I've reviewed your request and a modification of the 401 is not required as the rip -rap
will be placed in an area already permitted for fill. The revised plans are sufficient for
our files. You may proceed with this activity as described in your submittal during the
moratorium per the agreement from WRC. Thanks and let me know if you have any

Jay,
During the land quality review today, on this project, we discussed this with Garcy and
the contractor. Through the conversation it was decided it would be better to build the
slop with Class II rip rap, as opposed to just keying in the rip rap on a soil slope. All
thought it would be better for securing the slope.
Garcy stated he just needs a revised plan sheet, since we are not going outside of the
permitted area.
