Thank you for your recent call regarding the freeboard levels at your facilities On February 25, 2016, during a telephone conversation with staff of the NC Division of Water Resources (DWR), you reported a high freeboard level (18.5 inches) in the primary lagoon. Please be advised that failure to maintain waste levels in your lagoon/storage ponds in accordance with the facility's Certified Animal Waste Management Plan and with Condition V. 2. of NC Swine Waste System General Permit could result in other actions being taken by the Division in response to compliance matters. Deficiency 1: On February 25, 2016, a lagoon/storage pond level was documented at 18.5 inches of freeboard at the primary lagoon. A level of 19 inches is the maximum level allowed by your permit and Certified Animal Waste Management Plan, Thank you for submitting a 30-day Plan of Action on February 25, 2016. Take all necessary additional steps to insure lagoon levels remain in compliance with Section 2 of your permit. The Washington Regional Office has determined that no further enforcement actions will be taken by the Division for the inadequate freeboard. However, upon review and consideration of the information submitted, the Washington Regional Office has determined that an NOV is appropriate due to the freeboard being less than the structural limit of 12 inches. On April 21, 2003 the freeboard was noted as being 8 inches. In the future, please continue to evaluate ways to maintain freeboard levels in the required range (start pump mark of 19" & stop pump mark of 54"). These methods include, but are not limited to, water conservation practices, adding additional application sites, updating your cropping systems, adding additional and/or more flexible application equipment, and maintaining the lagoon levels at the lowest allowable and appropriate levels throughout the year. Also, attached to this letter, you will find copies of correspondence that has taken place between Neil Zahradka, LNM Manager for the Va. Division, and yourself over the last few months. In particular, I refer you to a April 25, 2003 letter sent to you by Neil that outlines the actions taken to improve our freeboard situations on these farms. These correspondence provide a timeline and documentation of our actions on these farms. As stated in the letter referenced above, a thorough root cause analysis of each of these freeboard issues will occur through our EMS. Once immediate issues are taken care of, work on longer -term corrective action can, and will, occur. OF CAROLINA April 25, 2003 Mr. Scott Vinson Environmental Specialist NC Department of Environment and Natural Resources Washington Regional Office 943 Washington Square Mall Washington, NC 27889 RE: Response to lagoons with structural freeboard issues Dear Mr. Vinson: RECEIVED APR 3 0 2003 DWQ'WARO This correspondence is provided to supply your office with additional information regarding Murphy -Brown's response to sow farms in the Washington region that are experiencing delays in regaining the full 12" of structural freeboard. As of 1:00 PM 4/25/03, this list includes only Farms 25-26 (Facility ID 66-34). We wish to emphasize that throughout these extraordinary weather conditions, our Environmental Management System has continued to provide protection to waters of the state, to include 1) immediate action to prevent environmental harm, 2) longer term response to address these problems as we progress through the application season, and 3) a root cause analysis of all farms experiencing freeboard problems to prevent reoccurrence. Our foremost immediate action included prudent land application practices that will not allow ponding or runoff to occur. This decision has at times delayed our ability to lower lagoon levels, but has assured protection of local waterways. Secondly, acquisition of additional irrigation equipment has occurred throughout our system in order to reduce the time required to initiate land application activities at each site. We have also mobilized additional internal and external labor resources to ensure appropriate monitoring and inspection procedures are maintained. Emergency water savings management was implemented which lowered the fresh water input from washdowns, and priority installation of additional water savings devices in the sow housing facilities was enacted. As continued adverse weather conditions reduced the positive effect of land application activities, we chose to reduce the populations in the finishing component of these farrow -finish farms through removal of animals. Further action has included 1) cessation of feeder pig placement in the finishing barns and 2) procedures that will reduce the sow populations. These actions related to animal population, although extremely costly, will bolster the efforts to control freeboard until adequate land application is possible. Longer term steps to affect the freeboard maintenance have been initiated, to include acquisition of additional pumping and land application equipment, modification of existing labor pools for land application. The final outcome of these efforts will be driven by an exhaustive root cause evaluation of the current freeboard situation at each individual farm. While the extraordinary rainfall amounts can certainly be identified as the major contributor to the current conditions, any and all other factors will be evaluated. Murphy -Brown is committed to responsible environmental management under all types of weather conditions that we may encounter. Our implementation of immediate and long-term corrective actions coupled with root cause evaluations will serve to meet that goal. I know that the farms are covered by the same permit, however the most important fact here is that the receiving farm is currently having freeboard problems. If the rain persists before this farm's lagoon has not been able to be lowered then Farm 35's lagoons, with the additional waste, might very well enter into it's structural freeboard with the possibility of breaching. Please hold off on any pump'and haul activities until approval has been given by DWQ. We did not reset the freeboard marker at that time, as we knew that any inaccuracy would be conservative. Please read this inspection and keep it with all other documents pertaining to your animal operation for future inspections. In general, these inspections included verifying that: (1) the farm has a Certified Animal Waste Management Plan (CAWMP); (2) the farm is complying with requirements of the State Rules 15 NCAC 2H.0217, Senate Bill 1217, and the Certified Animal Waste Management Plan; (3) the farm operation's waste management system is being operated properly under the direction of a Certified Operator; (4) the required records are being kept; and (5) there are no signs of seepage, erosion, and/or runoff. The following deficiencies were noted during the inspection: ➢ According to the new IRR 2 format, over -application of Nitrogen was noted in field # 1(28.13ac) which exceeded the PAN by 2%. In accordance with condition II, item 4 of your General Permit, land application rates shall be in accordance with the Certified Animal Waste Management Plan (CAWMP). In no case shall land application rates exceed the Plant Available Nitrogen (PAN) rate for the receiving crop or result in runoff during and given application. ➢ The irrigation records were initially confusing and incomplete. The irrigation worksheets that were completed in the field are satisfactory, however the IRR 2 records are not forms that have been either provided by nor approved by the DWQ. Please be advised that in accordance with Condition III, item 5 of your General Permit, "records, including land application event(s) and removal of solids to an off -site location(s) records, shall be maintained by the Permittee in chronological and legible form for a minimum of three years. These records shall be maintained on forms provided or approved by the DWQ and shall be readily, available for inspection.' This situation has been discussed before and a previous form that was being used provided all the required information. It.is recommended to begin using the IRR I & IRR 2 forms provided by the Division and the irrigation records should be maintained locally.
