The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program (NC EEP) is willing to
accept payment for impacts associated with the above referenced project. Please note that this decision does not assure that
the payment will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the
applicant to contact these agencies to determine if payment to the NC EEP will be approved.
This acceptance is valid for six months from the date of this letter. If we have not received a copy of the issued 404
PermitJ401 Certification within this time frame, this acceptance will expire. It is the applicant's responsibility to send
copies of the 404/401/CAMA permits to NC EEP. Once NC EEP receives a copy of the 404 Permit and/or the 401
Certification an invoice will be issued and payment must be made.
Based on the information supplied by you the impacts that may require compensatory mitigation are summarized in the

Upon receipt of payment, EEP will take responsibility for providing the compensatory mitigation for the permitted impacts
up to a 2: 1 ratio, (buffers, Zone 1 at a 3: I ratio and Zone 2 at a 1.5: I ratio). The type and amount of the compensatory
mitigation will be as specified in the Section 404 Permit and/or 401 Water Quality Certification, and/or CAMA Permit. The
mitigation will be performed in accordance with the Memorandum of Understanding between the N. C. Department of
Environment and Natural Resources and the U. S. Army Corps of Engineers dated November 4, 1998.

Shoreline Stabilization
1) The alignment of the permittcd bulkhead shall be staked by a rcpresentative of the Division of Coastal
Management within a maximum of 30 days prior to the start of any construction. Failure to initiate
construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the
alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of
construction.
2) The authorizcd bulkhead shall be located landward of the Normal High Water Level and any Coastal
Wetlands.
3) The bulkhead shall be constructed prior to any backfilling activities.

* other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.

The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other
suitable materials approved by department personnel. No excavntion is permitted except for that which
may be required for the construction of the bulkhead wall, riprap, cleadmen cables, elc. This permit docs
not authorize any excavation waterward of the approved alignment.

The fill material shall be clean and free of any pollutants except in trace quantities.
7)
All backfill material shall be obtained from a high ground source and confined behind the permitted
bulkhead.
Sedimentation and Erosion Control
All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion
within thirty days of project completion.
A silt fence shall be properly installed immediately landward of the bulkhead cap immediately following
completion of backfilling activities.
General

In order to compensate for impacts to 0.02-acres of wetlands, the permittee shall make payment to the
North Carolina Ecosystem Enhancement Program (NCEEP) in the amount determined by the NCEEP,
sufficient to perform the restoration of 0.02-acres of non-riparian Cladium Marsh wetlands in the Tar-
Pamlico River Basin, Cataloging Unit 03020105. Construction within jurisdictional areas on the
property shall begin only after the permittee has made full payment to the NCEEP and provided a copy
of the payment documentation to the Army Corps of Engineers and the Division of Coastal
Management, and the NCEEP has provided written confirmation to the Corps that it agrees to accept
responsibility for the mitigation work required, in compliance with the MOU between the North
Carolina Department of Natural Resources and United States Army Corps of Engineers, Wilmington
District, dated November 4, 1998,

The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon
due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions
caused thereby, without expense to the United States or the state of North Carolina. No claim shall be
made against the United States or the state of North Carolina on account of any such removal or
alteration.

Approval of 401 Water Quality Certification (GC3400) with Additional COllditions
Dear Mr. Freese:
You have our approval, in accordance with the attached conditions, to place fill material within or
otherwise impact 0.02 acres of 404 vegetated wetlands to prepare property for construction of a single
family residence as described in your application received by the Division of Water Quality (DWQ) 401
OversightlExpress Review Permitting Unit on August 2, 2005. After reviewing your application, we have
determined that the Division of Water Quality (DWQ) General Water Quality Certification Number 3400
covers these water impacts. This Certification allows you to General Permit No. 198000291 when issued
by the US Army Corps of Engineers (USACE). In addition, you should get or otherwise comply with any
other federal, state and local requirements before you go ahead with your project including (but not
limited to) erosion and sediment control regulations and CAMA. Also, this approval to proceed with
your proposed impacts or to conduct impacts to waters as depicted in your application shall expire
upon expiration of the 404 or CAMA Permit.
This approval is for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application. If the property is sold,
the new owner must be given a copy of this Certification and approva11etter and is thereby responsible for
complying with all conditions. If total fills for this project (now or in the future) exceed one acre of
wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A
NCAC 2H .0506 (h). This approval requires you to follow the conditions listed in the attached
certification and any additional conditions listed below.

2. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable
Buffer Rules, and any subsequent modifications, the applicant is required to return the attached
certificate of completion to the 401 OversightJExpress Review Pennitting Unit, North Carolina
Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650.
3. Water Quality Certification
The proposed project must comply with all of the conditions of General Water Quality
Certification (GC) 3400.
Violations of any condition herein set forth may result in revocation of this Certification and may result in
criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct
impacts to waters as depicted in your application and as authorized by this Certification, shall expire upon
expiration of the 404 or CAMA Pennit.
If you do not accept any of the conditions of this Certification (associated with the approved water
impacts), you may ask for an adjudicatory hearing. You must act within 60 days ofthe date that you
receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the
North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a
hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

fringe along a man made canal and backfill behind the bulkhead 50' landward including 886 ft2 of 404
wetlands for preparation to later construct a single family residence.

Project Setting
The project site is located off SR 1362 on Tom Neal Drive on the east side of
Ocracoke Island on a man made canal off the Pamlico Sound on lot number 14 of the
Soundshore subdivision, Hyde County, North Carolina. The site is an undeveloped, wooded
residential lot 117' wide (along canal) x :!: 173' deep. The vegetation on the lot consists
mainly of hardwoods and shrubs including loblolly pine live oak and eastern red cedar. The
neighboring lot on the west side is developed with a single-family residential structure and
bulkhead while the adjacent lot on the north side is a vacant highground lot with a bulkhead
vegetated mainly with upland grasses. The project site is :!:4' above the normal water level
(NWL) with the exception of a depression:!: 10' from the NWL. This depression totaling
886 ft2 has been delineated by the U.S. Army Corp of Engineers as a wooded 404 wetland.
Although the depression is vegetated with Cladium iamaicense it is not subject to regular or
irregular flooding by wind tides thus has not been claimed as a Coastal Wetland by the
Division of Coastal Management. Vegetation in this depression, encompassed in the area
delineated as 404 wooded wetlands, includes palmetto, live oak, poison oak, morning glory,
St. Augustine grass, yaupon and beach pea. This depression most likely was created during
the original excavation of the canal system with the Coastal Wetland species surviving after
having been placed there and or cut off during spoil deposition. There is a fringe of Coastal
Wetlands along the canal bank of varying widths. The Coastal wetland fringe is vegetated
with Spartina alterniflora, Scripus sp, and Cladium iamaicense. There is an existing septic
tank and house pilings on the lot installed several years ago.
Pamlico Sound on the east side of Ocracoke Island is classified as SA Waters by the
Environmental Commission and is open to shell fishing however the canal system of the
Soundshores subdivision is closed.
Project Description
The applicant proposes to construct a bulkhead on the landward limit of the Coastal
Wetland fringe and backfill an area landward of the bulkhead some 50' including the 886 ft2
of 404 wetlands. The applicant reports that this project is in preparation for future
development of the lot as a single-family residence,
Project Impact
The project as proposed will result in the filling of :!:886 ft2 of 404 delineated
wetlands within the 75' Estuarine Shoreline. The backfilling of the bulkhead and lot will
result in the disturbance of :!:5,850 ft2 of uplands.
