This permit, issued on June 12, 2006 , is subject to compliance With the application (where consistent.
with the permit), all applicable regulations, special conditions andnotcs set forth bClow. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. .
.1) This pe"rmit does not authorize any upland development or the alteratiollladdition to any structures
located. over land. Any reference to any upland development in the attached permit application and
workpl~n drawings, is hereby null and void. .
Excavation
2) Excavation shall not exceed -8 feet below the normal low water level. In no case shall the depth of
excavation exceed the depth of connecting waters.
3) No wetlands shall be excavated or filled, even temporarily.

This permit action may be appealed by thc permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit shall be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work shall cease when the pennit expires on
December 31, 2009
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

The permittee is hereby cautioned that the kicking of marsh with boat props is also strictly
prohibited.
5) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not
authorized.

Ail excavated materials ,'shall be confined above the normal high water level and landward of regularly
o~ irregularly flooded marsh behind adequate dikes or other ,retaining structures to prevent spillover of
solids into any marsh or surrounding waters.

Nq spoil material is to be placed within 30 feet of the normal high water line; except that which shall be
used to backfill the area behind the bulkhead.
Shoreline Stabilization
8) The alignment, of the permitted bul~ead shall follow the existing alignment as much as practicable, and
shall at no point e~tend more than 2 ft. watenyard of the existing bulkhead.
9) The bulkhead shall be constructed prior ~o any backfilling activities.
10) The bulkhead shall be, structurally tight so as to prevent seepage of backfill materials through the
structure.
11) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other
suitable materials approved by department personnel.
12) All backfill material shall be obtained from a high ground source and confined'behind the permitted
bulkhead.
Sedimentation and Erosion Control
13) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.). At a minimum, a silt fence shall be properly installed immediately
landward of the bulkhead cap immediately following completion of backfilling activities.
14) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion
within thirty days of project completion.

Prior to the start of construction 011 the authorized docking facility, the existing docking facilities labeled
"old dock" and "dock" 011 the attached workplan drawing 1 of 5 dated 1/13/95, shall be removed from
the site and all resulting debris shall be properly disposed of ilt upland disposal site. No debris shall be

disposed of in the surrounding water body. i
16) Unless specifically altered hereIn, this permit authorizes the 6. ft. x 10 ft. pier terminating in a 11 ft. x 36
ft., the seven 2 ft. x 14 ft. fing~r piers, the 10 associated mooring p'ilings,' and the repairli:eplacerl}ent of
the existing 14 ft. x 40 ft. and the 8 ft. x 30 ft. boardwalks adjacent. to the bulkhead; all as expressly and
specifically set forth in the attached workplan drawing' dated 3I2i06.... No other structure, whether
floating or stationary, shall become a permanent part of this docking facility without permit
modification. No nOll-water dependent uses of structure~ shall be conducted on, in or over public trust

17) No sewage, whether treated or untreated, shall be discharged at any time' from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.
18) The authorized covered platform shall not be enclosed. Any material nsed.onthe sides shall not obstruct
view and shall be permeable to air and water. Screen or wire on the s.ides along with benches and knee
walls are permitted. Lattice is specifically excluded from being used under' this authorization.
19) The roof of the covered platform shall not be designed for second story use.
20) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
21) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
22) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
that may be caused from existing or future operations undertaken by the United States in the public
interest.
23) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
. 24) This permit authorizes a maximum of ten boat slips.

in accordance with the rules of the Environmental Management Commission, many non-water
dependent activities are not authorized within 50 feet of the normal water level or landward edge'

specific clarification.
The N.C. Division of Water Quality has authorized the proposed project under General Water

