Upon review of the events leading up to this mishap it appears that a mistake in judgment on our part was clearly made. However, I feel strongly that this incident should be classified as an accidental discharge into a waterway since the water collected in a waterway found in field B (20.31ac) reference CAWMP. The guidance for this type of mishap is found in section I of the NPDES permit entitled "performance standards". Paragraph four, sections d and a specifically address this. It states that "any discharge of application of waste to a ditch which drains to surface waters or wetlands is prohibited except as follows: (d) the waste was removed immediately from the ditch upon discovery and (e) the event was documented and reported in accordance with part IIl. II of this permit." The incident was attended to immediately and no waste left the property. This is well documented through photographs that you have been exposed to and should have on file as well as our internal liquid waste mishap form provided to you dated 1/12/2006. Again, I would appreciate your reconsideration of this matter and hopefully reclassification of this mishap. I appreciate your time and the good job you do. Please understand that this letter is in no way a complaint and should not be received as such, only an attempt to interpret my permit as written and maintain as a responsible environmental record as possible. On March 7, 2001, Lyn Hardison from the Washington Regional Office of the Division of Water Quality conducted an Animal Operation Compliance Inspection at your facility in Greene County. A copy of the inspection report is attached for your review. In general, this inspection included verifying that: (1) the farm has a Certified Animal Waste Management Plan (CAWMP); (2) the farm is complying with requirements of the State Rules 15 NCAC 2H.0217, Senate Bill 1217, and the Certified Animal Waste Management Plan; (3) the farm operation's waste management system is being operated properly under the direction of a Certified Operator; (4) the required records are being kept; (5) there are no signs of seepage, erosion, and/or runoff. An estimated 900-1200 gallons of recycled water from the lagoon escaped from the flush gutter into a waterway, that runs parallel to lagoon structure. The waterway was dammed immediately and the waste water was pumped back into the lagoon. No discharge to the waters of the state occurred. However it is my intension always to be honorable and fore right about the operation of any farm within our system. For that reason I want to document this event. A copy of the inspection report is attached for your review. In general, this inspection included verifying that: (1) the farm has a Certified Animal Waste Management Plan (CAWMP) and the General Permit; (2) the farm is complying with requirements of the State Rules 15 NCAC 21-1.0217, Senate Bill 1217, the Certified Animal Waste Management Plan and the General Permit; (3) the farm operation's waste management system is being operated properly under the direction of a Certified Operator; (4) the required records are being kept; (5) there are no signs of seepage, erosion, and/or runoff.
