Looks like north is starting to be the only way to run although if that is the case I will
just stay here. It is my understanding that they underestimated the length of the channel
they needed and to connect it will require the additional footage. I also agree that the
soundside channels are premature. They should have dug in the hill first and then connected.
At pres there is no landward earthworks. These holes in the sound could cause WQ issues
although no fishkills or anything else has been reported. I will keep you informed.

I can only open one of the attachments - the one with the aerial photo. What I don't
understand is why they dead-ended the canal - it's kinda useless as is, ain't it? Anyway, it
seems that if the connection was already approved in the 401, they just need to finish what
we already approved, and it shouldn't require a mod. But it seems that same logic would
apply to the CAMA permit, so why is DCM requiring a mod. It seems simpler just to make them
comply with their already approved contours, unless they are changing that now. And yes,
that name makes me more than shiver. It makes me flee - west. Oh crap, that's where Dr. Lok
King Kong is creating adventures for us in ARO. Maybe I should just go north. Cheers.

Cyndi,
I know the subject name of this email makes you shiver but I thought you would need to see
this information. I received a letter from DCM this week indicating that they were
performing a compliance check and one of the navigation channels leading to the Sandy Point
development did not connect to matching bottom contours and they would require the Fund for
Sandy Point to modify their permit to correct the situation. Not 100% sure how that works in
a mod for the 401. Your office was not on the cc list so I attached a copy of the info with
this email.

CAMA Major Permit No. 138-06
Dear Mr. Young:

Based on our conversation and an as built survey submitted by Quible and Associates, it has been determined that
Channel No. 2 does not reach a connecting depth as required by CAMA Major Permit No. 138-06, issued to The
Fund for at Sandy Point North Carolina, LLC. In order to maintain consistency with the approved development, The
Fund for Sandy Point North Carolina, LLC must obtain a permit modification and extend the channel to a connecting
depth.
A Minor Modification of the CAMA Major Permit must be obtained prior to undertaking any dredging activities, In
addition, the modification must be in place and the dredging completed by February 15, 2010. My previous letter
date July 20, 2009, incorrectly noted the completion date as October 31, 2009. Failure to obtain the modification and
undertake the dredging as required may result in the issuance of a Notice of Violation.
In order to modify the permitted project a written request must be submitted to the Division of Coastal Management
showing in detail the proposed modification, which may be shown on the existing approved application plat. The
request for a modification must be accompanied with an application fee of $100.00 payable to the NC Department of
Environment and Natural Resources (NCDENR). Please direct the request to the attention of Field Representative
Kelly Russell.
