III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impcrvious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property
boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion,
so long as the property is clearly defined. For administrative and distribution purposes, the
USACE requires information to be submitted on sheets no larger than 11 by 17-inch format;
however, DWQ may accept paperwork of any size. DWQ prefers full-size construction
drawings rather than a sequential sheet version of the full-size plans. If full-size plans are
reduced to a small scale such that the final version is illegible, the applicant will be informed that
the project has been placed on hold until decipherable maps are provided.

at the time ofthis application: The site is currently zoned for a cluster subdivision R-20 &
R-30. It was previously utilized as a mobile home park. The site contains, existing water and

sewer lines. a wastewater treatment plant. pre-existing community wells. pre-existing roads
and two ponds.
10. Describe the overall project in detail, including the type of equipment to be used: We will
be developing this site utilizing the pre-existing infrastructure as much as possible. We will
be replacing and upsizing Storm Pipe and adding headwalls on some structures to prohibit
impacting designated wetlands. intermittent streams and other water features on site.
11. Explain the purpose of the proposed work: Stormwater Management of subdivision site.
IV. Prior Project History
If jurisdictional determinations and/or permits have been requested and/or obtained for this
project (including all prior phases of the same subdivision) in the past, please explain. Include
the USACE Action ill Number, DWQ Project Number, application date, and date permits and

VI. Proposed Impacts to 'Vaters of the United StateslWaters of the State

wetlands, open water, and stream channels associated with the project. Each impact must be
listed separately in the tables below (e.g., culvert installation should be listed separately from
riprap dissipater pads). Be sure to indicate if an impact is temporary. All proposed impacts,
permanent and temporary, must be listed, and must be labeled and clearly identifiable on an
accompanying site plan. All wetlands and waters, and all streams (intermittent and perennial)
should be shown on a delineation map, whether or not impacts are proposed to these systems.

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.

We are not impacting any wetlands or existing streams on the property. We will be replacing
and upgrading some existing storm pipes. However: our construction will remain the roadway or
the right of way.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on January 15, 2002, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete.
An applicant may also choose to review the current guidelines for stream restoration in DWQ's
Draft Teclmical Guide for Stream Work in North Carolina, available at
http://h20.em.state.nc.us/ncwetlands/strm gid e.htm I.

and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)

Trigon Engineering Consultants, Inc. (Trigon) is pleased to providc this report ofthc preliminary survcy
of strcams and wctlands at the refcrenccd sitc. This report summarizcs our field methods, observations,
and conclusions.
BACKGROUND
The sitc is located at the southcast corner of the intersection of Cass Holt Road and Buckhorn Duncan
Road southeast of Holly Springs in Wake County, North Carolina. Thc site is approximatcly 160 acres,
and is mostly wooded with somc opcn areas. Thc opcn areas arc primarily located on the northern
portion of thc sitc, at the loeation of a former mobile homc park. Somc pavcd roadways arc also loeated
within thc northern portion ofthc site. Two ponds (6.5 acres and 1.3 acres), Buckhorn Creek, and several
unnamed tributaries of Buckhorn Creek arc located on the propcrty. The attachcd USGS Fuquay-Varina
Quadrangle shows thc location of the sitc (Figure I). The property lies within thc Capc Fear River Basin
and is thercfore subject to local strcam buffer ordinances.
The sitc was visited on July 27 and July 30, 2004 for the purpose of dctermining if wetlands cxist in
portions of the sitc selectcd by Taylor Wiseman & Taylor and flag thc extent of wetlands so that survcy
crews may includc the boundaries on the sitc survey drawings.
STREAMS
Based on our observations, Buckhorn Creek and tributarics to Buckhorn Crcek located on the property
arc subject to buffer requirements imposed by Wake County. According to Mr. Byron Brady with the
Wakc County Environmental Services - Erosion, Flood and Stornnvater Division, all drainagc featurcs

depicted in the USDA Wake County Soil Survey rcquire a 50-foot buffer from the top of the stream
banks. This includes the following streams and/or drainage features:
. Buckhorn Crcek, located on the southem portion of the sitc;
. An unnamed tributary of Buckhom Creek which runs through the two on-sitc ponds locatcd on
the westem portion of the site and three small branches of this tributary including a braneh
cntering the tributary from the east near the 1.3 acre pond, a branch entcring the tributary from
the cast north of tile 6.5 acre pond, and a branch entcring the tributary from the north near the
source of the tributary on tile northwestern portion of the site;
. An unnamed tributary of Buckhorn Crcck located on the southeastcrn portion of the site and
divided into two branches near its source;
. An unnamcd tributary of Buckhorn Crcek locatcd on the northeastern portion of the site.
The streams and drainage fcaturcs describcd above are shown on thc Wake County Soil Survey map
(Figurc 2). One additional drainagc featurc is dcpicted on tile Wake County Soil Survey map east ofthc
sewer package plant. However, this drainage featurc was not observed at thc site. Streams and drainage
features requiring buffers, based on our review of the conditions at tile site, are shown on Figure 3.
WETLANDS
The purpose of the wctlands investigation was to identify conditions supporting wctlands at the sitc.
Based on a conversation with Mr. Jim Jatko on July 29, 2004, the scope was modified slightly to excludc
Buckhorn Creek from the investigation. Thc mcthodology used to identify areas suspected of having
conditions to support wetlands included walking thc suspected areas to observe existing vegetation, soil
characteristies, and hydrology.
Wetlands arc defined by the U.S. Army Corps of Engineers and the United States Environmental
Protection Agency as "those areas that are inundated or saturated by surfacc or groundwater at a
frequency and duration sufficient to support, and under normal circumstances, do support a prevalence of
vegetation typically adapted for life in saturated soil conditions." In order for an area to be classified as
wetlands, hydrophytic vegetation, hydric soil conditions and wetland hydrology indicators must be
present.
Idcntification of wetlands was based on thc 1987 Corps of Engineers Wetland Delineation Manual. Low-
lying areas and drainage features were investigated for conditions supporting wctlands at the sitc.
Specifieally, two ponds (loeated on the wcstern portion of the site), several unnamed tributaries of
Buckhorn Creek (flowing from north-to-south into Buekhorn Creek), and the area adjacent to the ponds
and streams werc investigated. The approximate boundaries of thc identified wetlands wcrc marked by
hanging orange survey tape. The survey tape was numbered sequentially for each wetland area
identified. However, Trigon did not survey the wetlands boundarics.
Nine areas werc identified as wetlands:
· The 1.3 acre pond located on the southwestern portion of the site;
· The 6.5 acre pond located on the westem portion ofthc site;
· An arca along the westernmost tributary of Buckhorn Creek, north of the 6.5 acrc pond, and
delineated by flag numbers 101 tiuough 105;

The locations ofthe wetland arcas idcntified above are depicted in Drawing 3.
CONCLUSIONS AND RECOMMENDATIONS
It is our opinion that Buckhorn Creek, unnamed tributaries to Buckhorn Creek, and wetlands identified at
the site would be eonsidered jurisdictional "Waters of the United States" regulated under Section 401
and Section 404 oftlle Clean Water Act. Section 401 is administered by the North Carolina Department
of Environment and Natural Resources Division of Watcr Quality. Scction 404 is administered by the
United States Army Corps of Engincers. These programs regulate the discharge of dredged or fill
material into Waters of the United States, and ensure State Water Quality Standards are maintained.
We recommend that best management praetices be implemented to avoid impacts to the stream buffer
and wetland areas. However, if necessary or desired, stream and wetland impacts may be permitted and
variances to the stream buffer requirements could be pursued. Please contact the undersigned if
