Thank you for your recent call regarding the freeboard levels at your facilities. On May 9, 2016,
during a telephone conversation with staff of the NC Division of Water Resources (DWR), you
reported a high freeboard level (16 inches) in the primary lagoon.
Please be advised that failure to maintain waste levels in your lagoon/storage ponds in
accordance with the facility's Certified Animal Waste Management Plan and with Condition V.
2. of NC Swine Waste System General Permit could result in other actions being taken by the
Division in response to compliance matters.
Deficiency 1: On May 9, 2016, a lagoon/storage pond level was documented at 16 inches of
freeboard at the primary lagoon. A level of 20 inches is the maximum level allowed by your
permit and Certified Animal Waste Management Plan.

We have noted chronic rainfall events in North Carolina that are historic rainfall totals in some
areas. Thank you for your recent call regarding the freeboard levels at your facilities. On
February 9, 2016, during a telephone conversation with staff of the NC Division of Water
Resources (DWR), you reported a high freeboard level (15 inches) in the primary lagoon.
Please be advised that failure to maintain waste levels in your lagoon/storage ponds in

(DWQ) Aquifer Protection Section (APS), you reported a high freeboard level (17 inches) in the
primary lagoon.
As a result of this incident, you are hereby notified that, having been permitted to have a non -discharge
permit for the subject animal waste disposal system pursuant to 15A NCAC Section .1300, you have
been found to be in violation of your Certified Animal Waste Management Plan and the Swine Waste
System General Permit No. AWG 100000 that you are covered to operate under, as follows:

A 30 Day Plan of Action (POA) was submitted to DWQ within two (2) days of the high freeboard
occurrence. Take all necessary additional steps to insure lagoon levels remain in compliance with

15, 2010 and to provide a written response to this Notice within 30 days of receipt of this letter

This letter is in reference to your January 240 letter regarding an NOV issued (case # NOV-2006-
sp-0007) to our Red Hill facility # 40-131 I would appreciate your reconsideration of this matter. Upon
review of the events leading up to this mishap it appears that a mistake in judgment on our part was clearly
made. However, I feel strongly that this incident should be classified as an accidental discharge into a
waterway since the water collected in a waterway found in field B (20.31ac) reference CAWMP. The
guidance for this type of mishap is found in section I of the NPDES permit entitled "performance
standards". Paragraph four, sections d and a specifically address this. It states that "any discharge of
application of waste to a ditch which drains to surface waters or wetlands is prohibited except as follows:
(d) the waste was removed immediately from the ditch upon discovery and (e) the event was documented
and reported in accordance with part IIl. II of this permit." The incident was attended to immediately and
no waste left the property. This is well documented through photographs that you have been exposed to
and should have on file as well as our internal liquid waste mishap form provided to you dated 1/12/2006.
Again, I would appreciate your reconsideration of this matter and hopefully reclassification of this mishap.
I appreciate your time and the good job you do. Please understand that this letter is in no way a
complaint and should not be received as such, only an attempt to interpret my permit as written and
maintain as a responsible environmental record as possible.

This letter is to notify you that facility number 40-131 is in violation of its Certified Animal Waste
Management Plan (CAWMP) and North Carolina Administrative Code Subchapter 15A.0217 for excessive
ponding (standing wastewater) at the subject farm in application area/field B. Mr. Martin McLawhom from the
Washington Regional Office of the Division of Soil and Water Conservation contacted the Division of Water
Quality on January 12, 2006, to report an incident of ponding on the referenced sprayfield.
Confined Animal Feeding Operations staff of the Washington Regional Office conducted a site investigation at
approximately 04:30 PM on January 12, 2006. A site visit was conducted again by Marlene Salver on January
13, 2006 at 08:00 AM, during which ponded wastewater was observed. Specific violations are as follows:
• In accordance with the Animal Waste Operation Permit (NCA240131) and the CAWMP for the subject
facility the land application activities are to be conducted in a manner that does not result in ponding of
wastewater.

