Shoreline Stabilization 1) The alignment of the permitted bulkhead and riprap shall be staked by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of any construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of construction. 2) The bulkhead and riprap shall be constructed in strict compliance with the attached workplan drawings, unless specifically altered herein. 3) All material resulting from the removal of the existing bulkhead shall be placed on an approved upland disposal site. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2008 In issuing this permit, the State of North Carolina agzees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Charles and Claudia Dunn Permit #142-05 Page 2 of 3 ADDITIONAL CONDITIONS 4) The bulkhead shall be constructed prior to any backfilling activities 5) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 6) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other suitable materials approved by department personnel. No excavation is permitted except for that which may be required for the construction of the bulkhead wall, riprap; deadmen cables, etc. This permit does not authorize any excavation waterward of the approved alignment. 7) The backfill material shall be clean and free of any pollutants except in trace quantities. 8) No backfill material shall be placed within 30 feet of the normal water line, except that which will be used to backfill the area behind the permitted bulkhead, without permit modification. 9) A silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. 10) The riprap shall not extend waterward more than 10 feet from the permitted bulkhead at any point along its alignment at the time of construction, without permit modification. 11) The riprap material shall be free from loose dirt or any pollutant. It shall be of a size sufficient to prevent its movement from the approved alignment by wave or current action. 12) The riprap material shall consist of clean rock or masonry materials such as but not limited to granite, marl, or broken concrete. 13) In accordance with commitments made by the permittee, the permitted riprap shall be angled back 45 degrees beginning where the riprap meets the adjacent property line to the west. General 14) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 15) No vegetated wetlands shall be excavated or filled, even temporarily, without permit modification. 0?0? After reviewing your application, we have determined that the Division of Water Quality (DWQ) General Water Quality Certification Number 3400 covers these water impacts. This Certification allows you to General Permit No. 198000291 when issued by the US Army Corps of Engineers (USACE). In addition, you should get or otherwise comply with any other federal, state and local requirements before you go ahead with your project including (but not limited to) erosion and sediment control regulations and LAMA. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 or CAMA Permit. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h). PROJECT SUMMARY: The applicant proposes to bulkhead and backfill f 100' of shoreline. Charles and Claudia Dunn Washington County Proiect settin The project site is located off SR 1316 at Leonard's Point on the south side of the Albemarle Sound near Roper in Washington County, North Carolina. The site is a 0.5-acre residential lot. Historically, there has been a bulkhead at the project site but it has virtually been destroyed by natural elements. Since the time the bulkhead was damaged, the shoreline has experienced severe erosion. The average erosion escarpment is ±20' landward of the previous bulkhead. No man-made features exist on the lot, except for the remnants of a bulkhead. The lot is mostly vegetated with low growth shrubs and briars. The lot was recently logged of all marketable timber. The downstream (east) side of the property is undeveloped and the shoreline is of similar character (i.e remnants of old bulkhead are severely eroded). Mr. Leonard Small, the adjacent downstream property owner has applied for a CAMA Major permit to bulkhead a long reach of his property as well. The upstream (west) property is a developed lot that contains a house, several storage buildings, a pier and bulkhead. The project site is approximately 10' above normal water level. The Albemarle Sound is classified as SB by the Environmental Management Commission at the project site. The Albemarle Sound is designated as Coastal Waters by the NC Division of Marine Fisheries and is not open to shell-fishing. Proiect description The applicant proposes to bulkhead and backfill ± 100' of shoreline. The proposed alignment will place the bulkhead on average ±10' waterward and a maximum distance of t18' waterward of the nonnal water level. This bulkhead alignment will tie in with the existing bulkhead on the upstream lot and will be landward of the remnant bulkhead located on the site. As previously referenced, the proposed alignment will be in line with that being applied for by Mr. Leonard Small. Additionally, the applicant proposes to install riprap a maximum of 10' waterward of the new bulkhead. Anticipated impacts The construction of the riprap, bulkhead and installation of backfill as proposed, will result in the filling of approximately 2,000 ft' of sound bottom. The project will result in localized turbidity as a result of the construction of the bulkhead and installation of riprap. Kelly Spivey - 11 July 2005 CAMA Major Development Permit Application Project Narrative For Claudia and Charles Dunn 23 June, 2005 Claudia and Charles Dunn are requesting approval of a North Carolina Coastal Area Management Act major permit for lot 6 (of the lots of R. W. Leary) located in Skinnersville Township, Washington County, N. C. The purpose of this development permit is stabilization of personal property adjoining the Albemarle Sound. The proposed development work will consist of: • restoration/replacement of storm damaged bulkhead and • backfilling of the area between the escarpment and the restored bulkhead This permit application proposes to restore or replace damaged existing bulkhead with wood, vinyl, or riprap. A local marine construction company will perform bulkheading. The erosion area will be backfilled with sandy clay from on site (upland borrow) by backhoe, dump truck, and/or bulldozer. These repairs will ensure property stability for future personal use. Additionally, unless bulkhead has been restored on property belonging to Albemarle Farms (eastern boundary of lot 6), the permit requestors are seeking permission to install a wing wall in that area. The wing wall would remain until such time as adjoining Albemarle Farms has been bulkheaded. The adjacent property owner (Leonard Small/Albemarle Farms) has also applied for a major CAMA permit to replace storm damaged bulkhead.
