Sullins Dee Freeman Governor Director Secretary August 19, 2009 CERTIFIED MAIL: RETURN RECEIPT REQUESTED Mr. Dale King City of Durham 2011 Fay Street Durham, NC 27704 Subject Property: Third Fork Creek Southern Greenway REQUEST FOR MORE INFORMATION Dear Mr. King: DWQ EXP No. 04-1920v2 Durham County On August 17, 2009, the Express Review Program of the Division of Water Quality (DWQ) received your application dated August 17, 2009, to fill or otherwise impact 0.374 acres of wetland, 157 linear feet of intermittent stream and 4,440 square feet of Zone 1 Jordan Water Supply basin protected riparian buffer, and 7,950 square feet of Zone 2 Jordan Water Supply basin protected riparian buffer, to construct the proposed greenway at the site. The DWQ has determined that your application will require additional information. Please provide the following information so that we may continue to review your project and prevent denial of your application as required by 15A NCAC 2H .0506: Additional Information Requested 1. Aquatic Life Passage: a. Please provide typical details for the intermittent stream culverts indicating provisions for aquatic life passage. Placement of culverts and other structures in waters, streams, and wetlands must be placed below the elevation of the streambed by one foot for all culverts with a diameter greater than 48 inches, and 20% of the culvert diameter for culverts having a diameter less than or equal to 48 inches, to allow low flow passage of water and aquatic life. b. Please provide typical detail of a cross section of the proposed concrete boardwalk with a stream crossing, showing location of footers, etc. and sequence of work. Please respond within five (5) days of the date of this letter by sending two (2) copies of the above information in writing. The Express Review Program is a process that requires all parties to participate in a timely manner. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
