Diffuse Flow All stormwater shall be directed as diffuse flow at non-erosive velocities through the protected stream buffers and will not re-concentrate before discharging into the stream as identified within 15A NCAC 2B .0233(5) In an effort to comply with the diffuse flow provision of the Buffer Rule (15A NCAC 02B .0233(5)), you have provided the DWQ with level spreader designs dated August 23, 2005. The DWQ believes that if implemented, as per these plans, diffuse flow will be achieved. However, if diffuse flow as per 15A NCAC 02B .0233(5) is not achieved, then the DWQ shall be notified and corrective actions to restore diffuse flow shall be taken if necessary to impede the formation of erosion gullies. At no time shall stormwater from the proposed development be piped directly through the buffer without prior DWQ written authorization. The structural stormwater practices as approved by this Office as well as drainage patterns must be maintained in perpetuity. No changes to the structural stormwater practices shall be made without written authorization from the Division of Water Quality. Stormwater easements shall be recorded for a distance of at least 10 feet on each side of all stormwater conveyances and on all lots containing these structures including future access for maintenance. The stormwater easements shall allow for the ability to maintain the structures, perform corrective actions as described above and shall provide protection of the structures from potential alternations by future property owners. 6 Culvert Installation The bottomless culverts, bottomless arches or other spanning structures used on this project shall span the entire bed and both banks of the stream and may only be used for a road, driveway or path crossing. Mitering of the bottomless culvert in order to follow the stream pattern is prohibited. The bottomless culverts required for this project shall be installed in such a manner that the original stream profiles are not altered. Existing stream dimensions (including the cross section dimensions, pattern, and longitudinal profile) must be maintained above and below locations of each culvert. Culverts shall be designed and installed to allow for aquatic life movement as well as to prevent head cutting of the streams. Pat's Branch Subdivision Page 4 of 5 September 12, 2005 7. Construction Stornnvater Permit NCG010000 Upon the approval of an Erosion and Sedimentation Control Plan issued by the Division of Land Resources (DLR) or a DLR delegated local erosion and sedimentation control program, an NPDES General stormwater permit (NCGO10000) administered by DWQ is automatically issued to the project. This General Permit allows stormwater to be discharged during land disturbing construction activities as stipulated by conditions in the permit. If your project is covered by this permit [applicable to construction projects that disturb one (1) or more acres], full compliance with permit conditions including the sedimentation control plan, self-monitoring, record keeping and reporting requirements are required. A copy of this permit and monitoring report forms may be found at http://h2o.eizr.state.iie.uslsu/Forms Documents.htm. 8. No Sediment & Erosion Control Measures w/n Wetlands or IYaters Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. The bottomless culverts and/or bridge spans will be constructed outside of the wetland area and bank of channel. The footing will be a spread footing that will be capable of supporting HS20 loading. The requirement for this loading is primarily due to construction traffic (loaded concrete truck, brick and block delivery, etc), but is also required after construction should, for example, tree removal need take place and a truck loaded with timber cross the span. Otherwise, normal residential traffic would dictate a smaller loading requirement. The naturally-occurring soil in these areas is a stiff soil determined from hand augers to a depth of approximately 5', which is the approximate depth of the footing. Such a naturally occurring soil will support a load of at least 1500 pounds per square foot. The HS20 loading of 16000 pounds per wheel pair results in a load on the structure of 64,000 pounds. Thus, the bearing alone will require 32 square feet, or 16 square feet per end should the crossing be a bridge that is 10' wide. The footing, to resist bearing would be approximately 2' wide by 10' long. The detailed structural design of the footing will be controlled by the overturning moment rather than the need to support the weight of the HS20 vehicle. Please find attached the illustration of the loading requirements for a HS20 vehicle. 2. Plan and profile are attached. 3. As discussed with Cynthia Van Der Wiele, the actual footprint of the house is not known at this time. Also, her concern was limited to the four lots on the south side of the Neuse River Buffer. We have included illustrative layouts of rather large footprints to show they may be accommodated. As well, for these four lots, we have shown the side yard and rear yard setbacks. For this exercise, we have altered the lot line between lots 20 and 21 outside of the NRB to accommodate a side-entry garage for lot 21. 5. Noted. LEVEL SPREADER OPERATION AND MAINTENANCE AGREEMENT The level is defined as an elongated, level threshold, designed to diffuse stormwater runoff. Maintenance activities shall be performed as follows: 1. After construction and until vegetation has been established, level spreader(s) shall be inspected after every rainfall. Thereafter, level spreader(s) shall be inspected at least every month and more frequently during the fall season and after heavy rainfall events: a. Accumulated sediment, leaves and trash shall be removed, and repairs made if required. b. Inspect level spreader(s) for evidence of scour, undercutting settlement of the structure, and' concentrated flows downhill from the level spreader(s). c. A level elevation shall be maintained across the entire flow-spreading structure at all times. Repair or replace the level spreader if it is damaged. d. Mow vegetation cover to a height of six (6) inches and prune plants if they cover over half of the level spreader surface. e. Repair eroded areas and replace/replant dead or damaged vegetation. 2. The contractor should avoid the placement of any material on and prevent construction traffic across the structure. If the measure is damaged by construction traffic, it shall be repaired immediately. 3. Inspect and repair the collection system (e.g. catch basins, pipes, swale, riprap) four (4) times a year to maintain proper functioning. I acknowledge and agree by my signature below that I am responsible for the performance of the maintenance procedures listed above. I agree to notify DWQ of any problems with the system or prior to any changes to the system or responsible party. Print name: Title: lTkv rJ Address: / c) Per--,7 cl? Phone: 9 16?1. Z`:1.55 1__? Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when Page 9 of 13 necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwetlands/strmgide.html. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. 2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration Program (NCWRP). Please note it is the applicant's responsibility to contact the NCWRP at (919) 733-5208 to determine availability and to request written approval of mitigation prior to submittal of a PCN. For additional information regarding the application process for the NCWRP, check the NCWRP website at http://h2o.enr.state.nc.us/wrp/index.htm. Director Division of Water Quality August 24, 2005 DWQ EXP No. 05-1542 Wake County CERTIFIED MAIL: RETURN RECEIPT REQUESTED Pogo I, LLC 12620 Port Chester Court Raleigh, NC 27614 Subject Property: Pat's Branch Subdivision REQUEST FOR MORE INFORIVIATION-EXPRESS REVIEW PROGRAM On August 17, 2005, the Division of Water Quality (DWQ) received your application and associated application fee for Riparian Area Buffer Impact Authorization in order to construct the proposed Pat's Branch Subdivision project. The 8" sanitary sewerline indicated on the southeast portion of the project has parallel impacts to the protected riparian buffer. These impacts will require a Nationwide 12/GC 3374, which was noted in the August 18, 2005 correspondence. The application fee was based on the type of action you requested on the Initial Interest form. However, your project will require written concurrence for a NW 12 / GC 3374 and will require an additional fee of $1000. Please refer to the Express Review Fee Schedule found at: http://112o.enr.state.nc.us/ncwetlands/documents/express fees.pdf. In order for DWQ to begin review and process your request, you must send an additional check made payable to the N.C. Division of Water Quality. The project has been placed on hold pending receipt of payment. DWQ will not review the application until receipt of the additional funds. At that time, the 30-day Express Review clock will restart. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ. Please call Cynthia Van Der Wiele or Cyndi Karoly if you have questions regarding this matter at 919.733.1786. Sincerely, t?
