You asked for additional information/clarification on two issues: Break out the buffer impact acreage to show Zone 1 and Zone 2 amounts, and clarify the NCPC stream buffer mitigation note. For the total Modified Alternative L boundary that was permitted by the Corps in Permit No. 200110096 dated June 10, 2009, the Zone 1 buffer impact acreage is 24.4 acres, and the Zone 2 acreage is 16.5 acres. Clarification of the Note: Condition 7 of the 401 WQ Certification dated 1/15/09 states that our mitigation sites include about 24.4 acres of buffer credit, and that based on the PCS Project Impact Schedule, disturbance of buffers in the NCPC, Bonnerton or South of 33 Tracts shall not be done beyond the limits of the 2014 impact area (generally south of Drinkwater Creek). The Note updates the mitigation of buffers on the NCPC Tract, based on the Modified Alternative L boundary permitted under the Corps 404 permit, and the most up-to-date mitigation site plans. Because of additional stream avoidance that occurred between the issuance of the 401 in January and the 404 in June, the buffer impact and resulting mitigation has been reduced. The NCPC buffer impact is 10.6 acres and required buffer mitigation is 25.1 acres. The mitigation sites are projected to produce 28.5 acres of buffer credit, therefore all of the buffer impacts on the NCPC Tract would be mitigated for with our current mitigation sites.
