This approval allows you to: 1. Maintenance dredge existing boat basin to a depth of -7 ML W (240' X 120'). 2. Maintenance dredge existing access channel to a depth of -7 ML W (250' X 50 '). 3. The depth of the boat basin and access channel is not to exceed the permitted depth of Banks Channel which is -7MLW. This approval is only valid for the purpose and design that you described in your CAMA Major application received by the Division of Water Quality (DWQ) Wilmington regional Office (WiRO) on August 16, 2005. After reviewing your application, we have determined that General Water Quality : Certification Number 3400 covers this activity. This Certification can also be found on line at: Jhttp://h20.enr.state.nc.us/ncwetlands/certs.htmI.This Certification allows you to use your CAMA Permit when the NC Division of Coastal Management issues it. Please keep in mind that there may be additional Federal, State or Local regulations applicable to your project, such as (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations, NPDES and Coastal Stormwater. In addition, this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. Please be aware that if you change or modify your project, you must notify the Division (DWQ) in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in l5A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional conditions listed below and on the following page: 1. No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in the Pre-construction Notice Application. Bridgers Boat Basin Page Two 9. PROJECT DESCRIPTION: The project site is located at 406 Bridgers Ave., adjacent to BarIks Channel/Topsail Sound, in Topsail Beach, Pender County. To get to the property cross the Surf City Swing Bridge. At the stoplight in Surf City take a right on NC HWY 50, travel about 6 miles, take a right on Empie Ave., then a left on Bridgers Ave. The basin is located on the left side of Bridgers Ave. According to the permit application the existing boat basin is approximately 1.75 acres. The basin abuts 15 highground properties developed as residential lots. The highground properties have an average elevation of5.6' MSL. There are 12 residential structures and 3 vacant lots currently adjoining the basin. There are bulkheads constructed of various materials surrounding the basin with the exception of two lots that have not constructed any type of shoreline stabilization. The boat .basin connects to BarIks Channel / Topsail Sound via an access channel measuring approximately 50' wide and 250' long. The high ground area of this lot is vegetated primarily with Wax Myrtle (Myrica cerifera), Red Cedar (Juniperus virginiana), ornamental plants and lawn grass. There are Coastal Wetlands along approximately 75% of the perimeter of the boat basin. Portions of the perimeter have a 2' - 8' band of upper marsh with Sea Ox-eye (Borrichiafrutescens), Glasswort (Salicornia spp), Spike Grass (Distichlis spicata), and Salt Meadow Grass (Spartina patens); transitioning to a band of regularly flooded Smooth Cordgrass marsh (Sparlina alterniflora) which varies in width from 5' - 20'. There are 14 docks of various dimensions with approximately 31 total slips with in the basin. The main body of the basin has an average water depth of -3.5' @MLW and the water depths in the access channel range from -1' @MLW to -8.2' @MLW. The water depth adjacent to the mouth of the access channel is currently -8.6' @MLW. The permitted maintained depth ofBarIks Channel per the Army Corps of Engineers is currently-7' @MLW. CAMA Major Permit #30-01 was issued to Mr. William Herring (different applicant) on March 5, 2001 for his property located in the southwest comer of the boat basin. This permit authorized Mr. Herring to construct a floating dock and boatlift and to dredge around his dock and to excavate an area of marsh, approximately 396 ft.2 of high marsh and 231 ft.2 of regularly flooded Smooth Cordgrass marsh that had volunteered itself to an area that had built up over the years with sediment. I The Topsail Beach Land Use Plan classifies the highground surrounding the basin as developed. In the project area, the NC Division of Water Quality classifies the waters of the Banks Channel / AIWW and Topsail Sound, as SA. This area of Topsail Sound is not designated as primary nursery area by the NC Division of Marine Fisheries and is closed to the harvesting of shellfish. PROPOSED PROJECT: The applicant is proposing maintenance excavation of the existing boat basin measuring approximately 240' x 120' x -8@ ML Wand an access channel 250' x 50' x -8 @MLW. The access channel would terminate near BarIks Channel, a federally maintained channel. The permitted maintained depth of BarIks Channel per the Army Corps of Engineers is currently -7' @MLW. The water depth at the beginning of the access channel is presently 8.6' @ ML W. The excavated material will be used at another location for fill. The applicant is proposing to do the excavation by barge and bucket, allowing the excavated material to dewater on the barge. The excavated material would be transported to the staging area located at 406 Bridgers Avenue adjacent to the basin. At this location there is an approximately 20' wide band of coastal wetlands adjacent to a bulkhead. The applicant states that they would dismantle the floating dock that connects to 406 Bridgers Avenue to allow the barge easier access to the bulkhead for the use of the ramp to off-load the excavated material. The excavated material would remain at this site for a short period of time until transported to an off-site location, located approximately 1.5 miles to the north, know as Queens Grant to be used as fill. The fill area is located on the peninsula located between the boat basin and the northern canal at Queens Grant. The fill site is a bulkheaded peninsula and the fill area will be located 30' from the bulkhead in an area approximately 60' x 670'. 10. ANTICIPATED IMPACTS The proposed excavation would impact approximately 41,300 ft.2 of shallow bottom area with in the estuarine waters and public trust area. The spoils that will be used as fill for Queens Grant would impact approximately 46,815 ft.2 of high ground in the estuarine shoreline AEC.
