Director Division of Water Quality November 28, 2005 Mr. Jason Payne Soil and Environmental Consultants 11010 Raven Ridge Road Raleigh, NC, 27614 Subject Property: Hunter's Run, Section 2 DWQ Project # 20051658 Pitt County On-Site Determination for Applicability to the Neuse River Riparian Area Protection Rules (15A NCAC 2B.0233) Dear Mr. Payne: On November 23, 2005, at your request I conducted an on-site determination to review a feature located on the subject property for applicability to the Neuse Buffer Rules (15A NCAC 2B.0233). The stream is labeled as "C" on the attached map initialed by me on November 23, 2005. Division of Water Quality (DWQ) Staff from the Washington Regional Office (Kyle Barnes) had previously conducted an on-site determination of the stream. In your letter to the Director dated October 31, 2005, you requested an appeal of their determination as provided within 15A NCAC 02B .0233(3)(a). At your request, I conducted an appeal of their determination as stated above. During my review I evaluated the stream using the DWQ Stream Classification Form. I evaluated the stream reach C and calculated the score to be 26 points. The form states that if the score is "greater than or equal to 19 points the stream is at least intermittent". The DWQ has determined that the stream labeled as "C" on the attached map is at least "intermittent" and is subject to the Neuse Buffer Rule. This determination shall support and confirm the determination originally performed by the Regional Office. This stream and its associated buffers should be identified on any future plans for this property. The owner (or future owners) should notify the DWQ (and other relevant agencies) of this decision in any future correspondences concerning this property. This letter only addresses the applicability to the buffer rules and does not approve any activity within the buffers. Nor does this letter approve any activity within Waters of the United States or Waters of the State. Nov 1 -,2005 DENR - WATER QUALITY RE: Buffer Determination Appeal for Stream Feature C, WEnMDS NO STORMWATER BRANCH Hunter's Run, Section 2; Ayden, Pitt County, North Carolina On behalf of the property owner, Kenneth Smith, we request an appeal of the buffer determination performed by Mr. Kyle Barnes on September 1, 2005 for the Hunter's Run - Section 2 Site. Mr. Barnes met S&EC on site and determined feature C to be subject to the Neuse Buffer Rule (see attached USGS topographic map). However, we believe this feature lacks the necessary indicators of an intennittent/buffered stream channel. Therefore, we request a re-evaluation of Mr. Barnes' analysis. Please accept this letter as an official request. We are only appealing the determination of stream "feature C". We do not disagree with the other determinations throughout the property. Your help in clarifying the status of the application of the Neuse Buffer Rules to this feature is greatly appreciated.
