The September 24, 2010 permit was contested with no final resolution and had an expiration date of September 1, 2015. Rose Acre Farms, Inc. previously submitted an application (AWP480024) and Notice of Intent for coverage under the Non -Discharge State Poultry Waste Management Permit (AWG300000). This application was denied by the Department of Environmental Quality on January 26, 2016 and a Notice of Violation for Operation of a Waste Management System Without a Permit was issued on January 28, 2016. Based upon further legal review of the agricultural stormwater exemption found in 33 U.S.C. § 1362(14), the reasoning of the federal district court in Alt v. U.S. EPA, 979 F. Supp. 2d 701 (N.D.W.V. 2013), and the information provided by the North Carolina Poultry Federation to Senator Brent Jackson in its April 27, 2016 letter, the Department believes that Rose Acre Farms, Inc., is eligible for coverage under General Permit #AWG300000. Per Division of Water Resources correspondence dated January 26, 2016 (attached), your state non -discharge general permit application has been denied due to evidence of a discharge of contaminated stormwater from the facility. This discharge is separate from any precipitation - caused runoff out of the previously permitted field for land application of egg wash water. However, samples taken elsewhere on the facility's property (notably at the stormwater pond, stormwater outfall and other stormwater ditches internal to the site) revealed increased nutrient levels resulting in a discharge of contaminated stormwater to Waters of the State as measured on March 20, 2014 and April 1, 2014. Therefore, an NPDES Individual Wastewater Discharge Permit is required. As of the Division's denial of your application, the Poultry Waste Collection, Treatment, Storage and Application System serving the above -referenced facility is not covered under a permit. Operation of the subject waste management system without coverage under a permit is a violation ofN.C.G.S. §143-215,1. Specific violations are as follows: Violation 1: Operation of a Waste Management System Without a Permit 1n accordance with N.C.G.S. § 143-215.1 [including, but not limited to, (a)(1) and (a)(12)] Activities for Which Permits Required. - Except as provided in subsection (a6) of this section, no person shall do any of the following things or carry out any of the following activities unless that person has received a permit from the Commission and has complied with all conditions set forth in the permit: (1) Make any outlets into the waters of the State; (12) Construct or operate an animal waste management system, as defined in N.C.G.S. 143- 215.1013, without obtaining a permit under wither this Part or Part I A of this Article. (remainder of N.C.G.S. § 143-215.1 incorporated by reference). Required Corrective Action for Violation 1: Immediately apply for coverage under an NPDES Permit. You are required to immediately take any necessary action to correct the above violation and to provide a written response to this Notice within 30 days of receipt of this letter indicating that all violations have been addressed. Please include in your response all corrective actions already taken and a schedule for completion of any corrective actions not addressed. Failure to promptly secure an NPDES Permit for the subject waste management system and to also comply with conditions in -a permit and/or pending permit for the facility may result in a recommendation of enforcement action to the Director of the Division of Water Resources who may issue a civil penalty assessment of not more than twenty-five thousand ($25,000) dollars against any "person" who violates or fails to act in accordance with the terms, conditions, or requirements of a permit under authority of N.C.G.S. §143-215.6A. The September 24, 2010 permit was contested with no final resolution and had an expiration date of September 1, 2015. Rose Acre Farms, Inc. recently submitted an application and Notice of Intent for coverage under the Non -Discharge State Poultry Waste Management Permit (AWG300000). Per Division of Water Resources correspondence dated January 26, 2016 (attached), your state non -discharge general permit application has been denied due to evidence of a discharge of contaminated stormwater from the facility. This discharge is separate from any precipitation - caused runoff out of the previously permitted field for land application of egg wash water. However, samples taken elsewhere on the facility's property (notably at the stormwater pond, stormwater outfall and other stormwater ditches internal to the site) revealed increased nutrient levels resulting in a discharge of contaminated stormwater to Waters of the State as measured on March 20, 2014 and April 1, 2014. Therefore, an NPDES Individual Wastewater Discharge Permit is required. As of the Division's denial of your application, the Poultry Waste Collection, Treatment, Storage and Application System serving the above -referenced facility is not covered under a permit.
