This permit, issued on Odolwr 26, 2005 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below, Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility
1) No portion of the permitted docking facility shall extcnd more than 14 width of Queen Anne's Creek.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considcred a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.
3) The permittee shall maintain the authorized work in good condition and in conformancc with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be,

Any maintenance work or project modification not covered
hereunder requires further Division approval.

7) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S,
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors should be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
8) This permit authorizes a maximum of 10 boat slips.
NOTE:
Any proposal to add one or more additional boat slips to the authorized 10-slip facility will
require that the docking facility be classified as a marina, and will therefore require a review
under the N,C. Environmental Policy Act (NCEPA).
General
9) No vegetated wetlands or open water areas shall be excavated or filled, even temporarily.
10) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary o( the Army or his authorized representative, said structure or work shall cause
umeasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon
due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions
caused thereby, without expense to the United States or the state of North Carolina. No claim shall be
made against the United States or the state of North Carolina on account of any such removal or
alteration.
11) The project site is located in an area having a high probability of containing cultural resources, such as
shipwreck remains, If such materials are encountered, the permittee must immediately stop work and
notify the District Engineer, Washington Branch, U.S. Army Corps of Engineers at (252) 975-1616, and
the N.C, Division of Coastal Management at (252) 264-3901.
NOTE:
In coordination with the authorized agent, the permitted kayak launching platforms shall be built
as depicted on the attached workplan drawing labeled 1 of 2 and dated 6/9/05.
NOTE:
This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.

Approval of 401 Water Quality Certification (GC3400) with Additional Conditions
Ladies and Gentlemen:
You have our approval, in accordance with the attached conditions, to shade: 0.039 acres of 404
Wetlands, Public Trust Shoreline AEC; 0.029 acres of 404 Wetlands, outside Public Trust AEC; and
0,053 acres of Public Trust Area to construct a pier/walkway as described in your application received by
the Division of Water Quality (DWQ) 401 OversightlExpress Review Permitting Unit on August 15,
2005. After reviewing your application, we have determined that the Division of Water Quality (DWQ)
General Water Quality Certification Number 3400 covers these water impacts. This Certification allows
you to General Permit No. 198000291 when issued by the US Army Corps of Engineers (USACE). In
addition, you should get or otherwise comply with any other federal, state and local requirements before
you go ahead with your project including (but not limited to) erosion and sediment control regulations
and CAMA, Also, this approval to proceed with your proposed impacts or to conduct impacts to
waters as depicted in your application shall expire upon expiration of the 404 or CAMA Permit.
This approval is for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application, If the property is sold,
the new owner must be given a copy of this Certification and approval letter and is thereby responsible for
complying with all conditions. If total fills for this project (now or in the future) exceed one acre of
wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A
NCAC 2H .0506 (h). This approval requires you to follow the conditions listed in the attached
certification and any additional conditions listed below.
The Additional Conditions of the Certification are:

2. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable
Buffer Rules, and any subsequent modifications, the applicant is required to return the attached
certificate of completion to the 401 OversightJExpress Review Permitting Unit, North Carolina
Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650.
3. Water Quality Certification
The proposed project must comply with all of the conditions of General Water Quality
Certification (GC) 3400.
Violations of any condition herein set forth may result in revocation of this Certification and may result in
criminal and/or civil penalties, The authorization to proceed with your proposed impacts or to conduct
impacts to waters as depicted in your application and as authorized by this Certification, shall expire upon
expiration of the 404 or CAMA Permit.
If you do not accept any of the conditions of this Certification (associated with the approved water
impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that you
receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the
North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, N.C. 27699-6714, This certification and its conditions are final and binding unless you ask for a
hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

