Dear Mr. Carmon:
On August 5, 2009,the Division of Water Quality(DWQ)received your application dated July 22, 2009,
to fill or otherwise impact 43 linear feet of intermittent stream(temporary impact)and 1,260 square feet
of Zone 1 Tar-Pamlico River basin protected riparian buffers and 752 square feet of Zone 2 Tar-Pamlico
River basin protected riparian buffers to provide sanitary wastewater collection and transportation to the
Town of Leggett, Phillips School,Coker-Wimberly School,and a portion of the NC Highway 97 corridor.
The DWQ has determined that your application was incomplete and/or provided inaccurate information
as discussed below. The DWQ will require additional information in order to process your application to
impact protected wetlands and/or streams on the subject property. Therefore, unless we receive five
copies of the additional information requested below,we will place this project on hold as incomplete
until we receive this additional information. If we do not receive the requested information, your project
will be formally returned as incomplete. Please provide the following information so that we may
continue to review your project.
Additional Information Requested:
I. Please verify that the USACE will be permitting this project under solely a Nationwide Permit 12,
and not a Nationwide Permit 12 and a Nationwide Permit 39 and/or Nationwide Permit 29.
2. Please provide a qualitative indirect and cumulative impact analysis for the project. Please see
DWQ's policy for guidance on our website at:

Will any undeveloped parcels be served by this sanitary sewer project?
3. Please note that your buffer impacts are considered permanent, and not temporary, by the DWQ.
