With much help over the phone from John Dorney and Nicole Thomson of DWQ in Raleigh, Tom Stethens of DWQ in Washington, and Scott Jones of the Army Corps of Engineers in Washington, I think I have filled the application out correctly. Here is a brief summary of the proposed project: Property Lot 17, Bay Hills, Chocowinity. Waterfront residential lot on Pamlico River, approx 56' wide x 160' deep (0.47 acre - see survey). A separate lot (#20) across the street serves for the septic field (see survey and permit). Description: Gently sloping wooded lot, sandy beach on riverfront. 65' wide band of wetlands cuts across the middle, about halfway down the length of the lot. This is in an existing neighborhood of single family homes. Proposed Project We eventually plan to build on this lot, and need to put in a gravel driveway (approx 12'x290') from the road to the building site (75' setback from the river). The driveway will cross the stretch of wetlands at its narrowest point of 65', on the left side of the lot. Supporting Information • We purchased the property in July 2005. Prior to purchase, we asked Scott Jones of the Army Corps of Engineers to look at the wetlands area to determine whether it would prohibit building a house on the lot. He gave his opinion that there was plenty of room between the wetlands and the river to build a house, and that it should not be a problem getting a permit to cross the small area of wetlands with a driveway. • Scott Jones flagged the wetlands area, and we had the property surveyed by the East Group (see attached). • Fall '04: 1 spoke with both Scott Jones and a recommended contractor about putting in a driveway with minimal disturbance to the wetland area. Scott Jones recommended placing three 24" equalization pipes (DOT-recommended plastic) under the drive where it crosses the wetlands, to allow the hydrology of the wetlands to function. He recommended crossing the wetlands at the narrowest point (65') on the left side of the lot. The fill for building up the drive where it crosses the wetlands would be trucked in over the completed portion of the driveway from the street. • December '04: After many phone conversations with Scott Jones (ACE) and Tom Stethens (DWQ Washington), it was determined that I needed to apply to DWQ in Raleigh for the permit. I then reached Nicole Thomson who directed me to John Dorney in Raleigh. He spoke with me at length about the project and walked me through filling out the correct application. He also suggested that I send a courtesy copy to the Army Corps of Engineers, which I am doing. Many thanks to all of these helpful people. Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at htti)://1]2o.enr.state.nc.us/ncwetlands/strm?*ide.litnil. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., decd restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction.