8. PROJECT SUMMARY:
The applicant proposes to construct an approximate 50S-feet elevated walkway over 404 wetlands to
an "L" shape 205-feet pier extending 80 feet into Queen AlU1e Creek,S fmger piers with 17 mooring
pilings for 10 slips, and two 20-feet long by 20-feet wide canoe/kayak platforms with 5-feet long by
6-feet wide access platforms for each canoe platform on his property. The current development on
the property is the renovated Edenton Cotton Mill, which is to be converted to a 50-52 unit
condominium with storage buildings, riprap-lined stormwater retention pond, and 2 finger piers
adjacent to a boat ramp on the ulU1amed tributary off Queen AlU1e Creek
PROJECT SETTING
The location of the proposed development site is within a 14,36-acre tract of developed land with a cotton
mill that is being converted to a 50-52 unit condominium, located at the end of McMullan Ave. (off SR
17 Business) in the Town of Edenton of Chowan County. The development site is located on the western
shoreline of an ulU1amed tributary off Queen AlU1e Creek and the northern shoreline of Queen AlU1e
Creek near to it's mouth at Edenton Bay, The width of Queen AlU1e Creek at this point is approximately
0,07 mile (360 feet).
The property is mostly flat and vegetated with indigenous weeds, lawn grasses, and landscaping plants.
An extensive cypress fringe shoreline of 404 wetlands lies on both sides of the ulU1amed tributary and
Queen AlU1e Creek. The property has an irregular shoreline that is approximately 1,000 linear feet.
The adjacent property to the north and west is developed with a cypress swamp fringe along the
shoreline, and the adjacent property to the east and across the ulU1amed tributary is farmland southward
near Queen AlU1e Creek and residential northward. There was no observed presence of submerged
aquatic vegetation or shellfish in the vicinity of the pier site on June 27, 2005. Reviews of available
information suggest that there are no known archeological sites or geologic formations associated with the
applicant's property. However, the property is located in a National Registered Historic District.
The waters of Queen AlU1e Creek and the cOlU1ecting ulU1amed tributary in this area are classified as C
NSW by the Division of Environmental Management and are closed to shellfish harvesting.
The water depths at the site range from 2 feet near shore, 3 feet along the pier portion parallel to
shoreline, and 4 feet at the waterward end of pier slips, The bottom is fine sand and organic silt.
PROJECT DESCRIPTION
In order to provide water access for the residents of the Cotton Mill condominium, the applicant proposes
to construct a private community boating access area that consists of a 6-feet wide by 50S-feet long
elevated walkway over 404 wetlands, 6-feet wide by 205-feet long "L" shape pier, five 3-feet wide by
IS-feet long finger piers and 17 mooring pilings, two 20-feet wide by 20-feet long floating canoe
platforms, and two 6-feet wide by 5-feet long canoe platform access ramps. There is no request for
restrooms, gasoline, sewage pumpout, or dredging with this development proposal.
The pier structure will have 10 designated mooring slips and is setback 250 feet from the nearest property
line to the west. The pier structure will extend a maximum distance of 80 feet into Queen AlU1e Creek,
which is 1/4,5 of the width of this water body.

ANTICIPATED IMPACTS
The proposed elevated walkway to the pier will project approximately 80 feet out into Queen Anne
Creek, and will shade approximately 2,315 square feet of Public Trust Area (PTA), 1,740 square feet of
404 Wetlands in the Public Trust Shoreline, Area of Environmental Concern (AEC), and 1,290 square
feet of 404 Wetlands outside the Public Trust Shoreline AEC,
Each boat slip will be approximately 15 feet wide by 30 feet long, and the entire mooring area will
occupy 4,500 square feet. Boating activity will increase in this area resulting in a possible increase in
water turbidity, and may result in toxics from hull paint and maintenance products to accumulate in the
sediment near the boat slips, This will be the second pier along this shoreline, There are no expected
navigational impacts due to the pier structure.
Temporary water turbidity will occur during construction.

Environmental Concern (ABC) at the 14.36 acre Edenton Cotton Mill Development, Inc. site, The
property is approximately centered around Latitude 360 03' 22.60" N and Longitude 760 36' 1.68" Wand
located at 723 McMullan Street in Edenton, Chowan County, North Carolina along The Queen Anne
Creek (Attachment 2).

