Dear Mr. Besco:
You have our approval, in accordance with the conditions listed below, to impact approximately
113 square feet (ft2) of Zone 2 of the protected buffers to construct the garage at the subj ect
property as described within your variance request dated July 26, 2005 and received by the
Division of Water Quality (DWQ) on August 22,2005. This letter shall act as your Minor
Variance approval as described within 15A NCAC 2B .0233(9)(b). In addition to this approval,
you should obtain or otherwise comply with any other required federal, state or local permits
before you go ahead with your project including (but not limited to) Erosion and Sediment
Control regulations.
This approval is for the purpose and design that you described in your application. If you change
your project, you must notify us and you may be required to send us a new application. If the
property is sold, the new owner(s) must be given. a copy of this variance approval and is
thereby responsible for complying with all conditions. This approval requires you to follow
any conditions listed below.
The Additional Conditions of the Certification are:
I. No Zone 1 Impacts
No impacts (except for "exempt" uses as identified within 15A NCAC 2B .0233) shall
occur to Zone 1 ofthe protected riparian buffers unless otherwise approved by the DWQ.
No impervious surfaces shall be added to Zone I, unless otherwise approved by the
DWQ.

2. Buffer Mitigation
You are required to mitigate for impacts to the protected riparian buffers. The required
area of mitigation to compensate for impacts to the protected riparian buffers is 170
square feet as required under this variance approval and l5A NCAC 2B .0242. We
understand that you wish to make a payment into the Riparian Buffer Restoration Fund
administered by the NC Ecosystem Enhancement Program (EEP) to meet this mitigation
requirement. This has been determined by the DWQ to be a suitable method to meet the
mitigation requirement. In accordance with l5A NCAC 2B .0242, this contribution will
satisfy our compensatory mitigation requirements under l5A NCAC 2B .0233(9)(C).
Until the EEP receives and clears your check (made payable to: DENR - Ecosystem
Enhancement Program Office), no impacts specified in this variance approval shall occur.
Ms. Susan Klimek should be contacted at (919) 733-5205 if you have any questions
concerning payment into the EEP. For accounting purposes, this variance approval
authorizes payment into the Riparian Buffer Restoration Fund to compensate for
170 ft2 of required riparian buffer mitigation for impacts to 113 ft2 of protected
riparian buffers; 03-04-02,27-43-(5.5) river and stream index."
The DWQ will also accept an alternative method of mitigation (including but not limited to
Buffer Restoration or Enhancement) pursuant to the Buffer Mitigation Rule (15A NCAC
02B .0242) to satisfy this mitigation requirement. If you choose to pursue this option, then
you are required to submit in writing a mitigation plan to the DWQ 401 OversightJExpress
Permitting Unit for review and approval. No impacts shall occur to the protected buffers
until the mitigation plan is approved by the DWQ. The DWQ has determined that you may
satisfy this mitigation requirement by planting at least 2 native woody trees and shrubs
within the retained portions of the protected buffers. You must ensure their survival for a
period of at least five (5) years. You are required to replace any of these trees or shrubs that
die within this five (5) year period. You are required to provide proof in writing that the
trees have been planted within one year of the date of this letter. The proof of plantings
shall be submitted to the Wetlands/40l Unit and copied to the Raleigh Regional Office.
3. Diffuse Flow
An additional condition is that all stormwater shall be directed as diffuse flow at non-
erosive velocities through the protected stream buffers and will not re-concentrate before
discharging into the stream as identified within l5A NCAC 2B .0233(5).
4. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or-
applicable Buffer Rules, and any subsequent modifications, the applicant is required to
return the attached certificate of completion to the 401 OversightJExpress Permitting Unit,
North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC,
27699-1650.

Requests for appeals of this decision shall be made to the Office of Administrative Hearings. If
you do not accept any of the conditions of this approval, you may ask for and adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a
hearing, send a written petition which conforms to Chapter 150B of the North Carolina General
Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC
27699-6714. This approval and its conditions are final and binding unless you ask for a hearing.
This Minor Variance Approval shall expire five (5) years from the date of this letter.
This letter completes the review of the Division of Water Quality under the Neuse River
Riparian Buffer Protection Rules [15A NCAC 2B .0233(9)(b)]. Please call Ms. Debbie Edwards

Re: Wishing Well SID Lot 22 (20051601), I looked at this when the contractor first
found out about the buffer. The foundation and several rows of cinder block were
already up. They were at first going to move the structure, but due to the presence
of some large hardwood trees, it looked like any place they moved it to would
probably damage the roots of the trees. I really don't have a problem with this one,
although they did buy the house in 2002 (not that anyone would have told them about
the buffer rules).
Re: William Riddick (20051595) I will get out to look at this after the travel
restrictions are lifted.

Riparian Buffer Protection Rules
for the Neuse and Tar-Pamlico River Basins
On Dec. 9, 1999, the North Carolina
Environmental Management Commission
adopted rules to protect 50-foot wide riparian,
or waterside, buffers along waterways in the
Neuse and Tar-Pamlico River Basins. These
buffers remove nitrogen, phosphorus, and other
pollutants from rainwater that flows into the
basins' waterways, protecting the waterways
from surrounding land uses. The rules are part
of larger nutrient reduction strategies for each
basin. In the Neuse River basin, the rules
have been effective as temporary rules since
July 22, 1997. In the Tar-Pamlico basin,
temporary rules took effect on Jan. 1,2000.
In both basins, the rules will be effective as
permanent rules on Aug. 1, 2000, pending
review by the General Assembly during the
summer.
The main rule, referred to as the buffer
protection rule, requires that up to 50 feet of
riparian area be protected and maintained on
the banks of waterways in the basin. This rule
does not require establishment of new
buffers unless .the existing use of the
buffer changes. Diffuse flow of stormwater
that runs into the buffer must be maintained.

Q: Are existing activities within SO feet of waterways exempt /tom the rules?
A: Yes. The footprint of existing, ongoing uses is exempt. These uses include, but are not limited to:
agriculture; buildings; industrial, commercial, and transportation facilities; maintained lawns; utility
lines; and on-site wastewater systems.

Q: What activities are allowed in the buffer? ~
A: The rule indudes a table of uses. In it, specific activities are listed as exempt, allowable, allowable
with mitigation, or prohibited. Exempt activities require no prior approval. Allowable and allowable
with mitigation mean that approval must be obtained from the Division of Water Quality beforehand~
The approval process will require a showing of no practical alternatives to the impact, and that the
impact will be minimized. If it is allowable with mitigation, a greater amount of buffer must be
established elsewhere to offset impacts. A separate buffer mitigation rule establishes
requirements for activities that are allowable with mitigation. Prohibited activities are not allowed,
however, a variance may be sought if one thinks that complying with the rule will cause practical
difficulties or unnecessary hardships. If an activity is not listed in the table, then it is prohibited.

vegetation in zone 1 is not compromised, and diffuse flow is reestablished~ .
a Road intrusions into the buffer are allowable with mitigation.
~ Road crossings of a waterbody that impact less than 40 feet of the bufferare exempt. Wider
crossings that are less than 150 feet wide are allowable, and those over -ISO feet wide are allowable
with mitigation.
a New ponds in drainageways are allowable if a 50-foot buffer is established around the new ponds, or
allowable with mitigation if a new buffer is not established~
a Fertilizer application is prohibited, except for one-time application to establish replanted vegetation.
