Rose Federal Highway Administration/Eastern Federal Lands Highway Division 21400 Ridgetop Circle, Suite 310 Sterling, VA 20166 SUBJECT: Proposed Road Rehabilitation in the Pee Dee National Wildlife Refuge, RRP-PED 10(1), Anson County, DWQ #09-0406 Dear Mr. Rose: The Division of Water Quality (DWQ) has reviewed your submittal for a 401 Water Quality Certification for the aforementioned project. Review of your application, in association with a site visit on April 30, 2009, revealed it is lacking the necessary information required for making an informed permit decision. The permit application was deficient in the following areas: • Potential jurisdictional resources (to include both streams and wetlands) were identified during the site visit. Many of these resources were not included in the permit application. All jurisdictional resources must be properly identified (delineated) and accounted for in the Pre-Construction Notification (PCN). • Upon the verification of jurisdictional resources, the PCN must be revised to adequately address proposed impacts to jurisdictional resources. This shall include avoidance and minimization measures with respect to the effected jurisdictional resources, proposed mitigation for impacts (if required) and appropriate plans (i.e., cross-sections and plan view drawings) depicting jurisdictional resource impacts. Therefore, pursuant to 15A NCAC 2H .0507(a)(5), we will have to place the permit application on hold until we are supplied with the necessary information. You have 21 days to respond in writing with the requested information or notification to this office that the information is forthcoming. If, at the end of the 21 days, this office has not received this information in writing, we will assume you are withdrawing your application and it.will be returned.
