PROJECT SUMMARY: The applicant proposes to construct a city park and public amphitheater with site grading/excavation, shoreline stabilization, timber walkways and a transient floating dock adjacent to a section of the northern Wilmington downtown Riverwalk along the east bank of the Northeast Cape Fear River. PROJECT DESCRIPTION The project site is a parcel of the old Almont Shipping Terminals property adjacent to the Northeast Cape Fear River (NECFR) in downtown Wilmington, New Hanover County. To locate the site from the Wilmington Regional Office (WiRO) travel south on Market Street (U.S. HWY 17) until you reach Martin Luther King, Jr. Parkway (N.C. HWY 74) which will be located on the right. Turn right and travel west approximately 3.5 miles until you arrive at North 3`d Street in downtown Wilmington. Tum right onto N. Front Street and then take the second right onto Harnett Street until you reach the property of interest, which is located just to the west of the existing PPD building. The project site is located between Cowan Street to the north and Harnett Street to the south. The applicant's property is an approximately 6.4 -acre tract of urban waterfront land, which averages approximately 1Oft. — 14ft. above mean high water (MHW) abutting the NECFR with approximately 800 linear feet of shoreline. The project also includes a 38,769 sq. ft. City of Wilmington right-of-way on the Nutt Street and Old Front Street Promenades. The property was purchased by the City from Riverfront Holdings LLC in December of 2013. The site has been associated with the old Almont Shipping Site along the Northeast Cape Fear River. It is a designated Brownfields site and was most recently utilized for spoil disposal during excavation for the adjacent Northern Riverfront Marina, the upland portion of the project site was authorized as the designated spoil location for the excavated spoil material associated with State Permit No. 44-07. Once the material was de -watered, it was utilized as backfill for the new bulkhead and fill material and for the authorized upland development under State Permit No. 44-07. This site has also been authorized for re- development through a separate Brownfields Agreement. On March 28, 2014 a Soil Fill Source Approval was issued by the Brownfields Project Manager for the Northern Park Property authorizing the use of "clean fill" from Wilmington Materials on this site. The project limits extend north along Cowan street and the CFPUA pump station. The site is bordered to the south by a parking lot and vacant land, to the west by the Cape Fear River and existing Riverwalk and to the east by vacant land. The high ground areas, due to the industrial activities, are mostly un -vegetated except for sections of Coastal and Section 404 wetlands along the northern shoreline. There is existing rubble/rip-rap shoreline stabilization along a portion of the project site. There was an existing drainage ditch located within the center portion of the project site, located within a 50' City of Wilmington easement. The stormwater pipe has been abandoned and the wetland area was previously filled under State Permit No. 62-13. The drainage ditch located within the center of the project site (City easement) was impacted with 1,402 sq. ft of fill within Section 404 areas under a modification to State Permit No. 62-13 issued on November 14, 2013. Three pockets of Coastal Wetlands (769 sq. ft) along the southern shoreline downstream of the drainage ditch were determined to be insignificant in ecological function and were authorized for fill under an additional modification to State Permit No. 62-13 issued on March 11, 2014. State Permit No. 62-13 expired on December 31, 2016. The majority of the existing Coastal Wetlands in this area consists primarily of Smooth Cordgrass (Spartina alternii lora); however, wetland species also includes the invasive species Common Reed (Phragmites australis). The vegetation along the northern end of the project consists of a marsh fringe ranging from approximately 20' to 80' in width as you move from south to north, consisting primarily of Smooth Cordgrass (Spartina alternii lora), Bulrush (Scirpus spp.) and Giant Cordgrass (Spartina cynosuroides). Due to the elevation, the vegetation transitions into §404 type wetlands, consisting primarily of Common Reed (Phragmites australis). Existing Coastal Wetlands and the normal high water boundary (NHW) are located on a Jurisdictional Determination dated March 6, 2019 and have been verified by the U.S. Army Corps of Engineers (USACE) (See Jurisdictional Determination map dated received on May 15, 2019). City of Wilmington North Waterfront Park c/o Everett Pannkuk Page Three This project site is located just south of the old Dean Hardwoods property which has been re -developed under State Permit No. 76-97. Existing structures on this property includes an open water marina facility, shoreline stabilization, a timber Riverwalk and mixed-use upland development. The City of Wilmington/New Hanover County Joint 2006 CAMA Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Urban Conservation. The waters of the NECFR are classified SC by the Division of Water Resources. They ARE designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. The USACE federally maintained channel and associated Wilmington Harbor is located adjacent to the project site. PROPOSED PROJECT: The applicant proposes to construct a city park and public amphitheater with site grading/excavation, shoreline stabilization, timber walkways and a transient floating dock adjacent to a section of the northern Wilmington downtown Riverwalk along the east bank of the Northeast Cape Fear River. The upland portions of this proposed project