NPDES Permit No. NCA148024 covering the above referenced facility was originally issued November
23, 2004 and later re -issued on September 24, 2010. The September 24, 2010 permit was contested with
no final resolution and had an expiration date of September 1, 2015. Rose Acre Farms, Inc. previously
submitted an application (AWP480024) and Notice of Intent for coverage under the Non -Discharge
State Poultry Waste Management Permit (AWG300000). This application was denied by the
Department of Environmental Quality on January 26, 2016 and a Notice of Violation for Operation of a
Waste Management System Without a Permit was issued on January 28, 2016.
Based upon further legal review of the agricultural stormwater exemption found in 33 U.S.C. § 1362(14),
the reasoning of the federal district court in Alt v. U.S. EPA, 979 F. Supp. 2d 701 (N.D.W.V. 2013), and
the information provided by the North Carolina Poultry Federation to Senator Brent Jackson in its April
27, 2016 letter, the Department believes that Rose Acre Farms, Inc., is eligible for coverage under
General Permit #AWG300000.
Therefore, the above -referenced Notice of Violation is hereby rescinded.

Dear Mr. Wesner:
NPDES Permit No. NCA148024 covering the above referenced facility was originally issued
November 23, 2004 and later re -issued on September 24, 2010. The September 24, 2010 permit
was contested with no final resolution and had an expiration date of September 1, 2015. Rose
Acre Farms, Inc. recently submitted an application and Notice of Intent for coverage under the
Non -Discharge State Poultry Waste Management Permit (AWG300000).
Per Division of Water Resources correspondence dated January 26, 2016 (attached), your state
non -discharge general permit application has been denied due to evidence of a discharge of
contaminated stormwater from the facility. This discharge is separate from any precipitation -
caused runoff out of the previously permitted field for land application of egg wash water.
However, samples taken elsewhere on the facility's property (notably at the stormwater pond,
stormwater outfall and other stormwater ditches internal to the site) revealed increased nutrient
levels resulting in a discharge of contaminated stormwater to Waters of the State as measured on
March 20, 2014 and April 1, 2014. Therefore, an NPDES Individual Wastewater Discharge
Permit is required.
As of the Division's denial of your application, the Poultry Waste Collection, Treatment, Storage
and Application System serving the above -referenced facility is not covered under a permit.
Operation of the subject waste management system without coverage under a permit is a
violation ofN.C.G.S. §143-215,1. Therefore, because the waste management system is operating
without a valid permit from the State of North Carolina, you are hereby notified that Rose Acre

Farms, Inc. has been found to be in violation of N.C.G.S. § 143-215.1 Control of Sources of
Water Pollution; Permits Required. Specific violations are as follows:
Violation 1: Operation of a Waste Management System Without a Permit
1n accordance with N.C.G.S. § 143-215.1 [including, but not limited to, (a)(1) and (a)(12)]
Activities for Which Permits Required. - Except as provided in subsection (a6) of this section, no
person shall do any of the following things or carry out any of the following activities unless that
person has received a permit from the Commission and has complied with all conditions set forth
in the permit:
(1) Make any outlets into the waters of the State;
(12) Construct or operate an animal waste management system, as defined in N.C.G.S. 143-
215.1013, without obtaining a permit under wither this Part or Part I A of this Article. (remainder
of N.C.G.S. § 143-215.1 incorporated by reference).
Required Corrective Action for Violation 1:
Immediately apply for coverage under an NPDES Permit.
You are required to immediately take any necessary action to correct the above violation
and to provide a written response to this Notice within 30 days of receipt of this letter
indicating that all violations have been addressed. Please include in your response all
corrective actions already taken and a schedule for completion of any corrective actions not
addressed.
Failure to promptly secure an NPDES Permit for the subject waste management system and to
also comply with conditions in -a permit and/or pending permit for the facility may result in a
recommendation of enforcement action to the Director of the Division of Water Resources who
may issue a civil penalty assessment of not more than twenty-five thousand ($25,000) dollars
against any "person" who violates or fails to act in accordance with the terms, conditions, or
requirements of a permit under authority of N.C.G.S. §143-215.6A.