Thank you for your recent submittal of the information requested in our letter dated April 16, 2003. We greatly
appreciate the effort that you made in compiling this information and sending it to our Washington Regional Office
by the date required. We also appreciate the fact that you reported the problem with high freeboard to our staff as
required by your permit.and worked with our staff to manage the problem once it occurred.
Upon review and consideration of the information submitted, the Washington Regional Office has determined that
no further compliance/enforcement actions will be taken by the Division for these high freeboards.
Also, based on your actions to properly operate your facility, the Division of Water Quality hereby rescinds the
Notice of Violation that was issued to you on April 16, 2003 and replaces it with this Notice of Deficiency.
In the future, please continue to evaluate ways to maintain freeboard levels in the required range (19.2" to 42").
These methods include, but are not limited to, water conservation practices, adding additional application sites,
updating your cropping systems, adding additional and/or more flexible application equipment, and maintaining the
lagoon levels at the lowest allowable and appropriate levels throughout the year. Our staff looks forward to
continuing to work with you and your Technical Specialist to evaluate and implement any needed changes to your
system.

On March 21, 2003, a representative of your animal operation informed the Division of
Water Quality (DWQ) that there was inadequate freeboard in the lagoon(s) serving this facility.
This lack of adequate freeboard is in non-compliance with the Certificate of Coverage
issued to this facility on June 5, 1998. In addition to this Notice of Violation (NOV), this non-
compliance is subject to an appropriate enforcement action by DWQ. This action can consist of
one or more of the following: a civil or criminal enforcement action; an injunction; and/or a
requirement to apply for coverage under an individual permit. The action chosen will be based
on complete evaluation of all factors that resulted in the inadequate freeboard; the actions taken
to restore the needed freeboard; and the actions being proposed to prevent the problem from
reoccurring.
To assist us in our review, please provide the Washington Regional Office with an
evaluation of the reasons for the freeboard violation(s) and a strategy to prevent future freeboard
violation(s). This evaluation and strategy must include but is not limited to the following:

an updated Plan of Action as to how the facility will return to compliance.
Provide a detailed description of the actions taken or proposed to be taken to insure that

On March 21, 2003, a representative of your animal operation informed the Division of .
Water Quality (DWQ) that there was inadequate freeboard in the lagoon(s) servxlag this facility.
This lack of adequate freeboard is in non-Pompliance with the Certificate of Coverage
issued to this facility on June 5, 1998. In addition to this Notice of Violation (NOV), this non-
compliance is subject to an appropriate enforcement action by DWQ. This action can consist of
one or more of the following: a civil or criminal enforcement action; an injunction; and/or a
requirement to apply for coverage under an individual permit. The action chosen will be based
on complete, evaluation of all factors that regulted in the inadequate freeboard; the actions taken
to restore the needed ffsreboard; and the actions being proposed to prevent the problem from
reoccurring.
To assist us in our review, please provide the Washington Regional Office with an
evaluation of the reasons for the freeboard violation(s) and a strategy to prevent future fteeboard
violation(s). This evaluation and strategy must inelude but is not limited to the following:

Once this information is received and evaluated by the DWQ staff, a determination will
be made as to the appropriate compliance/enforcement actions to be taken. Each case will be

problems will be positive factors in this determination,

This letter is to inform you that the Division of Water Qualitv is rescinding the Notice of Violation dated Mav 22,
2001.
The wastewater that flowed from the flush tank did not reach surface waters of the State and the product was
completely contained and pumped back into the lagoon. At the time of the inspection, many items of concern were
not provided at that time. The inspector was led to believe that the waste had flowed a significant distance prior to
being contained and pumped back into the lagoon.
The Division of Water Quality extends their apologies for incorrectly evaluating your compliance integrity.
However, as an ommer and operator of animal operations in the State of North Carotina you are required to property
operate the waste management facilities, maintain appropriate records and provide components of your Certified
Animal Waste Management Plan and documentation to support your activities during, inspections.

This letter is to notify you that facility # 40-131 is in violation of its CAWMP and North Carolina
Administrative Code Subchapter 15A .0217. On March 7, 2001, Lyn Hardison from the
Washington Regional Office of the Division of Water Quality conducted an Animal Operation
Compliance Inspection at your facility in Greene County. A copy of the inspection report is
attached for your review.
In general, this inspection included verifying that: (1) the farm has a Certified Animal Waste
Management Plan (CAWMP); (2) the farm is complying with requirements of the State Rules 15
NCAC 2H.0217, Senate Bill 1217, and the Certified Animal Waste Management Plan; (3) the
farm operation's waste management system is being operated properly under the direction of a
Certified Operator; (4) the required records are being kept; (5) there are no signs of seepage,
erosion, and/or runoff. The following violations were noted during the inspection.
(p A small amount of recycled wastewater spilled from the flush gutter onto the ground
when a small piece of plastic lodged in the discharge pipe that leads to the lagoon. The
wastewater was completely contained onsite, recovered and pumped into the lagoon.
DWQ was notified of this incident within 24 hours and is in receipt of a written
response to the incident.
It is very important as the owner and/or the Operator in Charge that these aforementioned
violations and any other problems that may arise be resolved, as soon as possible. For additional
assistance, please contact your Technical Specialist.