consist of an open stage with pile supports, concrete mat slabs and a steel frame, a concession building with steel frame, restroom building and park support building with a concrete retaining wall. There would be temporary seating installed directly adjacent to the stage with a concrete banded step area leading to the grass seating area. Timber framed elevated walkways are proposed are proposed with three areas of connection to the existing Riverwalk (see Sheets 3, 7 and 12 of 13). According to the applicant the total impervious coverage for the site would be 36% with 2-4% (portion of the stage and shoreline stabilization) being within the 75 ft. Coastal Shoreline AEC area. A new road would be constructed by the City on the Nutt Street right- of way and the Old Front Street right-of-way as part of this project (see Sheets 3 and 6 of 13). Please note the site development plan has been submitted to the Division of Water Resources Stormwater Section for review. The proposed high ground excavation would result in approximately 13,900 cubic yards of Brownfields site soils being excavated in an area measuring approximately 250 ft. in length by an average of 170 ft. in width (see grading plan Sheet 3 and 7 of 13). According to the applicant the excavation is to create grassed green space for educational areas and walkways within the park. Disposal of this material would be onsite, in an area measuring approximately 360 ft. long by 180 ft. wide and would seek approval through the Brownfields program. The disposal location includes the green space and sitting areas within the amphitheater allowing for the desired elevation change for stage viewing. The application states that 3 sediment basins will be installed for containment of surface water and filter fabric would be installed between contaminated soils and backfilled soils. Please note: Five existing monitoring wells on the southwest side of the property are proposed to be abandoned. There is a Brownfields agreement for this property and it is recorded with the New Hanover County Register of Deeds on Book 53 Pages 55-59. Proposed shoreline stabilization consists of Precast concrete and marine mattresses filled with rock (see sheets 3, 7, 11 and 12 of 13). The existing rip rap would be removed from the NHW line and above only. An approximately 620 ft. long by 19 ft. area along the existing shoreline would be transitioned from existing rip rap to what the applicant refers to as "beach amoring". The area is entirely above NHW and would be excavated back to the flexi mat and marina mattresses. The shoreline stabilization would be installed at a 4:1 slope in areas ranging from 10 ft. to 90 ft. landward of NHW. The area between NHW and the new flexi-mat material would be upland grass. The applicant states that no Coastal Wetlands would be filled for shoreline stabilization. The application states that the toe of the shoreline stabilization would begin a minimum of 10 ft. landward of NHW. The proposed floating dock would be 240 ft. long by 15 ft. in width to provide 9 transient slips associated with the park and amphitheater. The floating dock would be oriented parallel to the shoreline with access from the existing Riverwalk. (see Sheet 3 and 13 of 13). According to the applicant, the floating dock City of Wilmington North Waterfront Park c/o Everett Pannkuk Page Four would be located in water depths of -14 ft. at Mean Low Water and would extend a maximum of 18 ft. waterward of the Riverwalk. Due to the proximity of the Federal channel in this location of the NECFR, the pilings for the proposed floating dock would be located just landward of the Wilmington Harbor Line; however, the floating dock itself would encroach approximately 15 ft. into the Wilmington Harbor Line. The applicant states that there are no services proposed such as fuel, maintenance or a pump out 10. ANTICIPATED IMPACTS The proposed amphitheater park and upland shoreline stabilization would impact approximately 319,295 sq. ft. of high ground area, including the City of Wilmington road construction, essentially within an area of shoreline in the riverfront which has been usurped with historical fill associated with the industrial use of the Brownfields site. The proposed shoreline stabilization portion of high ground area is almost entirely within the 75 ft. AEC. No impacts to Coastal Wetlands are proposed. The proposed floating dock would incorporate 3600 sq. ft. of Estuarine Waters and Public Trust Area immediately adjacent to the existing Riverwalk. As proposed, the proposed structures would conform to the 1/4 distance rule; however, the floating dock would encroach into the Wilmington Harbor Line. The application states that these structures are designed to be removed if required by the USACE. The proposed floating dock would provide side to transient slips for up to 9 vessels. The construction will consist of site grading, an open -building steel -framed amphitheater, steel -framed concession/restroom building with CMU infill walls, timber -framed elevated walkways connecting to the existing Riverwalk, a new floating dock with piles landward of the harbor line and an aluminum gangway accessed via the existing Riverwalk. Also, there will be excavation work for grading purposes as shown on the attached drawing page 5 of 14. No excavation below NHW is planned. The contaminated soil will remain on site and property in accordance with the Brownfrelds Agreement. A portion of the existing riprap protection will be removed and replaced with beach armoring and marine mattress with stone fill. The existing coastal wetlands located at the north end of the property will be left undisturbed. The total tract will be 36% covered by impervious area.
