Thank you for your recent call regarding the freeboard levels at your facilities. On April 26,
2017 during a telephone conversation with staff of the NC Division of Water Resources (DWR),
you reported a high freeboard level (16 inches) in the primary lagoon.
Please be advised that failure to maintain waste levels in your lagoon/storage ponds in
accordance with the facility's Certified Animal Waste Management Plan and with Condition V,
2. of NC Swine Waste System General Permit could result in other actions being taken by the
Division in response to compliance matters.
Deficiency 1:
On April 26, 2017, a lagoon/storage pond level was documented at 16 inches of freeboard at the
primary lagoon. A level of 19 inches is the maximum level -allowed by your permit and Certified
Animal Waste Management Plan.
Corrective Action for Deficiency 1:
Thank you for submitting a 30-day Plan of Action on April 26, 2017. Take all necessary
additional steps to insure lagoon levels remain in compliance with Section 2 of your permit.

Please work to ensure that your facility is managed in a way to maintain compliance with permit
and animal waste management plan requirements. Failure to comply with conditions in a permit
may result in a recommendation of enforcement action, to the Director of the Division of Water
Quality who may issue a civil penalty assessment of not more that twenty-five thousand
($25,000) dollars against any "person" who violates or fails to act in accordance with the terms,
conditions, or requirements of a permit under authority of G.S. 143-215.6A. To minimize the
potential for any possible future compliance matters attributable to prolonged wet weather
conditions, you may wish to review your animal waste management system design, as well as the
waste plan itself, for any potentially beneficial modifications and/or improvements.

On February 9, 2010, during a telephone conversation with staff of the NC Division of Water Quality
(DWQ) Aquifer Protection Section (APS), you reported a high freeboard level (18.5 inches) in the
primary lagoon.
As a result of this incident, you are hereby notified that, having been permitted to have a non -discharge
permit for the subject animal waste disposal system pursuant to 15A NCAC Section .1300, you have
been found to be in violation of your Certified Animal Waste Management Plan and the Swine Waste
System General Permit No. AWG100000 that you are covered to operate under, as follows:
Deficiency 1:
Failure to maintain waste levels in your lagoon/storage ponds in accordance with the facility's Certified
Animal Waste Management Plan in accordance with Condition V. 2. of Swine Waste System General
Permit No. AWG 100000
On February9, 2010, a lagoon/storage pond level was documented at 18.5 inches of freeboard at the
primary lagoon. A level of 19 inches is the maximum level allowed by your permit and Certified
Animal Waste Management Plan.

Required Corrective Action for Deficiency 1:
A 30 Day Plan of Action (POA) was submitted to DWQ within two (2) days of the high freeboard
occurrence. Take all necessary additional steps to insure lagoon levels remain in compliance with
Section 2 of your permit.
You are required to take any necessary action to correct the above violations on or before March
9, 2010 and to provide a written response to this Notice within 30 days of receipt of this letter
indicating that freeboard is at a compliant level. Please include in your response all corrective
actions already taken and a schedule for completion of any corrective actions not addressed.

On May 10, 2000, I conducted an Animal Feedlot Operation Compliance Inspection at the Danny Miller
Swine Farm in Greene County. A copy of the inspection report is attached for your review.
In genctal, this inspection included verifying that: (1) the farm has a Certified Animal Waste Management
Plan (CAWMP) and the General Permit; (2) the farm is complying with requirements of the State Rules 15
NCAC 2H.0217, Senate Bill 1217, the Certified Animal Waste Management Plan and the General Permit;
(3) the farm operation's waste management system is being operated properly under the direction of a
Certified Operator; (4) the required records are being kept; (5) there are no signs of seepage, erosion,
and/or r uno$ The following deficiencies were observed during the inspection
➢ Your Certified Animal Waste Management Plan records did not include a soil analysis for 1999. In
Section Ill. Monitoring and Reporting Requircments, item number 3 ofthe General Permit it is a
requirement that a soil analysis be collected annually on each application field receiving animal waste.
Further, Semon IL Operation and Maintenance Requirements, item number 3 requires that lime be
applied; as needed, to maintain soil pH in the optimum range for crop production. This information is
received from your annual soil analysis.
It is very important as the owner and the Operator in Cbarge that you resolve these aforementioned
deficiencies and any other problems that may arise, as soon as possible. Nothing in this letter should be
taken as absolving this facility of the responsibility and liability of any violations that have resulted or
may result from these deficiencies.

Dear Mr. Miller:
On April 28, 1998, 1 conducted an Animal Feedlot Operation Site Inspection at
the Danny Miller Swine Farm in Greene County. A copy of the inspection report
is attached for your review.
In general, this inspection included verifying that: (1) the farm has a Certified
Animal Waste Management Plan (CAWMP) and the General Permit; (2) the farm
is complying with requirements of the State Rules 15 NCAC 2H.0217, Senate Bill
1217, the Certified Animal Waste Management Plan and the General Permit; (3)
the farm operation's waste management system is being operated properly under
the direction of a Certified Operator; (4) the required records are being kept; (5)
there are no signs of seepage, erosion, andlor runoff. The following deficiencies
were observed during the inspection.
➢ The current waste utilization plan for your facility does not contain all of the
receiving crops and/or land that are being utilized for waste management. All
receiving crops and/or land being utilized for waste management are required

to be included in the waste Utilization plan. Please refer to the attached
inspection form for further comments.
➢ The irrigation records should correspond with the acreage, fields, and PAN per
acre in the waste utilization plan.
➢ The CAWMP should include the land owner agreement from Mr. Jones and the
land tract should be included in the total acreage available for irrigation.
➢ Vegetate bare areas on the lagoon dike walls to prevent further erosion.
It is very important as the owner and the Operator in Charge that you resolve
these aforementioned deficiencies and any other problems that may arise, as
soon as possible. For additional assistance, please contact your Technical
Specialist. Nothing in this letter should be taken as absolving this facility of the
responsibility and liability of any violations that have resulted or may result from
these deficiencies.