PROJECT NARRATIVE
Site ConditionslPronosed Develonment Overview:
The subject property (site) is a 14.36 acre parcel formerly operated as The Edenton Cotton Mill. The
Edenton Cotton Mill Development, Inc. have been restoring/ remodeling the old mill for several years.
Development activities at the site include the creation of 50-52 townhouse style homes and single family
residential units. As part of the development, a pier. dock, ten slips and canoe/kayak staging areas are
proposed (Attachment 4). The elevated walkway will extend through the Section 404 Wetlands on site
from the existing boat ramp out to Queen Anne Creek.
Water depths at the end of the proposed pier (4') are sufficient to support boat slips. In addition. a canoe
and kayak staging area is proposed on the landward side of the pier/dock. The walkway over wetlands
will be approximately 505 feet in length (measured from ramp to normal water) and six feet wide and
will be constructed to avoid the destruction of any existing mature trees. The proposed 205 feet of
pier/dock will also be six feet in width. The dock will extend a total of eighty feet off the shore (NWL)
and will generally run parallel to the shore. Queen Anne Creek is 361 feet wide at the location of the
proposed slips.

The floating docks for the canoes and kayaks are proposed to be 20' by 20' with approximately ten feet
long by five feet wide access ramps that raise and lower with fluctuating water levels in the creek
(fluctuating water levels in the creek expected and reported to be low). The pier, dock and slips will be
for the private use of residents of the Edenton Cotton Mill Development. Aerial infra-red photography of
the site showing the walkway, pier, slips, docks/platforms is presented as Attachment 3. The proposed
layout of the water dependent structures and details are presented on two sheets as Attachment 4,
Please note, there is a railroad trestle which restricts the size of boats that can enter Queen Anne Creek
from Edenton Bay, However, in an e-mail correspondence from Anne-Marie Knighton, Edenton Town
Manager, representatives from Norfolk Southern Railroad have indicated they have plans to discontinue
the rail and trestle crossing Queen Anne Creek, The railroad has also indicated that the funds for the
dismantling and removal of the trestle have already been included in their budget. A copy of an e-mail
correspondence from Anne-Marie Knighton to Ann Perry and Company has been included as
Attachment 8.
There is no proposed development within the AEC with the exception of the water dependent structures.
In addition, there is no proposed shoreline stabilization, and there will be no discharges to waters of the
state as a result of the proposed water dependent structures,
Ten slips are proposed. As proposed, the slips will be 30 feet in length and 15 feet in width. Overnight
docking will be allowed, however, no live aboard docking will be allowed. In addition, there will be no
sewage disposal/pumpout or water services offered at the slips.
Construction Details:
The proposed 505 feet of wooden walkway will be constructed through cypress swamp (freshwater; 404)
wetlands. The developers have indicated they do not want to eliminate any mature trees during the
construction of the walkway. Pilings for the walkway will be washed or driven into the substrate using
standard techniques. The construction of the walkway will start at the existing boat ramp and progress
toward Queen Anne Creek, The builders will finish the walkway in sections and move out toward the
Creek. In this manner, there will be no need to transport materials through wetlands. Materials can be
brought down to the boat ramp area and transported as needed across the wetlands using the walkway.
There will be no vehicles in the wetlands and no mats are proposed to be used to access areas for
construction at this time. Construction of the pier and slips will be achieved using conventional methods.
Grading, Excavation and FilV Stormwater:
There is no grading, excavation or fill associated with this project.
Sedimentation and Erosion Control Plan
A sedimentation and erosion control plan will not be necessary for the construction of the water
dependent structures.

Potable Water and Wastewater:
Potable water is available on site via the Town of Edenton. Water will not be extended out to the boat
slips.

Tom, I mat with a representative today from Norfolk Southern about the treslle. Shl;l told me that the Railroad now bel/eves thsy
nave satisfied all of the NC StatlJ Historic PreservatIon Office's concerns regarding the trestle. The Railroad has asked me to writa
a letter to SHPO roquesting tnem to write a needed latter to the Federal Government's SUI'Tace Transporation Board, Once the
STB receives SHPO's letter. It is expectecJ mat STB Will approve the Railroad's request [0 (]Jscontlnue the line that crosses Quocn
Ann Creek. It is expected that the discontinuation will become ewec'dve early i1, July. The RQilro<1id hell' funds budgeted to
dismantle end remove the tresUQ, and thoy er.peGt. that warlt to be done in late summor or early rail. I gave them Waft Comractlng
