shore at the point where the upland property line meets the water's edge.
Because of the close proximity to the eastem most property owner, and to ensure compliance with
Condition No. 17, an as-built survey shall be performed of the docking facility, and a copy of the survey
provided to the Division of Coastal Management, within 60 days of completion of construction of this
portion of the project.
17) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.

18) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation.

The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
This permit authorizes a maximum of two boat slips.
General
23) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required,
upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or
obstructions caused thereby, without expense to the United States or the state of North Carolina. No
claim shall be made against the United States or the state of North Carolina on account of any such
removal or alteration.

Approval of 401 Water Quality Certification (GC3400) with Additional Conditions
Dear Mr. Godfrey:
You have our approval, in accordance with the attached conditions, to place fill material within or
otherwise impact 0.282 acres of public trust area (estuarine waters) for bulkhead fill, and to place fill
material within or otherwise impact 0.256 acres of public trust area (estuarine waters) for riprap fill to
replace an existing wooden bulkhead as described in your application received by the Division of Water
Quality (DWQ) 401 Oversight/Express Review Permitting Unit on September 7, 2005. After reviewing
your application, we have determined that the Division of Water Quality (DWQ) General Water Quality
Certification Number 3400 covers these water impacts. This Certification allows you to General Permit
No. 198000291 when issued by the US Army Corps of Engineers (USACE). In addition, you should get
or otherwise comply with any other federal, state and local requirements before you go ahead with your
project including (but not limited to) erosion and sediment control regulations and CAMA. Also, this
approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in
your application shall expire upon expiration of the 404 or CAMA Permit.
This approval is for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application. If the property is sold,
the new owner must be given a copy of this Certification and approval letter and is thereby responsible for
complying with all conditions. If total fills for this project (now or in the future) exceed one acre of
wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A
NCAC 2H .0506 (h). This approval requires you to follow the conditions listed in the attached
certification and any additional conditions listed below.

2. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable
Buffer Rules, and any subsequent modifications, the applicant is required to return the attached
certificate of completion to the 401 Oversight/Express Review Pennitting Unit, North Carolina
Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650.
3. Water Quality Certification
The proposed project must comply with all of the conditions of General Water Quality
Certification (GC) 3400.
Violations of any condition herein set forth may result in revocation of this Certification and may result in
criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct
impacts to waters as depicted in your application and as authorized by this Certification, shall expire upon
expiration of the 404 or CAMA Pennit.
If you do not accept any of the conditions of this Certification (associated with the approved water
impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that you
receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the
North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a
hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

8. PROJECT SUMMARY:
The applicant proposes to replace 712-ft. of a 1,394-ft. wooden bulkhead, rock rip rap 1,394-ft.
waterward of existing and replacement bulkhead, construct a new pier with a lO-ft. long by 36-ft.
wide "T" platform and two mooring pilings, and remove old bulkhead remnants on his property
located adjacent to a farm field off Winslow Rd., New Hope Community, in Durants Neck,
Perquimans County, and on Albemarle Sound.
PROJECT SETTING
The property is a 65.48-acre farm located off Winslow Rd. (SR 1323), Durant's Neck New Hope
Community, in Perquimans County and adjacent to Albemarle Sound. The property has an elevation of
approximately 5.5 ft. above normal water level (NWL) and has Roanoke and Chowan silt loam soils.
Vegetation on the property consists of mostly pine, sweet gum, bald cypress, other indigenous trees,
grasses, weeds, and soybeans. The development site is located on the northern shoreline of Albemarle
Sound just east of the mouth of the Perquimans River. The width of Albemarle Sound at this point is
approximately 9 miles (47,520 feet). Previous Earl Ray Godfrey Major Permit No.'s 157-77, 171-87,
and 151-95 authorized the existing bulkhead, a bulkhead aligned further waterward of NWL than
currently being proposed, and a boat ramp adjacent to a pier on a further westerly tract. Only remnants
of the old bulkhead and pier currently exist.
Adjacent property consists of four single-family dwellings along the shoreline to the west and wooded,
undeveloped property to the east. The properties to the west have been bulkheaded, while the property to
the east is natural shoreline, and the applicant's property has experienced considerable erosion along the
shoreline in areas where the existing bulkhead has failed or washed away due to Hurricane Isabel and
tropical storms and high winds that followed. A severe escarpment averaging 4-ft. deep by lO-ft wide
exists in failed bulkhead areas. This farm tract has an irregular shoreline that is approximately 2,500
linear feet.
The water depth close to shore ranges from 0.3-2 ft. and gradually deepens to 3.2 ft. at water ward end
of pier. There was no observed presence of submerged aquatic vegetation or shellfish in the vicinity of
the pier on August 8, 2005. Reviews of available information suggest that there are no known
archeological sites or geologic formations associated with the applicant's property. The waters of the
Albemarle Sound in this area are classified as SB by the Division of Environmental Management and are
closed to shellfish harvesting.
PROJECT DESCRIPTION
In order to prevent further erosion, the applicant proposes to replace 712 ft. of an existing 1,394-ft.
wooden bulkhead to connect with existing bulkhead on his property to have a straight alignment. The
applicant proposes three IS-ft. return walls: two of them are located on the west side of sections C and B
of Sheet 2, and the other is located at the eastern property line adjacent to Charles Anthony's property.
All three return walls terminate the bulkhead along a treelike of 404 wetlands. The proposed bulkhead
alignment will have a maximum distance of 58 ft. from the shoreline and an average distance of 20 ft.
While 12,287 sq. ft. of state waters behind the failed bulkhead will be recaptured, there exists another
approximately 10,500 sq. ft. of state waters behind the failing bulkhead that will not be recaptured.
Excavation within the water will be needed for installation of the bulkhead. Clean, dry fill will be used