Approval of 401 Water Quality Certification (GC3400) with Additional Conditions
Dear Mr. Gaskill:
You have our approval, in accordance with the attached conditions, to shade 0.046 acres of waters to
replace existing piers with a single 8' wide x approximately 114' long pier with a 11' wide x 36' long T-
head platform and 7-2' wide x 14' long finger piers servicing 10 slips as described in your application
received by the Division of Water Quality (DWQ) 401 OversightlExpress Review Permitting Unit on
August 12,2005. After reviewing your application, we have determined that the Division of Water
Quality (DWQ) General Water Quality Certification Number 3400 covers these water impacts. This
Certification allows you to General Permit No. 198000291 when issued by the US Army Corps of
Engineers (USACE). In addition, you should get or otherwise comply with any other federal, state and
local requirements before you go ahead with your project including (but not limited to) erosion and
sediment control regulations and CAMA. Also, this approval to proceed with your proposed impacts
or to conduct impacts to waters as depicted in your application shall expire upon expiration of the
404 or CAMA Permit.
This approval is for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application. If the property is sold,
the new owner must be given a copy of this Certification and approval letter and is thereby responsible for
complying with all conditions. If total fills for this project (now or in the future) exceed one acre of
wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A
NCAC 2H .0506 (h). This approval requires you to follow the conditions listed in the attached
certification and any additional conditions listed below.

2. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable
Buffer Rules, and any subsequent modifications, the applicant is required to return the attached
certificate of completion to the 401 Oversight/Express Review Permitting Unit, North Carolina
Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650.
3. Water Quality Certification
The proposed project must comply with all of the conditions of General Water Quality
Certification (GC) 3400.
4. Approval for a Variance from the Riparian Buffer Protection Rules in the Tar-Pamlico River Basin
You have proposed permanent impacts within Zone 2 of the Tar-Pamlico River basin buffer. You
must receive approval for a variance from the Riparian Buffer Protection Rules in the Tar-
Pamlico (15A NCAC 2B .0259) River Basin before the impacts specified in this Certification
may occur per Condition No.6 in GC No. 3400. Please contact Mr. Kyle Barnes ofDWQ's
Washington Regional office to start this process.
Violations of any condition herein set forth may result in revocation of this Certification and may result in
criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct
impacts to waters as depicted in your application and as authorized by this Certification, shall expire upon
expiration of the 404 or CAMA Permit.
If you do not accept any of the conditions of this Certification (associated with the approved water
impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that you
receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the
North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a
hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

Environmental Setting
The project site is located off SR 1328, Silver Lake Road, on the west side of Silver Lake
Harbor off the Pamlico Sound on Ocracoke Island in Hyde County North Carolina. The 0.34-acre
project site currently operates as a wholesale fishhouse with 1\\'0 existing do.cks/piers providing
mooring for commercial fishing boats. A portion of the existing one story fishouse building, under
today's standards, is a nonc"onforming structure as it eh"tends watef\\'ard of the existing bulkhead over
Silver Lake. On the landward side of the fishouse there exist a grav~1..entrance and loading dock
associated with the loading lunloading oftrucks. The remaining, unocc~pied areas of the property'
are currently used as a stockpile area for topsoil, graveL oyster shell, etc. as the applicant owns and
operates a dump truck hauling service. The site has also served as a spoil area for previous hydraulic
dredging activities permitted offshore nearby properties. Portions of the diked disposal area remain.
On the landward/western end ofthe lot there is an existing one-story building that serves as a rental
unit. The neighboring property to the north is a natural shoreline \\ith a pier to a nonconforming two
story net shed in Silver Lake. This property is utilized by commercial fisherman for mooring of
commercial boats as well as storage for various commercial fishing gear. The property on the south
side has a natural shoreline with a marsh fringe. Although there is no formalized docking facility.
the southern adjacent riparian area is utilized for mooring of skiffs to attendant mooring piles.
Existing water depths range from <1' at the bulkhead to :t8' below the normal water le,"el (NWL)
50' offshore the bulkhead. Although shellfish, oysters and clams, inhabit this area, Silver Lake
remains closed to harvest. The Division of \Vater Quality cJassifies Silver Lake as SC waters.
Project Description
The applicant proposes replace the existing piers with a single 8' wide x =114' long pierv.-ith
all' wide x 36' long T-head platform and 7-2' wide x 14' long finger piers seT\icing ten slips. The
pier is to be constructed from the center ofthe property. An area adjacent to the existing bulkheacL
50' offshore x 100' wide is to be excavated to a final depth of 8' below the N\VL. The excavation
work is proposed to be accomplished using a long reach excavator. An 80' long dock is proposed
adjacent to and waterward of the bulkhead. The dock will be 14' wide in front of the fish house to
facilitate the loading and unloading of commercial fishing vessels. Once the dock eh"tends beyond
the fish house, the dock drops back to 8' wide and stops 15' short of the propeny line on the north
side.
A new two-story building is proposed and will provide space for three rental units. There
will also be retail space located in the new two-story building. A proposed gravel parking area will
provide parking for 14 vehicles.
Environmental Impacts
The project as proposed will result in the excavation of5,000 ft:: of Silver Lake bonom. The

