Director 0 Division of Water Quality June 23, 2004 CERTIFIED MAIL RETURN RECEIPT REQUESTED 7003 3110 0005 8968 8791 Mr. Bobby Keaton 812 Andrews Crossing Smithfield, VA 23430-5833 SUBJECT: NOTICE OF VIOLATION Animal Feedlot Operation Compliance Inspection Weeksville Farm Facility No. 70-1 Pasquotank County Dear Mr. Keaton: This letter is to notify you that the subject facility is in violation of its Certified Animal Waste Management Plan, General Permit, Title 15A North Carolina Administrative Code, Subchapter 2H, Section .0217(d) and N.C.G.S. 143-215.1. On March 18, 2004. Scott Vinson from the Washington Regional Office of the Division of Water Quality (DWQ) conducted an Animal Feedlot Operation Compliance Inspection at the Weeksville Farm in Pasquotank County. A copy of the inspection report is attached for your review. In general, the Compliance inspection was to determine if: (1) the farm has a Certified Animal Waste Management Plan (CAWMP); (2) the farm is complying with requirements of the State Rules 15 NCAC 2H.0217, Senate Bill 1217, and the Certified Animal Waste Management Plan; (3) the farm operation's waste management system is being operated properly under the direction of a Certified Operator; (4) the required records are being kept, and that (5) there are no signs of seepage, erosion, and/or runoff. The following violations were observed during the inspection: There was an over application of nutrients from September 6 through September 16, 2003 on Field #2, Tract 1162 due to the failure to plant a receiving crop. There were eight (8) applications total each lasting 60 minutes. The IRR2 forms were not complete at the time of the inspections and should be completed as soon as possible. The most current waste analysis to be use when calculating the amount of Nitrogen over applied is dated August 18, 2003 with 0.70 lbsN/1000gai. In accordance with condition Il, item 2 of your General Permit, a vegetative cover shall be maintained on all land application fields and buffers in accordance with the CAWMP. No waste may be applied upon fields not included in the CAWMP. Also in accordance with condition 11, item 4 of your General Permit, land application rates shall be in accordance with the CAWMP. In no case shall land application rates exceed the Plant Available Nitrogen (PAN) rate for the receiving crop or result in runoff during any give application. It is very important as the owner and/or the Operator in Charge that these aforementioned violations and any other problems that may arise be resolved, as soon as possible. For additional assistance, please contact your Technical Specialist. You are requested to respond in writing within ten (10) days of receipt of this Notice, outlining the corrective actions that have been undertaken and/or have been planned to address these violations and any further actions taken to prevent future violations of this nature from occurring. Your explanation will be reviewed and if an enforcement action is still deemed appropriate, your explanation will be forwarded to the Director with the enforcement package for his consideration. There was no receiving crop planted. As noted during Soil & Water's review, IRRI forms had irrigation events recorded from Sept. 6 through September 16, 2003. 23)The IRRI records are currently missing from Mr. Keaton's records. (use additional pages as necessary): ❑ Field Copy ❑ Final Notes * Emergency site visit conducted as part of Hurricane Isabel's damage assessments. + Received notification that there was evidence of possible discharge from farm by Carl Dunn, DSWC, on 9/24/03. & 8) There is the possibility of a prior discharge, however there is no waste being discharged today. The joints to the irrigation pipe have been leaking, especially near the lagoon/pump where the angles at the joints are too great, The joints need to be sealed properly before any further irrigation takes place. 9) The lagoon marker looks to read approximately 19", however after walking the perimeter of the lagoon the waste level appears to be around 12", Have a new gauged marker appropriatley installed in each lagoon. Notify me of the day this is to happen. 14) A 30 day POA is re�uired be of the high freeboard. A message was left for Mr. Keaton describing these problems and requirements. We had a bad pump seal which caused a leak in February, which we promptly replaced with a new pump. We also caulked around the pipe in the corner of Building 1 near the flush tank when we saw a small leak to prevent any future leakage. This same action was taken for Building 2 near the flush pit. The leakage we experienced from the above problems were minimal leakages leading us to assume it wasn't enough to report. However, we now realize that we should have reported it and any future problems will be promptly reported. We understand that the water level minimum is 19 inches freeboard at all times. We have no problem complying with this and regularly pump when the levels indicate necessary. A copy of the inspection report is attached for your review. In general, the Compliance Inspection was to determine if: (1) the farm has a Certified Animal Waste Management Plan (CAWMP); (2) the farm is complying with requirements of the State Rules 15 NCAC 2H.0217, Senate Bill 1217, and the Certified Animal Waste Management Plan; (3) the farm operation's waste management system is being operated property under the direction of a Certified Operator, (4) the required records are being kept; and that (5) there are no signs of seepage, erosion, and/or runoff. The following violations were observed during the inspection: During the compliance inspection conducted by Mr. Scott Vinson, he noted evidence of past discharges from two leaks first detected by Mr. Martin McLawhom, DSWC, during his annual routine operation review on February 6, 2002. The first being a small leak coming from the comer of Building #1 near the flush tank. Note that this leak had been caulked prior to the inspection. A leaking flush pipe at Building #2 by the flush pit was also detected. This leak was also caulked prior to Mr. Vinson's inspection. Mr. McLawhom noted in his review that the ditch behind building #2 had evidence of a past discharge from a leaking seal from the flush pump. According to Mr. McLawhom due to the dry conditions it appeared that waste did not leave the farm site. In neither circumstance were these leaks reported to the Division of Water Quality as required by your General Permit. In accordance with condition III, item 6g of the General Permit, the Permittee shall report by telephone to the appropriate Regional Office as soon as possible, but in no case more than 24 hours following first knowledge of the occurrence of any of the following events: g. Any discharge that bypasses a lagoon/storage pond resulting in a discharge to surface waters or that poses a serious threat to the environment. There was approximately 17 inches of freeboard in the small lagoon. It is noted that you frequently transfer waste from the small lagoon over into the large lagoon in order to apply to fields. In general, this inspection included verifying that: (1) the farm is complying with requirements of the State Rules 15 NCAC 21-1.0217, Senate Bill 1217, the Certified Animal Waste Management Plan and/or General Permit; (2) determine whether the waste utilization plan is based on total or actual wetted acres; (3) the farm operation's waste management system is being operated properly under the direction of Certified Operator; (4) the required records are being kept; (5) there are no signs of seepage, erosion, and/or runoff. The following deficiencies were noted during the inspection. cp In accordance with condition III, item 3 of your general permit, you are required to conduct an annual Standard Soil Fertility Analysis, including pH, copper and zinc. 9 The irrigation events in November were in preparation for the winter crop of which was never planted by the land owner. It is very important to make sure there is a crop in the designated fields that will utilize the applied nitrogen. In addition, it is suggested to contact your Technical Specialist to check the accuracy of the lagoon marker in comparison to the lagoon wall.
