We are requesting for NC Division of Water Quality (NCDWQ) written approval under Section 401, Clean Water Act, 33 USC 1344. This will assist in compliance with Water Quality Certification (WQC) 3404 and it's accompanying Nationwide Permit (NWP) 14. We have addressed your included written comments in the following paragraphs. 1. Please provide a location map for the project. Please refer to the attached USGS site location map. There is also a vicinity map on the upper right corner of the Site Layout Plan Sheet. 2. Please show all stream impacts including all fill slopes, dissipaters, and bank stabilization on the site plan. Please refer to the revised Stream Crossing (C2) Plan Sheet. 3. Please indicate the location of the protected buffers as overlays on the site plan clearly identifying Zone 1 and Zone 2. Please refer to the revised Site Layout (C 1) and Stream Crossing (C2) Plan Sheets. The respective riparian zones are shaded accordingly. 6. Please locate all isolated or non-isolated wetland, streams and other waters of the State as overlays on the site plan. Please refer to the revised Site Layout (C1) and Stream Crossing (C2) Plan Sheets. The two wetland areas are represented by hatching. The first wetland area is near the north property line near the confluence area of the two streams on lots 11, 13- 15, 55, 65, and 64. The second wetland area is along Hooks Branch and its tributary. 7. Please indicate the diffuse flow measures on the site plan. It appears though the level spreaders are located perpendicular rather than parallel to the contour lines. Please refer to the revised Site Layout (C1) and Stream Crossing (C2) Plan Sheets. The level spreaders adjacent to the proposed stream crossing have been corrected. All level spreaders are located parallel to the contour lines. 8. Please provide documentation that the Ut to Hodges Creek referenced in the table contained within Section VI, No. 4, is intermittent. This determination must be made by DWQ. For planning purposes, the UT to Hooks Branch will be considered a perennial stream. 9. Please correct the buffer impact total in the table contained within Section X., No. 2. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive five copies of the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional information.