proposed pier and platform will shade 2.034 ft2 of Silver Lake bottom. Localized short-term
turbidity will result from the excavation work and installation of the pier. Remo\"al of the 'Stockpiled
materials and construction of the new building will result in the excavation, filling, grading and
seeding of the adjacent uplands.

Project Description
Monroe Gaskill
The proposed project is located on the property of Benjamin Monroe Gaskill, reference made to Deed Book 136, Page 200,
Hyde County Registry, Ocracoke Township, Hyde County, North Carolina
This project consists ofrepairinglreplacing the existing Structures within the Public Trust Area; removing the section of the
existing clam/fishouse built over Silver Lake, in the Public Trust Area and Estuarine Water Area of Environmental Concern
(AEC); and improving the two existing buildings on said land plot as Upland Develop'ment in the Area of Environmental
Concern.
The Structures within the Public Trust Area phase of this project consists ofrepairinglreplacing the existing bulkhead with
a new wood/vinyl bulkhead. Also, improving the existing two piers by reconfiguring the layout to provide a covered
platform of 11 ft. x 36 ft. and ten boat slips. of which one is sized to allow commercial fishing vessels proper
maneuverability to load and off-load fish and supplies. This reconfiguration of pier/dock allows a total reduction of the
existing pier/dock size by 121 sq.ft. The new pier/dock is to be wooden construction, consisting of 10" diameter pilings, T
x 6" and 4" x 6" wood and appropriate fasteners. All wood to be treated A WP A standard C2 marine grade. AIl fasteners to
be galvanized and stainless steel.
The Upland Development phase of this project consists ofrepairinglreplacing the two existing structures. Structure One
(existing c1am/fishouse) is to be repaired/replaced by removing the section of the structure built over Silver Lake, in the
Public Trust Area and Estuarine Water Area of Environmental Concern (AEC) and reconfigure the building footprint to
eliminate the buildings existing encroachment into adjacent property and reduce the encroachment into setbacks by 4 ft.
This structure is to maintain the original occupancy ofa commercial fishhouse (A-2) with the new facilities added to enable
wholesale, retail, and primary "take-out" prepared seafood sales. The repaIr/replacement of the second structure is to
provide three smaIl apartments (occupancy R-3) with less than 400sq.ft. of mercantile space (occupancy M) below. The
location of both proposed structures are shown on scaled site plan.. also, the location of existing structures are shov.n on the
additional scaled site plan marked "existing". AIl construction for upland development to be wooden construction (Type
V) in accordance to all applicable codes and laws of whichever supersedes the established laws by the State of North
Carolina; the County of Hyde; and the Tov.nship ofOcracoke.
To address discharge of said project a licensed soil scientist, S & EC, was consulted for soil analysis of site and a Long
Term Acceptance Rate of soil. The waste water treatment system is currently being engineered in accordance to occupancy
load. A copy of the soil report is available for review. The waste water treatment system wiIl be provided by Bio-
Microbics Incorporated under rule .1957 c. "design criteria for design of alternative sewage systems -individual aerobic
sewage treatment units" of the North Carolina Department ofEnvrronment and Natural Resources, Division of
Environmental Health, On-Site Wastewater Section. Upon completion of engineering, a septic permit wiIl be applied for.
The square footage ofimperviouslbuilt-upon surface within 75 ft. of Normal High Water for Estuarine Shoreline EAC is
calculated to cover 21.5% of the area of said tract. All other surfaces in the Area of Environmental Concern are to be soil
with a grass groundcover. The parking area shown on site plan was calculated using occupancy loads and is in accordance
to the Ocracoke Development Ordinance. The shown parking area is to be granite gravel.
Adjacent property owners have been notified of project with a complete CAMA major application. A copy of their signed.
certified letter receipt is included in this application. The date of delivery for both adjacent property O\mers is March 21,
2005.

