In order to meet this directive, a representative of DENR has recently evaluated the inactive lagoon(s) and/or storage pond(s) on your property. Inactive lagoons and storage ponds were defined by the Statute as structures which were previously used to store animal waste but have not received waste for at least one year. The information collected on your property is contained in the attached field data sheets. Using this field data, staff ranked your inactive waste structures as high, medium or low according to its potential risk for polluting surface and/or groundwater. These include taking appropriate actions to eliminate current discharges, prevent future discharges and to insure the stability of their. structures. Staff of the Division of Water Quality will be in contact with owners of all inactive structures that have been determined to pose a serious environmental risk, based on its ranking and/or additional field data collected by the Department. All liquids and waste removed from these structures must be land applied at a rate not to exceed the agronomic needs of the receiving crops. Any major modifications made to the dike walls or structure must be done in accordance with current standards and under the direction of a technical specialist designated for structural design. Your local Soil and Water Conservation District is an excellent source for information and guidance related to proper waste application practices, structure operation and maintenance, and other related animal waste management standards and/or requirements. Nothing in this letter should be taken as removing from you the responsibility and liability for any past or future discharges from your lagoon(s) and/or storage pond(s) or for any violations of surface water or groundwater quality standards. The information you provided us indicated that your operation's animal population does not exceed the number set forth by 15A NCAC 2H .0217, and therefore does not require registration for a certified animal waste management plan. Under 15A NCAC 2H .0217, your facility is deemed permitted if waste is properly managed and does not reach the surface waters of the state. Any system determined to have an adverse impact on water quality may be required to obtain a waste management plan or an individual permit. You are reminded that a discharge of wastes to the surface waters of the state will subject you to a civil penalty up to $25,000 per day. Should you decide to increase the number of animals housed at your facility beyond the threshold limits listed below, you will be required to receive approval from the Division of Water Quality prior to stocking animals to that level. However, your facility is currently considered as an active farm and is subject to all of the rules and regulations as a fully stocked facility. This includes but is not limited to being subject to receiving a General Permit and the associated fee, record keeping requirements, and annual compliance inspections. To eliminate the need for the above mentioned requirements you may have your farm removed from the list of active farms. To remove your farm from the active database, please complete the enclosed form. You may reactivate your farm at any time in the future as long as it has not been classified as an abandoned facility. As a reminder, if your farm remains unstocked for a period of four consecutive years, your farm will be considered abandoned, whether you are on the active list or the inactive list. To avoid being considered an abandoned farm, you must have your facility stocked with ten percent of the farm's design capacity for a period of forty-five days during any part of the four year period. At the end of the forty- five days your farm will be eligible to begin a new four year period. If your farm is to be considered abandoned, you will no longer be able to use -your farm without meeting all of the requirements of that of a new farm including but not limited to the new set back requirements and lagoon liner standards. Please remember, whether your farm is active or inactive, at no time may you allow animal waste to be discharged to waters of the State. You should maintain an appropriate freeboard level in your lagoon at all times. If our records are in error and your farm is currently stocked with animals please let me know. Box 87 Tyner, NC 27980 SUBJECT: Animal Feedlot Operation Site Inspection Lonesome Pine Pork Facility No. 21-18 Chowan County Dear Mr. Copeland: On May 15, 1997, I conducted an Animal Feedlot Operation Site Inspection at the Lonesome Pine Pork Farm in Chowan County. Overall, the operation was found to be in satisfactory condition. A copy of the inspection report is attached for your review. In general, this inspection includes verifying that: (1) the farm has a Certified Animal Waste Management Plan (CAWMP); (2) the farm is complying with requirements of the State Rules 15 NCAC 2H.0217, Senate Bill 1217, and the Certified Animal Waste Management Plan; (3) the farm. operation's waste management system is being operated properly under the direction of a Certified Operator; (4) the required records are being kept; (5) there are no signs of seepage, erosion, and/or runoff. The following were noted during the inspection 1. The referenced farm is currently registered and you are currently working with the Chowan County Soil & Water Conservation District Office on getting the farm certified. 2. Irrigation records are not currently maintained for the farm. Once your farm has a certified plan, please maintain all components of the Certified Animal Waste Management Plan (CAWMP) on site. A CAWMP component list is attached to this letter for reference. 3. Both of the lagoons had adequate storage capacity at the time of the inspection. Maximum and minimum pump markers will be installed as a requirement of certification. Pumping should be managed to maintain the liquid level between the markers. As a reminder, a minimum of nineteen inches of freeboard must be maintained in the lagoon and it is required to maintain a buffer of twenty-five feet while spray irrigating from any drainage system (ditch, swale, canal, stream, etc.). Please be aware that it is a violation of North Carolina General Statutes to discharge wastewater to the surface waters (farm ditches, creeks, streams, etc) of the State without a permit. The Division of Water Quality has the authority to levy a fine of not more than $10,000 per day for the unpermitted discharge of wastewater into the surface waters of the State. Howes, Secretary November 13, 1996 Jeff Copeland Lonesome Pine Pork Rt 1 Box 70 Belvidere NC 27919 SUBJECT: Operator In Charge Designation Facility: Lonesome Pine Pork Facility ID#: 21-18 Chowan County Dear Mr. Copeland: RECEIVED WASHINGTON OFFICE NOV 19 1996 Senate Bill 1217, An Act to Implement Recommendations of the Blue Ribbon Study Commission on Agricultural Waste, enacted by the 1996 North Carolina General Assembly, requires a certified operator for each animal waste management system that serves 250 or more swine by January 1, 1997. The owner of each animal waste management system -must submit a designation form to the Technical Assistance and Certification Group which designates an Operator in Charge and is countersigned by the certified operator. The enclosed form must be submitted by January 1, 1997 for all facilities in operation as of that date. Failure to designate a certified operator for your animal waste management system is a violation of 15A NCAC 2H .0224 and may result in the assessment of a civil penalty. If you have questions concerning operator training or examinations for certification, please contact your local North Carolina Cooperative Extension Service agent or our office. Examinations have been offered on an on -going basis in many counties throughout the state for the past several months and will continue to be offered through December 31, 1996.