for backfill from his own soybean field adjacent to the project, which is upland and outside the Estuarine
Shoreline (ES), Area of Environmental Concern (AEC). If additional fill is needed, clean, dry fill will be
trucked in from an upland, commercial pit. The applicant is requesting this bulkhead alignment because
trash and debris collect in the eroded area and Hurricane Isabel was the major cause of this severe
erosion. Due to the historical high maintenance of the bulkhead since it's initial construction and to break
waves before they hit the bulkhead wall, the applicant proposes to riprap the entire 1,394 ft. of bulkhead,
8-ft. waterward of the proposed bulkhead alignment and average 2-ft above the sandy bottom. This riprap
will better protect the bulkhead shoreline from wave energy created from southwest winds and
approximate 9-mile fetch of the Albemarle Sound.
The applicant proposes to construct a ISO-ft. long by 6-ft. wide pier with a lO-ft. long by 36-ft. wide
"T" head platform. The total length of the pier structure will be 160 ft. The applicant proposes to place
two pilings north of the "T" in order to create two 12-ft. long by IS-ft. wide boat slips. There is a 260-
ft. long pier along the same shoreline 130 feet north of the applicant's property.
ANTICIPATED IMPACTS
The proposed bulkhead alignment with backfill will result in the filling of approximately 12,287 sq. ft.
(308 cubic yards) of Public Trust Area (PTA), Estuarine Waters (EW), and 5,773 sq. ft. (2,528 cubic
yards) of PT A, Estuarine Shoreline (ES) Area of Environmental Concern (AEC). Additional fill in the
PTA, EW from the riprap will result in the filling of approximately 11,152 sq. ft. (206 cubic yards).
Therefore, total fill from the riprap and bulkhead in the PTA, EW will be 514 cubic yards.
The proposed pier will shade 900 sq. ft. and the "T" platform will shade 360 sq. ft., for a total of
1,260 sq. ft. of shaded area in the PTA, EW. There are no expected navigational impacts due to the pier
structure.
Temporary water turbidity will occur during construction. The use of a filter cloth behind the
bulkhead, will minimize future erosion and turbidity.

The purpose of the proposed activity is to reconstruct three portions of an
existing 1,394 linear foot bulkhead, point to point, which has been destroyed in
three areas (see sheet 2 of 2: (A), (B), & (C)) within the existing bulkhead
alignment, from prior hurricane and storm events. Remnant bulkhead and
tiebacks are present in three areas, ((A), (B), & (C)) where severe escarpments
exist. Breaks in the bulkhead, left the shoreline vulnerable to storm erosion
causing distinct escarpment averaging four feet (4+') in depth. The eroding
shoreline continues to erode with every strong southwest wind. The remaining
bulkhead (685 linear feet) is in good condition (see sheet 2 of 2) except for a 50
linear foot section that needs some minor repairs and to be backfilled. The
remaining 635 linear feet does not require replacement or maintenance at this
time. Linear footage of bulkhead to be replaced landward of the existing remnant
bulkhead is 712 linear feet, Sections (A), (B), & (C). Three 15 foot return walls
(one at each end) are proposed to be replaced as well (45 linear feet). Rock Rip
rap (1,394 linear feet, 8' base, 2' in height) is proposed waterward of the
bulkhead once the bulkhead is reconstructed. Construction of a pier (150'),
platform (400 sJ.) and two boat slips are proposed as well.
Predominant southwest winds make this area along the Perquimans River a high
wave energy area; therefore, without continued shoreline stabilization the
shoreline is vulnerable to continual erosion. Personal observation from the
property owner and NC Division of Coastal Management field representative,
observed eroded shoreline 10+ feet in the past 12 months. Once the
reconstructed bulkhead is in place, rip rap placed in front of the bulkhead will
armor the bulkhead and minimize future destruction due to the high-energy
impact zone. Rip rap is proposed in front of the bulkhead, since historical
bulkheads armored with rip rap have proven to be left intact after major storm
events, when portions of bulkhead without rip rap have failed (refer to previous
CAMA Major Permit "Albemarle Estates" in Currituck County). Existing
structures do not exist on the property; property is currently utilized as a
cultivated farmland (soybeans).
Predominant southwest winds make this a high wave energy area, therefore,
submerged aquatic vegetation (SAV's) does not normally exist in these high-
energy areas. AEC staff confirmed during a site visit, there are no submerged
aquatic vegetation (SAV's) within the project area or outside the project area.
With the absence of SAV's, aquatic invertebrate and vertebrate species should
not be impacted by the proposed activity. It is to the findings of the field biologist
during site visits, aquatic life is not reported in this project area. There are no
coastal wetlands present within this 64 acre tract or within the project area or

outside the project area. Wooded areas have not been delineated but have been
observed by AEC staff to support Section 404 wetlands.
All field measurements taken during a southwest wind tide. Tide was
approximately 3 inches above NWL; corrections were made to water depths
during the time of survey (plat reflects corrected water depths). Water depths
were taken in fifteen-foot increments from the NWL to the existing bulkhead
alignment. Transects were taken 20 feet apart in Sections (A), (B), & (C).
Escarpment measurements were taken every 20 feet at each transect.

cloth. If more material is needed for backfill behind the bulkhead, it will be
trucked in from a highground commercial source.
Rock rip rap will be trucked in after backfill and bulkhead are in place, and placed
directly in front of the bulkhead (1,394 linear feet).
Rip rap proposed below the NWL 1,394' x 8' x 1 x .5 -;- 27 = 206 cubic yards.
Once all rip rap is in place, rip rap height will be no more than one foot above the
NWL.
Total disturbed area for the proposed activity = 19,355 sJ. (includes backfill in
escarpment areas (A) (B) & (C)).