g. Existing ClamlFish House
Remove portion of existing Clam/Fish House that is over Silver Lake and replace with pervious
dock. Repair/replace existing ClamlFish House to upgrade facility to enable wholesale, retail,
and primary "take-out" prepared seafood sales. The Structure is to remain one story with access
to covered seating on roof (see cross section). Proposed repair/replacement of existing
Clam/Fish House will reduce encroachment of building over Silver Lake by 100%; will reduce
encroachment into neighboring property by 100%; and will reduce encroachment into setbacks
by four feet.
Platform
The proposed 11' x 36' platform shall be roofed intended for single story use. There shall be no
sidewalls and the deck shall be made of pervious material.

Approval of 401 Water Quality Certification (GC3400) with Additional Conditions
Dear Mr. Gaskill:
You have our approval, in accordance with the attached conditions, to shade 0.046 acres of waters to
replace existing piers with a single 8' wide x approximately 114' long pier with a 11' wide x 36' long T-
head platform and 7-2' wide x 14' long finger piers servicing 10 slips as described in your application
received by the Division of Water Quality (DWQ) 401 Oversight/Express Review Pennitting Unit on
August 12,2005. After reviewing your application, we have detennined that the Division of Water
Quality (DWQ) General Water Quality Certification Number 3400 covers these water impacts. This
Certification allows you to General Pennit No. 198000291 when issued by the US Army Corps of
Engineers (USACE). In addition, you should get or otherwise comply with any other federal, state and
local requirements before you go ahead with your project including (but not limited to) erosion and
sediment control regulations and CAMA. Also, this approval to proceed with your proposed impacts
or to conduct impacts to waters as depicted in your application shall expire upon expiration of the
404 or CAMA Permit.
This approval is for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application. If the property is sold,
the new owner must be given a copy of this Certification and approval letter and is thereby responsible for
complying with all conditions. If total fills for this project (now or in the future) exceed one acre of
wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A
NCAC 2H .0506 (h). This approval requires you to follow the conditions listed in the attached
certification and any additional conditions listed below.
The Additional Conditions of the Certification are:

2. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable
Buffer Rules, and any subsequent modifications, the applicant is required to return the attached
certificate of completion to the 401 Oversight/Express Review Permitting Unit, North Carolina
Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650.
3. Water Quality Certification
The proposed project must comply with all of the conditions of General Water Quality
Certification (GC) 3400.
4. Approval for a Variance from the Riparian Buffer Protection Rules in the Tar-Pamlico River Basin
You have proposed permanent impacts within Zone 2 of the Tar-Pamlico River basin buffer. You
must receive approval for a variance from the Riparian Buffer Protection Rules in the Tar-
Pamlico(15A NCAC 2B .0259) River Basin before the impacts specified in this Certification
may occur per Condition No.6 in GC No. 3400. Please contact Mr. Kyle Barnes ofDWQ's
Washington Regional office to start this process.
Violations of any condition herein set forth may result in revocation of this Certification and may result in
criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct
impacts to waters as depicted in your application and as authorized by this Certification, shall expire upon
expiration of the 404 or CAMA Permit.
If you do not accept any of the conditions of this Certification (associated with the approved water
impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that you
receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the
North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a
hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water
