Attn: Jeanette Powell, MS4 Program Coordinator MAY 232019 1612 Mail Service Center Raleigh, NC 27699-1612 DENR-LAND QUALITY Re: Notice of Violation (NOV-2019-PC-0284) STGRMWATER PtRivil7 ilNG Dear Mrs. Powell, This letter is intended to serve as the required response to items of the Notice of Violation (1), (2), and (3) outlined in the NOV. (1) The Town Council shall adopt a resolution demonstrating support for a compliant stormwater management program. A sample council resolution with the minimum requirements is enclosed with this letter. The Town shall have sixty (60) calendar days from the date of receipt of this letter to submit an original signed resolution to DEQ. • The sample resolution has been placed on the June 111b agenda for adoption by the Town of Maiden Council. Once adopted, the signed resolution will be sent to NCDEQ. (2) The Town shall complete the following and submit documentation to DEQ for review and comment within one hundred twenty (120) calendar days from the date of receipt of this letter: a. Conduct a self -audit which includes, at a minimum, an evaluation of compliance with the permit conditions found in Part II Section B: Public Education and Outreach; Section C, Public Involvement and Participation; Section D: Construction Site Runoff Controls. The self -audit must be documented utilizing the DEQ standard MS4 Permit Compliance Audit Report template. The Town of Maiden contracts with the Western Piedmont Council of Governments for assistance in aspects of the Public Education and Outreach, and Public Involvement and Participation. Additionally, Construction Site Runoff Controls are inspected and reviewed by Catawba County Erosion Control & Sedimentation Control for sites in the Town of Maiden. The Town of Maiden will conduct a self -audit using DEQ standard MS4 Permit Compliance Audit Report template for the permit conditions listed above and report those findings to NCDEQ. b. Develop a Stormwater Management Plan (SWMP) which details specific actions, measurable goals, and implementation timelines to bring the stormwater management program into compliance with NPDES MS4 requirements over a 5-year period. The SWMP must be documented utilizing the DEQ standard Phase II MS4 SWMP template. The SWMP must address all known compliance deficiencies including, at a minimum, the items detailed in the DEQ MS4 Program Audit Report and the self -audit. • The Town of Maiden acknowledges the need for a Stormwater Management Plan and will implement a SWMP based upon the sample SWMP which will be provided by NCDEQ. The developed SWMP changes will acknowledge the findings from the Audit on December 13, 2018 and any needed changes noted from the conducted self -audit listed in (2)a. This SWMP will be submitted to NCDEQ for review and comment. (3) The Town shall submit an NPDES MS4 permit application within thirty (30) days of receiving written DEQ concurrence that the submitted SWMP documents a compliant stormwater management program. A new 5-year NPDES MS4 permit will be public noticed along with the submitted SWMP. The Town shall respond to public comments on the Draft SWMP and shall submit a final SWMP for DEQ approval and final permit issuance. The final DEQ-approved SWMP becomes an enforceable component of the NPDES MS4 permit. • Once the Town of Maiden has received approval regarding the submitted SWMP from NCDEQ the Town of Maiden will submit an NPDES MS4 permit application. The Town of Maiden will respond to any comments on the Draft SWMP and resubmit to NCDEQ for a final permit. We acknowledge that once approved, the SWMP becomes an enforceable component of the NPDES MS4 permit.
