Dear Mr. Mellinger
I begin by saying thank you for the efforts of the Division of Water Quality to protect our water
resources in the Great State of North Carolina. The fact that we received a notice of deficiency
for what had previously been a long standing policy of cooperation concerns me greatly about
what the future holds. We work diligently to be good stewards of the environment and live up
to our name. Our relationship with DWR has always been one of a partnership rather than one
of "police and criminal". I know there are organizations who would like nothing more than to
see us put out of business and they have pressured the North Carolina Department of
Environmental Quality with their false accusations to implement policy change that is not
necessary. We have received rainfall in 2018 that totals 49.4" as of this writing and the rainfall
amounts per occurrence have made managing lagoons, crops and soil conditions difficult. We
are working hard to keep our lagoon out of the "red zone" while also remaining vigilant to
adhere to conditions set forth in our permit. I strongly believe that a return to DWR's previous
policy of cooperation will better serve the citizens of North Carolina who truly want clean
water. I believe it to be appropriate to request a rescission of the Notice of Deficiency issued to
Earth Right Farms, Inc.
