Sullins Dee Freeman Governor Director Secretary April 2, 2009 DWQ Project # 09-0566 Johnston County Mr. Joe Poole Caterpillar 954 NC 42 East Clayton, NC 27520 Subject Property: Caterpillar Access Road UT to Neuse River [030402,27-(39.7), WSIV, NSW] REQUEST FOR MORE INFORMATION: STORMWATER MANAGEMENT PLAN Dear Mr. Poole: On May 21, 2009, the Division of Water Quality (DWQ) issued a 401 Water Quality Certification to permanently impact 192 linear feet of perennial stream, 9,770 square feet of Zone 2 Neuse River basin riparian buffer, and 15,004 square feet of Zone 1 Neuse River basin riparian buffer to facilitate development of the Caterpillar Core PDC site. In order to meet Conditions 6 and 7 of the 401 Certification for this project, a stormwater management plan prepared by your consulting engineer McKim & Creed, dated August 12, 2009, was received by the DWQ on August 13, 2009. The DWQ has determined that this stormwater management plan was incomplete as discussed below. Additional Information Requested: 1. Please provide a BMP Supplement Form for each proposed best management practice that will be used on the site (including both worksheets, Design Summary and Required Items Checklist), as well as all of the required items. The BMP Supplement Forms are available on the DWQ web site at: http://h2o.enr.state.nc.us/su/bmp forms htm. The DWQ will conduct a detailed review of the BMP designs after this information has been submitted. 2. The level spreader that is proposed downslope of BMP #1 must be relocated to an area that has appropriate slope and topography per Chapter 8 of the BMP Manual. Condition 7 states: "All areas on the site that shall be utilized for equipment testing shall be shown clearly on the plans... In addition, the testing processes themselves and their impacts on the natural land surface shall be described in detail. Any areas that will be left undisturbed on an ongoing basis shall be equipped with appropriate Sediment and Erosion Control measures..." Although the testing area has been shown clearly on the plans, the remainder of this condition does not appear to have been met.
