After reviewing your application, we have determined that this project is covered by Water Quality General Certification Number 3374, which can be viewed on our web site at http://h2o.enr.state.nc.us/ncwetiands. i This General Certification allows you to use Nationwide Permit Number 12 once it is issued to you by the U.S. Army Corps of Engineers. Please note that you should get any other federal, state or local permits before proceeding with your project, including those required by (but not limited to) Sediment and Erosion Control, Non-Discharge, and Water Supply Watershed regulations. The above noted Certification will expire when the associated 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. if you change your project, you must notify us in writing, and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter; and is thereby responsible for complying with all conditions. Continuing Compliance. The Town of Faith shall conduct all activities in a manner so as not to contravene any state water quality standard (including any requirements for compliance with section 303(d) of the Clean Water Act) and any, other appropriate requirements of state and federal law. If DWQ determines that such standards or laws are not being met (including the failure to sustain a designated or achieved use) or that state or federal law is being violated, or that further conditions are necessary to assure compliance, DWQ may reevaluate and modify this certification to include conditions appropriate to assure compliance with such standards and requirements in accordance with 15 A NCAC 2H.0507(d). Before codifying the certification, DWQ shall notify the Town of Faith and the US Army Corps of Engineers, provide public notice in accordance with 15A NCAC 2H.0503, and provide opportunity for.public hearing in accordance with 15A NCAC 2H.0504. Any new or revised conditions shall be provided to the Town of Faith in writing, shall be provided to the United States Army Corps of Engineers for.reference in any permit issued pursuant to Section 404 of the Clean Water Act, and shall also become conditions of the 404 Permit for the project. It has come to our attention that there maybe some confusion as to what is permissible when crossing streams with utility lines. North Carolina's General Certification (GC) #3374, which corresponds with Nationwide Permit #12 issued by the US Army Corp of Engineers, list 25 conditions (requirements) for utility line construction. Based on observations that staff has made in the field, the following conditions of GC 3374 are of particular importance: #3) :Mitigation may be required if the cumulative impacts of the project exceed 150 linear ft. of stream. This is calculated for the entire project. (Example: four streams, each with 40 linear feet of impact. The total impact is considered to be 160 linear ft.) #4) If the utility line runs parallel to a stream, the construction corridor shall not be closer than 10 ft. to the channel (25 ft. if the stream is a HQW). This condition refers to the construction corridor and not the utility line itself. At a minimum, a 10 ft. vegetated buffer _ is required along the stream. #9) If riprap'is to be used it shall be kept to a minimum and imbedded into the streambed below the normal high water level to allow passage of aquatic animals. During past site inspections, it has been observed that riprap was "dumped" into the channel without regard to stream flow. Where possible (especially in small channels), soft stream stabilization techniques (matting and vegetative ,plantings) should be utilized. Also, the stream should be restored and returned to its original grade and elevation. #15) Permanent maintenance corridors are limited to 10 ft. in streams and wetlands. Condition #4 above relates to the construction corridor, not the permanent maintenance corridor. Permanent impacts (riprap, etc.) should not exceed 10 ft. of stream channel. Frequently, staff have observed riprap lining of up to 40 ft of stream channel, which is far in excess of what is needed for adequate stabilization. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition that conforms to Chapter 1508 of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. We are notifying both the USACE and NC DWQ due to previous impacts requested and granted for sewer construction by the Town of Faith. Earlier permit approvals were obtained in 2001 (Action ID 200230087,200230088 & DWQ#01-1548) for temporary impacts of .995 acres of Waters and permanent impacts of 0.012 acres of Waters. The earlier approval involved temporary stream impacts of 3411f and permanent impacts of 1801f. Permanent impacts were requested under Nationwide 39 for sewer crossings that could not follow the conditions of Nationwide 12. Namely, fitting the sewer corridor to an existing Town (streets, homes, etc.) did not allow for perpendicular crossings in all cases. The purpose for the initial and current permit requests involved construction of sanitary sewer due to water quality problems caused by failing septic systems. Faith is located approximately 5 miles southeast of Salisbury and Interstate 85. The current project site is shown on the attached USGS Topo Quad vicinity map (35°36'3.86"N, 80°27'13.23"W). The current PCN requests impacts of 201f (60sf) of stream impact and 2sf of wetland impact for one sewer crossing. Due to the nature of the project (for water quality), amount of requested impact, and due to the fact the earlier impacts did not require mitigation, the applicant contends mitigation should not be required for this impact request. The current request minimizes impacts via perpendicular stream crossing and avoidance of wetlands. Since our initial involvement the first sewer corridor was relocated to avoid streams and manholes added to minimize and in some cases avoid wetland impacts. This project is unique due to the fact that the proposed sewer has to conform to the existing town elements and because the landscape contains vast amounts of granite with which to contend. Included are: (1) a completed Pre-Construction Notification application, (2) signed Agent Authorization Form, (3) USGS Site Vicinity Map, (4) Vicinity map of current and previous impacts, (5) Construction Plans (6) Copies of previous permits (7) Wetland Data Forms, and (8) a $200 check for 401 fees. We are notifying both the USACE and NC DWQ due to previous impacts requested and granted for sewer construction by the Town of Faith. Earlier permit approvals were obtained in 2001 (Action ID 200230087,200230088 & DWQ#01-1548) for temporary impacts of .995 acres of Waters and permanent impacts of 0.012 acres of Waters. The earlier approval involved temporary stream impacts of 3411f and permanent impacts of 1801f. Permanent impacts were requested under Nationwide 39 for sewer crossings that could not follow the conditions of Nationwide 12. Namely, fitting the sewer corridor to an existing Town (streets, homes, etc.) did not allow for perpendicular crossings in all cases. The purpose for the initial and current permit requests involved construction of sanitary sewer due to water quality problems caused by failing septic systems. Faith is located approximately 5 miles southeast of Salisbury and Interstate 85. The current project site is shown on the attached USGS Topo Quad vicinity map (35°36'3.86"N, 80°27' 13.23"W). The current PCN requests impacts of 201f (60so of stream impact and 2sf of wetland impact for one sewer crossing. Due to the nature of the project (for water quality), amount of requested impact, and due to the fact the earlier impacts did not require mitigation, the applicant contends mitigation should not be required for this impact request. The current request minimizes impacts via perpendicular stream crossing and avoidance of wetlands. Since our initial involvement the first sewer corridor was relocated to avoid streams and manholes added to minimize and in some, cases avoid wetland impacts. This project is unique due to the fact that the proposed sewer has to conform to the existing town elements and because the landscape contains vast amounts of granite with which to contend. Included are: (1) a completed Pre-Construction Notification application, (2) signed Agent Authorization Form, (3) USGS Site Vicinity Map, (4) Vicinity map of current and previous impacts, (5) Construction Plans (6) Copies of previous permits (7) Wetland Data Forms, and (8) a $200 check for 401 fees. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. Page 9 of 12 If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing.