The Division has received your application for coverage tinder the nondischarge State Poultry
Waste Management Permit, AWG300000.
As you are aware, the N.C. Superior Court held that it is within the authority of the Department
of Environmental Quality to require that Rose Acre Farms obtain an NPDES Permit under N.C.
Gen. Stat § 143-215.1.1 Given that this issue was contained within the challenge in your Petition
for Review to the Office of Administrative Hearings and you have voluntarily dismissed your
petition, the findings of the N.C. Superior Court remain binding upon the parties at this time.23
As a result, the discharge of contaminated stormwater to waters of the State, to which your
application and Notice of Intent for coverage under General Permit No. AWG300000 applies,
remains subject to the State's permitting requirement and your company is thus required to apply
for an NPDES Individual Wastewater Discharge Permit. Therefore, your application is hereby
denied.
The Department is happy to discuss this matter with you further, but please be aware that with
this denial, Rose Acre Farms is now operating its facility with an unpermitted discharge. Failure

Dear Mr. Wesner:
NPDES Permit No. NCA148024 covering the above referenced facility was originally issued
November 23, 2004 and later re -issued on September 24, 2010. The September 24, 2010 permit
was contested with no final resolution and had an expiration date of September 1, 2015. Rose
Acre Farms, Inc. recently submitted an application and Notice of Intent for coverage under the
Non -Discharge State Poultry Waste Management Permit (AWG300000).
Per Division of Water Resources correspondence dated January 26, 2016 (attached), your state
non -discharge general permit application has been denied due to evidence of a discharge of
contaminated stormwater from the facility. This discharge is separate from any precipitation -
caused runoff out of the previously permitted field for land application of egg wash water.
However, samples taken elsewhere on the facility's property (notably at the stormwater pond,
stormwater outfall and other stormwater ditches internal to the site) revealed increased nutrient
levels resulting in a discharge of contaminated stormwater to Waters of the State as measured on
March 20, 2014 and April 1, 2014. Therefore, an NPDES Individual Wastewater Discharge
Permit is required.
As of the Division's denial of your application, the Poultry Waste Collection, Treatment, Storage
and Application System serving the above -referenced facility is not covered under a permit.
Operation of the subject waste management system without coverage under a permit is a
violation ofN.C.G.S. §143-215.1. Therefore, because the waste management system is operating
without a valid permit from the State of North Carolina, you are hereby notified that Rose Acre

Farms, Inc. has been found to be in. violation of N.C.G.S. §143-215.1 Control of Sources of
Water Pollution; Permits Required. Specific violations are as follows:
Violation 1: Operation of a Waste Management System Without a Permit
In accordance with N.C.G.S. §143-215.1 [including, but not limited to, (a)(1) and (a)(12)]
Activities for Which Permits Required. - Except as provided in subsection (a6) of this section, no
person shall do any of the following things or carry out any of the following activities unless that
person has received a permit from the Commission and has complied with all conditions set forth
in the permit;
(1) Make any outlets into the waters of the State;
(12) Construct or operate an animal waste management system, as defined in N.C.G.S. 143-
215.1013, without obtaining a permit under wither this Part or Part IA of this Article. (remainder
of N.C.G.S. § 143-215.1 incorporated by reference).
Required Corrective Action for Violation 1:
Immediately apply for coverage under an NPDES Permit.
You are required to immediately take any necessary action to correct the above violation
and to provide a written response to this Notice within 30 days of receipt of this letter
indicating that all violations have been addressed. Please include in your response all
corrective actions already taken and a schedule for completion of any corrective actions not
addressed.
Failure to promptly secure an NPDES Permit for the subject waste management system and to
also comply with conditions in a permit and/or pending permit for the facility may result in a
recommendation of enforcement action to the Director of the Division of Water Resources who
may issue a civil penalty assessment of not more than twenty-five thousand ($25,000) dollars
against any "person' who violates or fails to act in accordance with the terms, conditions, or
requirements of a permit under authority of N.C.G.S. §143-215.6A.

of Environmental Quality to require that Rose Acre Farms obtain -an NPDES Permit under N.C.

for Review to the Office of Administrative Hearings and you have voluntarily dismissed your

