The following comments are submitted in accordance with the provisions of the Fish and Wildlife Coordination Act, as amended (16 U.S.C. 661-667e); the National Environmental Policy Act (42 U.S.C. §4321 et seq.); and section 7 of the Endangered Species Act of 1973, as amended (16 U.S.C. 1531-1543) (Act). According to our records and a review of the information you provided, no federally listed species or their habitats occur in the project area. Therefore, we believe the requirements under section 7 of the Endangered Species Act are fulfilled. However, obligations under section 7 of the Endangered Species Act must be reconsidered if: (1) new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered, (2) this action is subsequently modified in a manner that was not considered in this review, or (3) a new species is listed or critical habitat is determined that may be affected by the identified action. It appears that there may be portions of the project that may impact jurisdictional streams and/or wetlands. We recommend that the alignment along with any attendant features such as parking, river access, etc. be evaluated for the presence of jurisdictional waters and that information submitted to our office for review/confirmation along with detailed plans showing potential impacts to these areas. Watauga County/Blue Ridge Conservancy Middle Fork Greenway Trail Project The Solid Waste Section has reviewed the environmental scoping document for the proposed Watauga County and Blue Ridge Conservancy project to build a 10 -ft wide greenway trail from the northern end of Tweetsie Railroad to Niley Cook Road (approx. 5,000 ft.) and develop a trailhead park at Niley Cook Road to include parking, picnic shelter, river access, play area and interpretive signage, Watauga County, North Carolina. The review has been completed and has found no adverse impact on the surrounding community and likewise knows of no situations in the community, which would affect this project from a solid waste perspective. During construction, every feasible effort should be made to minimize the generation of waste, to recycle materials for which viable markets exist, and to use recycled products and materials in the development of this project where suitable. Any waste generated by this project that cannot be beneficially reused or recycled must be disposed of at a solid waste management facility approved to manage the respective waste type. The Section strongly recommends that any contractors are required to provide proof of proper disposal for all waste generated as part of the project.