2 - On 3-2-01, there was a small flushing problem @ house # 1 which resulted in less than 1000 gallons of wastewater overflowed the
flushing gutter onto the ground and into the grass waterway area. The area was dammed and the wastewater was completely
contained and pumped hack into the lagoon. DWQ was notified via telephone and in writing as the permit requires.
* The tree near the lagoon has been removed and the plans are to grout out the roots and fill it back in.

Dear Ms. Cullom:
The purpose of this letter is to inform you of a spill that occurred on the Red Hill farm
(40-131) on March 2, 2001, between the hours of 9:30-12:30 that morning, when
a piece of plastic lodged in the discharge pipe that leads to the lagoon in house # 1. An
estimated 900-1200 gallons of recycled water from the lagoon escaped from the flush
gutter into a waterway, that runs parallel to lagoon structure. The waterway was dammed
immediately and the waste water was pumped back into the lagoon. No discharge to the
waters of the state occurred. However it is my intension always to be honorable and fore
right about the operation of any farm within our system. For that reason I want to
document this event.

Dear Mr. Stokes:
On September 11, 1998, 1 conducted a Follow-up Animal Feedlot Operation Site
Inspection at the Red Hill Farm in Greene County due to a referral from the
Division of Soil & Water. A copy of the inspection report is attached for your
review.
In general, this inspection included verifying that: (1) the farm has a Certified
Animal Waste Management Plan (CAWMP) and the General Permit; (2) the farm
is complying with requirements of the State Rules 15 NCAC 21-1.0217, Senate Bill
1217, the Certified Animal Waste Management Plan and the General Permit; (3)
the farm operation's waste management system is being operated properly under
the direction of a Certified Operator; (4) the required records are being kept; (5)
there are no signs of seepage, erosion, and/or runoff. The following deficiencies
were observed during the inspection.
➢ Overapplication of animal waste in excess of the Plant Available Nitrogen Rate
set our in your CAWMP for the receiving crop(s) was noted in the irrigation
records (IRR-1 & IRR-2).

On May 5, 1998, I conducted an Animal Feedlot Operation Site Inspection at the
Red Hill Farm in Greene County. A copy of the inspection report is attached for
your review.
In general, this inspection included verifying that: (1) the farm has a Certified
Animal Waste Management Plan (CAWMP) and the General Permit; (2) the farm
is complying with requirements of the State Rules 15 NCAC 2H.0217, Senate Bill
1217, the Certified Animal Waste Management Plan and the General Permit; (3)
the farm operation's waste management system is being operated properly under
the direction of a Certified Operator; (4) the required records are being kept; (5)
there are no signs of seepage, erosion, and/or runoff. The following deficiencies
were observed during the inspection.
➢ Failed to have the required waste analysis. The wastewater must be
sampled within sixty (60) days of application. It is suggested to collect a
sample for analysis every 120 days to meet the requirement.

You were notified by letter dated November 12, 1996, that you were required to designate a
certified animal waste management system operator as Operator in Charge for the subject facility by
January 1, 1997. Enclosed with that letter was an Operator in Charge Designation Form for your
facility. Our records indicate that this completed Form has not yet been returned to our office.
For your convenience we are sending you another Operator in Charge Designation Form for your
facility. Please return this completed Form to this office as soon as possible but in no case later
than April 25, 1997. This office maintains a list of certified operators in your area if you need
assistance in locating a certified operator.
Please note that failure to designate an Operator in Charge of your animal waste management
system, is a violation of N.C.G.S. 90A-47.2 and you will be assessed a civil penalty unless an
appropriately certified operator is designated. Please be advised that nothing in this letter should be
taken as absolving you of the responsibility and liability for any past or future violations for your
failure to designate an appropriate Operator in Charge by January 1, 1997.
