The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program (NC EEP) is willing to
accept payment for impacts associated with the above referenced project. Please note that this decision does not assure that
the payment will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the
applicant to contact these agencies to determine if payment to the NC EEP will be approved.

This acceptance is valid for six months from the date of this letter. If we have not received a copy of the issued 404
PermitJ401 Certification within this time frame, this acceptance will expire. It is the applicant's responsibility to send
copies of the 404/40I/CAMA permits to NC EEP. Once NC EEP receives a copy of the 404 Permit and/or the 401
Certification an invoice will be issued and payment must be made.
Based on the information supplied by you the impacts that may require compensatory mitigation are summarized in the

Upon receipt of payment, EEP will take responsibility for providing the compensatory mitigation for the permitted impacts
up to a 2:1 ratio, (buffers, Zone 1 at a 3:1 ratio and Zone 2 at a 1.5:1 ratio). The type and amount of the compensatory
mitigation will be as specified in the Section 404 Permit and/or 401 Water Quality Certification, and/or CAMA Permit. The
mitigation will be performed in accordance with the Memorandum of Understanding between the N. C. Department of
Environment and Natural Resources and the U. S. Army Corps of Engineers dated November 4, 1998.

8. PROJECT SUMMARY: The applicant proposes to fill a 1,803-square foot wetland area and
construct a single-family dwelling located within the Estuarine Shoreline Area of
Environmental Concern (AEC).
PROJECT SETTING
The site of the proposed development activity is a 31 ,806-square foot lot located off NC 345 (Mill
!-anding ~oa~),Wanchese,_DareCounty and adjacent to a man-made canal off Broad Creek-and
Roanoke Sound. The property is accessed by a dirt driveway adjacent to the north side of 3209
Mill Landing Road. The property is mostly flat with an elevation range of 0-5 feet above normal
water level (N\VL) and vegetated with pine and indigenous grasses. The property has
approximately 9,627 square feet of 404 wetlands located on the east side and vegetated with gum,
cedar, red bay, marsh elder, wax myrtle and sea myrtle. The wetland area is adjacent to the
existing canal, which has a water depth of approximately -2 feet below NWL. Navigation in the
canal is hindered by debris from Hurricane Isabel.
Man-made features on the property include a skateboard facility and a dirt parking area. Adjacent
riparian properties consist of a lot with a single-family dwelling and an undeveloped tract of
wetlands .
The waters of Broad Creek in this area are classified as SA and are open to shellfish taking.
. DEVELOPMENT-PROPOSAL _n ._-~-
In order to construct a single-family dwelling, the applicant proposes to fill 1,803 square feet of
404 wetlands located within 75 feet ofNWL. The applicant proposes to construct a 1,064-square
foot home elevated on pilings with a 280-square foot covered deck or porch and a 224-square foot
uncovered wooden deck in this area. Approximately 5.15 square feet of the proposed uncovered
deck will be located within 30 feet of NWL. The applicant proposes to install a conventional septic
drain field system for the dwelling.
ANTICIPATED IMPACTS
The proposed wetland fill will result in 1,803 square feet of 404 wetlands located within the
Esmarine Shoreline AEC being filled. Fill material will be placed within 12 feet of NWL. It is

-- -- - - -area to -an elevation comparable to the adjacent uplands. This proposal does not involve any
bottom dismrbance within the adjacent canal; however, surface runoff could cause an increase of
turbidity until the fill area is stabilized with ground cover and the project is completed.

(MP-l & MP-2), incl. attached workplan drawings (5), 1 dated 5/16/05, 2 dated "rev" 6120/05, 1 dated 10/10/05, & 1 dated 10/19/05.
This permit, issued on November 7,2005 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Upland Development
1) Unless specifically altered herein, this permit authorizes only the grading and other land disturbing
activities associated with the development of the property owned by the applicant located of NC Hwy
345 in Wanchese, including the construction of the conventional septic system, all as expressly and
specifically set forth in the attached permit application forms and drawings. Any additional land
disturbing activities and/or construction may require a modification of this permit. Contact a
Division of Coastal Management representative at (252) 264-3901 for this determination. The
permittee is further advised that many non-water dependent activities are not authorized within 30
feet of the normal water level.

Signed by the authority of the Secretary of DENR and the
Chairman of the Coastal Resources Commission.
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit shall be accessible on-site to Department
personnel when the project is inspected for compliance.

A.DDITIONAL CONDITIONS
Hctaining Wall
The retaining ">','ali shall be staked by the permittee or the permitec's authorized agent according to the
;::ignment on the attached workplan drawings and a representative of the Division of Coastal
\ IanZigemcnt shall approve of the alignment within a maximum of 30 days prior to the start of any
conSllUCllon.
The retaining wall shall be constructed prior to any backfilling activities.
The retaining wall shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
The retaining '\vall shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or
other suitable materials approved by department personnel.
TIle fill material shall be clean and free of any pollutants except in trace quantities.
All fill material shall be obtained from a high ground source.
No fill material is to be placed within 30 feet of the normal water line, except that which shall be used to
fIll the area behind the permitted retaining walL
Sedimentation and Erosion Control
Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.). At a minimum, a silt fence shall be properly installed immediately
landward of the retaining wall cap and at the base of all filled areas not contained behind the retaining
\vall immediately following completion of filling activities.

All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion
within thirty days of project completion. .- ..
Development within \VetIands
This permit hereby authorizes the construction of the single family home and wooden deck, all as
expressly and specifically set forth ill the attached permit application and workplan drawings. No
portion of the home or wooden deck shall be constructed within the 30 ft. buffer other than the 5.15 sq.
ft. section of the wooden deck depicted in the attached workplan drawings.
The portion of the wooden deck that is to be located within 30 f1. of the normal water level shall be
uncovered, slatted, and elevated.

ADDITIONAL CONDITIONS
General

The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required,
upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or

; obstructions caused thereby, without expense to the United States or the state of North Carolina. No
claim shall be made against the United States or the state of North Carolina on account of any such
removal or alteration.
14) All construction shall conform to the N.C. Building Code requirements and all other local, State and
Federal regulations, applicable local ordinances and FEMA Flood Regulations.
15) In accordance with the conditions of the US Army Corps of Engineers and in order to compensate for
I impacts to O.04-acres of wetlands, the permittee shall make payment to the North Carolina Ecosystem
! Enhancement Program (NC EEP) in the amount determined by the NC EEP, sufficient to perform the
restoration of O.08-acres of non-riparian estuarine salt shrub wetlands in the Pasquotank River Basin,
(Cataloging Unit 03010205). Construction within jurisdictional areas on the property shall begin only
after the permittee has made full payment to the NC EEP and provided a copy of the payment
documentation to the Corps of Engineers and the Division of Coastal Management, and the NC EEP has
provided written confirmation to the Corps that it agrees to accept responsibility for the mitigation work
required, in compliance with the MOU between the North Carolina Department of the Environment and
Natural Resources and the United States Army Corps of Engineers, Wilmington District, dated
November 4,1998.
NOTE:
This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE:
The N.C. Division of Water Quality has authorized the proposed project under General Water
Quality Certification No. 3490 (DWQ Project No. 05-1578), which was issued on 10/4/05.
NOTE:
The U.S. Army Corps of Engineers has assigned the proposed project COE Action Id. No.
200511905.
