HomeMy WebLinkAboutNCG020939_RO Response to the NOI_20191220Strickland, Shane From: Lawyer, Mike Sent: Thursday, December 20, 2018 11:11 AM To: Riddle, Rick L Subject: FW: Request for Comments - NCG020939 - Emery Pit Rick, I have reviewed the NOI for the subject facility and noted several discrepancies, which are provided below. - Question 10 is marked Yes as an inactive mine site, but this mine is active - Question 19 has receiving waters classified as WS-II, OSW, but should be WS-II, ORW - Question 24a is marked Yes for dewatering and discharging to waters of the state while Question 24b is also marked Yes for dewatering but not discharging to waters of the state, it should be one or the other (they indicate on Question 38 that they will discharge mine dewatering wastewater) - Question 29 shows that stormwater is self-contained, but they listed a stormwater outfall on page 5 - Question 30 is marked Yes that the facility has a SWPPP, but they did not provide a date for when it was implemented - Question 35 is marked Yes about the use of chemical additives, but they did not provide the subsequent information - Question 39 is marked Yes about being a hazardous waste facility, which seems unlikely for a sand & gravel mine - on the final checklist on page 10 they marked they will not impact nearby wetlands or surface/ground waters by dewatering (meaning they will not dewater), but throughout the application they indicate that mine dewatering will occur with wetlands within 400 feet of mine, which requires a Pumping Operation & Monitoring Plan If we need to discuss these items further, please contact me.
