The referenced facility, Claxton Stallings and Son Farm, is located on State Road 1002, County Line Road, in Chowan County, North Carolina. On October 19, 2007, Marlene Salyer of North Carolina Division of Water Quality (DWQ) conducted a routine compliance inspection. The following specific violations are as follows: 1. Irrigation events occurred from April through August on Fescue Pasture; however the acceptable crop window for Fescue is September through March. In accordance with the Animal Waste Operation Permit Condition II, No. 1 and 2; The collection, treatment, and storage facilities, and the land application equipment and fields shall be properly operated and maintained at all tirrmes. (2) A vegetative cover shall be maintained as specified in the facility's CAWMP on all land application fields and buffers in accordance with the CAWMP. No waste shall be applied upon areas not included in the CAWMP. 2. There were eight irrigation events between May 1, 2007 and July 20, 2007 that were not covered by a current waste analysis. In accordance with the Animal Waste Operation Permit Condition III, No. 5; An analysis of the animal waste shall be conducted in accordance with recommended laboratory sampling procedures as close to the time of application as practical and at least within sixty (60) days (before or after) of the date of application. Every reasonable effort shall be made to have the waste analyzed prior to the date of application as close to the time of waste application as possible. Belvidere, NC 27919 SUBJECT: NOTICE OF VIOLATION Animal Feedlot Operation: Compliance Inspection Claxton Stallings.&.Son Farm Facility No. 21-4. Chowan County Dear Mr. Stallings: This letter is to notify you that the subject facility is in violation of its Certified Animal Waste Management Plan, General Permit, Title 15A North Carolina Administrative Code, Subchapter 2H, Section .0217(d) and N.C.G.S. 143-215.1. On August 8, 2002, Daphne Cullom from the Washington Regional Office of the Division of Water Quality conducted an Animal Feedlot Operation Compliance Inspection at the Claxton Stallings & Son Farm in Chowan County. A copy of the inspection report is attached for your review. In general, this inspection was to determine that: (1) the farm has a Certified Animal Waste Management Plan (CAWMP);-(2) the farm is complying with requirements of the State Rules 15 NCAC 2H.0217, Senate Bill 1217, and the Certified Animal Waste Management Plan; (3) the farm operation's waste management system is being operated properly under the direction of a Certified Operator; (4) the required records are being kept; and that (5) there are no signs of seepage, erosion, and/or runoff. The following violations were observed during the inspection: ➢ Over application of animal waste in excess of the Plant Available Nitrogen Rate & Hydraulic Loading as set out in your CAWMP for the receiving crop(s) was noted in the irrigation records (IRR-1 & IRR-2) for the 2001-2002 receiving crop of small grain and/or Coastal Bermuda. You are advised to review your current WUP for the PAN rate of each receiving crop as well as the application windows. ➢ The current WUP should be revised to include the correct receiving crops in the fields and to correspond with the irrigation design. You are advised to contact your Technical Specialist for assistance. The WUP should reflect the actual cropping scheme of the farm. ➢ Your Certified Animal Waste Management Plan and irrigation records did not include a current waste analyses for irrigation events in 2002. In Section III. Monitoring and Reporting Requirements, item number 4 of the General Permit, it is a requirement that a waste analysis be conducted as close to the time of application as practical and at least within 60 days (before or after) of the date of application. Further, this waste analysis is necessary to complete your irrigation records and to ensure that over application does not occur. This was previously noted in a Notice of Deficiency dated June 3, 1999 and February 22, 2001. ➢ The irrigation records of your Certified Animal Waste Management Plan are incomplete and have not been correctly --maintained- at this facility . In Section III. Monitoring and Reporting Requirements, item number 5 of the General Permit it is a requirement that land application records be maintained by the PermMee in chronological and legible form for a period of three years. This has been previously noted in Inspection Reports and Notice of Deficiencies dated July 14, 1997, November 20, 1998, and June 3, 1999. Please review the attached inspection report for further comments. It is very important as the owner and/or the Operator in Charge that these aforementioned violations and any other problems that may arise be resolved, as soon as possible. For additional assistance, please contact your Technical Specialist. You are requested to respond in writing to this notice within 15 days of receipt, outlining the corrective actions that have been undertaken and/or have been planned to address these violations and any further actions taken to prevent future violations of this nature from occurring. The effectiveness of your response will be a factor in the consideration of future enforcement. Please be advised that this letter does not prevent the Division of Water Quality from taking enforcement actions for past or future violations. It is suggested to resample the lagoon that sample 1 came from due o the high level of the sample. The irrigation records submitted were for Coastal Bermuda. No irrigation records were submitted for Fescue or Small Grain, however waste applications were noted during the winter months on Coastal Bermuda, which should have been an overseed. Your Waste Utilization Plan does not have Small Grain Overseed listed as a receiving crop. Therefore, you had small grain overseed as a receiving crop and need to add it to our Waste Utilization Plan or irrigation occurred on Coastal Bermuda when it was dormant. Both of these situations is a violation of your Waste Utilization Plan and General Permit. Your current Waste Utilization Plan allows you to irrigate on Coastal Bermuda from April - August and all receiving crops must be a part of your Waste Utilization Ian. e review of the irrigation records showed that the waste applications for Small Grain & Coastal Bermuda are calculated on the same sheet. It is suggested to keep IRR-1 and IRR-2 forms for each recieving crop with the