Erin, the information you provided does satisfy my concerns and questions. I will
proceed with processing the permit modification.
April, please note that our letter will authorize 26 linear feet of additional fill (loss of
stream). I'm not sure if this affects your 401, but wanted to give you a heads up just in
case.

See below responses to your questions. Looks like there are 4 more feet of permanent
impacts than was presented in the April mod/renewal application. I have attached
revised tables and permit drawings showing the 4 additional feet.
If the responses suffice, let me know and I will request revised DMS acceptance

Jerry,
1. It was simply an error on the part of whoever drew the fill line on the plan sheets
for this area. The cross sections show the fill extending out further than what is shown
on the roadway plans, and the surveying shots we took in the field confirm that the
cross sections are correct. The fill line juts out quickly in this area due to the steepness
of the existing bank around this stream. The slope is already 2:1, any steeper and slope
failure is a concern. A headwall wouldn't be wide or tall enough to stop this slope at the
original footprint.
The length of the stream over that distance is 26' due to the meander.

Erin,
Thank you for your Permit Modification request for, dated 5/1/2019, for the above
referenced project. I have reviewed the information and need clarification before
proceeding. Please submit the requested information below (via e-mail is fine) within 30
days of receipt of this Notification, otherwise we may deny modification of the Permit as
proposed or consider your application withdrawn:
1. Please provide an explanation as to why the fill slope at Permit Site 20 extends
further from the roadway than originally anticipated. Could the fill slopes be made
steeper, or headwalls be added, to stay within the originally authorized footprint?
2. The modification request states that the RCP at Permit Site 20 would be
approximately 22 linear feet longer than currently authorized, however it is not clear
that the amount of stream impacts would only increase by 22 linear feet. The plansheet
shows that the stream proposed for additional impacts includes a meander, which
appears to increase the amount of stream impacts required. Please resolve this
apparent discrepancy. If additional stream impacts are necessary, please submit a
revised permit modification request including a revised compensatory mitigation
proposal.
