Wetland and Stream Standard Violations

On April 4, 2019, the Division of Water Resources (Division) received a written response to NOV-2019-PC-
0131. As part of this response, a wetland and stream restoration plan was provided for approval. The
plan indicated that accumulated sediment (1 -2 inches) impacting approximately 500 square feet of
jurisdictional wetlands located to the west of Lots 64 and 65 will be left in place to naturally assimilate as
discussed with Division staff on March 13, 2019. The plan indicated that accumulated sediment impacting
approximately 150 linear feet of unnamed tributary to Jimmy's Prong will be removed with hand tools
and the stream channel returned to natural pattern, dimension, and profile of the previously existing
stream. The plan indicated that removed sediment will be hauled via wheel barrier to be disposed of on
high ground.
By copy of this letter, your restoration plan is approved and the restoration of the wetland and stream
should be completed by July 5, 2019. Please contact Division personnel indicated below after completing
the above-mentioned scopes of work so a site visit can be scheduled to verify that restoration is complete.
Thank you for your attention to this matter. Please remember these violations and any future violations
are subject to a civil penalty assessment of up to $25,000.00 per day for each violation. Should you have