appropriate PAN rate listed in the WUP. This was been suggested in previous DWQ inspections to prevent overapplication from occurring for each recieving crop. It was also noted that the same waste analysis was used for all application events. As advised in previous inspections, a waste sample must be collected within 60 days of waste application. was also noted that when calculating your irrigation records you divide the total flow rate of 16.3 gal/min/sprinkler y 7 to equal 2.32 gal/min/sprinkler and you do the same when you use 9 sprinklers to get 1.81 gal/min/sprinkler. r This is incorrect; when calculating your irrigation records you should use the total number of gal/min. for each sprinkler to complete the irrigation records. According to your irrigation design' each sprinkler applies 16.3 gal/min. erefore, this is the correct number to enter into column 6 on the IRR-2 forms. According to the review of your irrigation records, they have been incorrectly calculated, therefore significant overapplication and hydraulic overload as occurred. You are advised to recalculate your irrigation records as noted above. You are further advised to use the correct acreage/field, crop irrigation window, current waste analysis, number of sprinklers, and total gallons/minute in the completion of your irrigation records. As a result of these violations and review, your Waste Utilization Plan, Lagoon Design, and Irrigation Design are being forwarded to Carl Dunn, P.E., with the NC Division of Soil & Water for further review.This facility will reciev a Notice of Violation for the aforementioned violations of the General Permit and CAWMP. Please read this inspection and keep it with all other documents pertaining to your animal operation for future inspections. In general, this inspection included verifying that: (1) the farm is complying with requirements of the State Rules 15 NCAC 21-1.0217, Senate Bill 1217, the Certified Animal Waste Management Plan and/or General Permit; (2) determine whether the waste utilization plan is based on total or actual wetted acres; (3) the farm operation's waste management system is being operated properly under the direction of a Certified Operator; (4) the required records are being kept; (5) there arc no signs of seepage, erosion, and/or runoff. The following deficiencies were noted during the inspection. (p In accordance with condition III, item 4 of your General Permit, an analysis of animal waste shall be conducted as close to the time of application as practical and at least within 60 days (before or after) of date of application. The analysis shall include the following parameters: Nitrogen, Phosphorus, Zinc and Copper. As a reminder, please note the following which are conditions of the Certified Animal Waste Management Plan and the general permit therefore these items must be implemented: cp The nttaximum waste level in lagoons/storage ponds sluall not exceed that specified in the CAWMP. At a minimum, maximum waste level for waste for lagoons/storage ponds must not exceed the level that provides adequate storage to contain 25 year, 24 hours stonn event plus an additional foot of structural freeboard (p Soil analysis is required annually c) The following records are required: rainfall and lagoon level data, off -site solids removal, maintenance, repair, waste/soil analysis and land irrigation records. These records should be maintained by the facility owner/manager in chronological and legible form for a minimum of three years. (p Land application rates shall be in accordance with the CAWMP. In no case shall land apRl cation rates exceed the Plant Available Nitrogen AN) rate for the receiving_crop or result in runoff during any_ Wye amlication. cp Keep lagoons/storage ponds free of foreign debris including, but not limited to tires, bottles, plastic products, light bulbs, gloves, syringes or any other solids waste. T The lagoon areas should be kept mowed or otherwise controlled and accessible. High grass does not allow you to conduct a thorough inspection of the lagoon area for seepage, rodent damage, etc. cp It is suggested not required to keep crop yield information for future use to update your waste management plan. Your farm records were found to be deficient during this inspection. Specifically, you must start keeping your irrigation records on Form IRR-2 as instructed in your certified waste operators training manual. Also, you must take a waste analysis within sixty days before or after a waste application event. In addition to the above deficiencies, the rye grass in your bermuda grass field should be cut as soon' as possible to prevent damage to the bermuda grass. Also, you need to address the problems, on your lagoon bank caused by rodent tunneling. During the inspection of your farm, your waste application system was inspected_.for, compliance with proper application of waste at agronomic rates. However, this inspection was not completed due to a lack of irrigation parameters that should be contained in your irrigation design. Please contact your irrigation designer and provide to this office a map of the fields being irrigated including the actual acreage contained within the irrigation design. Overall, the operation was found to be in satisfactory condition. A copy of the inspection report is attached for your review. In general, this inspection included verifying that: (1) the farm has a Certified Animal Waste Management Plan (CAWMP); (2) the farm is complying with requirements of the State Rules 15 NCAC 2H.0217, Senate Bill 1217, and the Certified Animal Waste Management Plan; (3) the farm operation's waste management system is being operated properly under the direction of a Certified Operator; (4) the required records are being kept; (5) there are no signs of seepage, erosion, and/or runoff. The following deficiencies were observed during the inspection 1. The Certified Animal Waste Management Plan (CAWMP) did not contain all of the required components. Please find attached a list of the required components. The only components of the plan that were available for review were the waste utilization plan and waste analysis (11/7/96). Please compile the remaining components of the plan. You are required to maintain a copy of this plan on site. 2. Maximum and minimum pump markers need to be installed in the lagoon. These markers are to be installed to show the top and bottom elevations of the temporary Storage (pumping volume) of the lagoon.
