This letter is to notify you that the subject facility is in violation of its General Permit
NCA437001 Condition 11.16.
Your NPDES Permit Number NCA437001 Condition II.16 states:
"Within one hundred and twenty (120) days of the effective date of a COC issued under
this permit, the Permittee shall install, operate and maintain devices on all irrigation
pumps/equipment designed to automatically stop irrigation activities during precipitation.
This condition does not apply to manure spreaders or other equipment pulled by manned
vehicles.
The Permittee will not be required to install, operate and maintain the devices if the
Permittee commits to provide for the presence of the OIC or the designated backup OIC
at all times during the land application of waste. This commitment must be submitted in
writing to the Division prior to the 120`h day following the effective date of the COC on a
form supplied by, or approved by, the Division.
On 3/25/2004, you received a letter from the Division of Water Quality (DWQ) advising you of
the requirements of your permit. DWQ still has not received notification of your commitment
on this matter.

Enclosed please find a copy of the Compliance Site Inspection (as viewed in the DWQ database) conducted at the
referenced facility by the Division of Water Quality from the Washington Regional Office. Please read this
inspection and keep it with ail other documents pertaining to your animal operation for future inspections.
In general, these inspections included verifying that: (1) the farm has a Certified Animal Waste Management Plan
(CAWMP); (2) the farm is complying with requirements of the State Rules 15 NCAC 21-1.0217, Senate Bill 1217, and
the Certified Animal Waste Management Plan; (3) the farm operation's waste management system is being operated
properly under the directian•of a Certified Operator; (4) the reed records are being kept; and (5) there are no signs
of seepage, erosion, and/or runoff. The following deficiencies were noted during the inspection:
There are holes along dice walls from rodent activity. These holes need to be filled and compacted and efforts
need to continue to eradicate rodents. In accordance with condition III, item I of your General Permit, an
inspection of the waste collection, treatment, and storage structures and runoff control measures shall be
conducted at a frequency to insure proper operation but at least monthly and after storm events. For example,
lagoons, storage ponds, and other structures should be inspected for evidence of erosion, leakage, damage by
animals or discharge.
As a reminder, please note the following comments, which are conditions of the Certified Animal Waste Management
Plan and the General Permit; therefore, these items must be implemented:
q) The maximum'waste level in lagoons/storage ponds shall not exceed that specified in the CAWMP. At a
minimum, maximum waste level for waste for lagoons/storage ponds must not exceed the level that provides
adequate storage to contain 25 year, 24 hour storm event plus an additional foot of structural freeboard
rp An analysis of the liquid animal waste from the lagoon shall be conducted as close to the time of application as
practical and at least within 60 days (before or after) of the date of application. This analysis shall include the
following parameters: Nitrogen; Phosphorus, Zinc and Copper.
ea Soil analysis is required annually. Lime is to be applied to each receiving crop as recommended by the soil
analysis.
to The following records are required: off -site solids removal, maintenance, repair, waste/soil analysis and land
irrigation records. These records should be maintained by the facility owner/manager in chronological and legible
form for a minimum of three years.
rp Land application rates shall be in accordance with the CAWMP. In no case shall land awlication rates exceed the
Plant Available Nitrogen (PAN) rate for the receiving crow or result in runoff during any Given application.
W All grassed waterways shall have a stable outlet with adequate capacity to prevent ponding or flooding damages.
The outlet can be another vegetated channel, an earth ditch, stabilization structure, or other suitable outlets.

responsibility to certify monitoring and reporting information. The failure of an OIC to perform his/her duties can
result in a letter of reprimand, suspension, of certification, or revocation of certificates.
For your information, any swine facility that has a discharge to surface waters of the State will have to apply for a
National Pollutant Discharge Elimination. System (NPDES) permit with the Division of Water Quality, effective
January 1, 2001.

Enclosed please find a copy of the Animal Feedlot Operation Site Inspection (as it is viewed in DWQ database)
conducted on December 18, 2001 at the referenced facility by the Division of Water Quality from the Washington
Regional Office. Please read this inspection and keep it with all other documents pertaining to your animal
operation for future inspections.
In general, this inspection included verifying that: (1) the farm is complying with requirements of the State
Rules 15 NCAC 2H.0217, Senate Bill 1217, the Certified Animal Waste Management Plan and/or General Permit;
(2) determine whether the waste utilization plan is based on total or actual wetted acres; (3) the farm operation's
waste management system is being operated properly under the direction of a Certified Operator, (4) the required
records arc being kept; (5) there are no signs of seepage, erosion, and/or runoff. The following deficiencies were
noted during the inspection.
cp Several irrigation events were outside of the sixty-day requirement of the most current waste analysis. In
accordance with condition III, item 4 of your General Permit, an analysis of animal waste shall be conducted
as close to the time of application as practical and at Ieast within 60 days (before or after) of date of
application. The analysis shall include the following parameters: Nitrogen, Phosphorus, Zinc and Copper. It
is suggested to collect waste sample quarterly.
cp The required records were not in an orderly fashion and not available for review. Please be advised that
records should be maintained by the facility owner/manager in chronological and legible form for a minimum
of three years.

light bulbs, gloves, syringes or any other solids waste.
q) The lagoon areas should be kept mowed or otherwise controlled and accessible. High grass does not allow
you to conduct a thorough inspection of the lagoon area for seepage, rodent damage, etc.

Enclosed please find a copy of the Animal Feedlot Operation Site Inspection (as it is
viewed in DWQ database) conducted at the referenced facility by the Division of Water
Quality from the Washington Regional Office. Please read this inspection and keep it
with all other documents pertaining to your animal operation for future inspections. r'

In general, this inspection included verifying that; (1) the farm is complying with
requirements of the State Rules 15 NCAC 21i.0217, Senate Bill 1217, the Certified Animal
Waste Management Plan and/or General Permit; (2) determine whether the waste
utilization plan is based on total or actual wetted acres; (3) the farm operation's waste
management system is being operated properly under the direction of a Certified Operator;
(4) the required records are being; kept; (5) there are no signs of seepage, erosion, and/or
runoff. The following deficiencies were observed during the inspection(s).
cp In accordance with condition 111, item 2 of your general permit, you are required to
record weekly freeboard levels on forms provided and/or approved by DWQ.
cp There are a few areas on the dike wall that need to be filled in with suitable material. in
addition, the vegetation on the dike wall should be properly maintained to prevent
rodent damage and seepage.

cp The temporary pipe used to transfer waste from the solid trap lagoons to the final
lagoon leaks around the joints causing wastewater to pond along; the toe of the dike
wall. It is suggested to implement a means to minimize any leaks.
It is very important as the owner and the Operator in Charge that you resolve these
aforementioned deficiencies and any other problems that may arise, as soon as possible.
For additional assistance, contact your Technician Specialist. Nothing in this Letter should
be taken as absolving this facility of the responsibility and liability of any violations that
have resulted or may result from these deficiencies. Failure to comply with your Certified
Animal Waste Management Plan and General Permit could result in civil penalty
assessment and/or revocation of your General Permit.