§ 143-215.1. Control of sources of water pollution; permits required.
(a) Activities for Which Permits Required. — Except as provided in subsection (a6) of this section, no person shall do
any of the following things or carry out any of the following activities unless that person has received a permit from
the Commission and has complied with all conditions set forth in the permit:
(1) Make any outlets into the waters of the State.
(2) Construct or 6perate any sewer system, treatment works, or disposal system within the State.
(3) Alter, extend, or change the construction or method of operation of any sewer system, treatment works, or
disposal system within the State.
(4) Increase the quantity of waste discharged through any outlet or processed in any treatment works or disposal
system to any extent that would result in any violation of the effluent standards or Iimitations'established for any
point source or that would adversely affect the condition of the receiving waters to the extent of violating any
applicable standard.
(5) Change the nature of the waste discharged through any disposal system in any way that would exceed the
effluent standards or limitations established for any point source or that would adversely affect the condition of the
receiving waters in relation to any applicable standards.
(6) Cause or permit any waste, directly or indirectly, to be discharged to or in any manner intermixed with the waters
of the State in violation of the water quality standards applicable to the assigned classifications or in violation of any
effluent standards or limitations established for any point source, unless allowed as a condition of any permit, special
order or other appropriate instrument issued or entered into by the Commission under the provisions of this Article.
(7) Cause or permit any wastes for which pretreatment is required by pretreatment standards to be discharged,
directly or indirectly, from a pretreatment facility to any disposal system or to alter, extend or change the
construction or method of operation or increase the quantity or change the nature of the waste discharged from or
processed in that facility. .
(8) Enter into a contract for the construction and installation of any outlet, sewer system, treatment works,
pretreatment facility or disposal system or for the alteration or extension of any such facility. .
(9) Dispose of sludge resulting from the operation of a treatment works, including the removal of in -place sewage
sludge from one location and its deposit at another location, consistent with the requirement of the Resource
Conservation and Recovery Act and regulations promulgated pursuant thereto.
(10) Cause or permit any pollutant to enter into a defined managed area of the State's waters for the maintenance or
production of harvestable freshwater, estuarine, or marine plants or animals.
(11) Cause or permit discharges regulated under G.S..143-214.7 that result in water pollution.
(12) Construct or operate an animal waste management system, as defined in G.S. 143-215.1013, without obtaining
a permit under either this Part or Part 1A of this Article.

On April 1, 2014, staff of the NC Division of Water Resources Water Quality Regional Operations
Section inspected the above referenced facility for the purpose of obtaining water samples from
ditches, canals, and the stormwater system. We wish to thank Mr. Joe Miller, Timothy Waters,
Shelton Cooper, and Wes Spray who were present and assisted during the water sampling project.
Complete facility access was denied to Division staff and the collection of water samples was
prohibited in some areas. As a result of this incident, you are hereby notified that, having been
permitted under an NPDES permit for the subject facility pursuant to the requirements of North
Carolina General Statute 143-251.1, Section 402 of the Clean Water Act, and the Memorandum of
Agreement between North Carolina and the US Environmental Protection Agency dated May 9,
1994, you have been found to be non -conforming with NPDES Permit No. NCA148024, issued to
Rose Acre Farms on November 23, 2004. The following items specify permit conditions and
limitations that were not adhered to during the time of the inspection, based on failure to provide
access for the purpose of water sample collection.
Deficiency 1 (Section IV. Inspections and Entry):
Failure to grant access to Division staff and allow for collection of water samples from ditches,
canals, and/or other locations at the facility.
Conditions IV. Inspections and Entry 1. a. d., and e. state:
The Permittee shall allow any authorized representative of the Department of Environment and
Natural Resources or EPA, upon presentation of credentials and other documents as may be
required by law and in accordance with reasonable and appropriate biosecurity measures to:

a. Enter the Permittee's premises where a regulated facility or activity is located or conducted,
or where records must be kept under the conditions of this permit;
d. Sample or monitor, at reasonable times, for the purpose of assuring permit compliance, or
as otherwise authorized by the Act, any substances or parameters at any location;
e. Enter the Permittee's premises to monitor atmospheric nitrogen emissions and to monitor
ambient surface water conditions as deemed necessary.
Required Corrective Action for Deficiency 1:
Provide unrestricted access to water sampling locations at the facility, as required by the permit.
You are required to immediately take any necessary action to correct the above concern. Full site
access shall be granted during any future site visit by Division of Water Resources staff to collect
water quality samples, as provided in terms and conditions of NPDES Permit No. NCA148024.

Anonymous caller reports following concerns at Rose Acre Egg
Farm facility: groundwater lowering drains constructed and are
present under chicken houses. Groundwater drains drain to
ditches at facility. Drain outlets are camouflaged. Last seven
chicken houses built did not have rebar in the floor. Floors are
cracked and cracking. Concern that high moisture level in
houses may be seeping through floor cracks and impacting
groudwaler, which then drains to groundwater control drainage.
