Charlie Davis wrote: RE: Phase I Sanitary Sewer Improvements for the Smithfield Packing Company DWQ Project 4 20051328 Lenoir County Ms. Karoly, I feel it is necessary to address some recent confusion regarding the above referenced project. On September 12, 2005, I received an email from Laurie Dennison of your office indicating that additional information was required for the project. The attached letter to her 9/12/05 email was the July 28, 2005 letter from your office requesting information. I was concerned about the receipt of this letter since we had responded to such comments in our return correspondence to your office dated August 4, 2005. From Ms. Dennison's email, I was of the impression that your office had not received our 8/4/05 correspondence. Subsequently, we made a copy of the 8/4/05 response letter w/ attachments and hand delivered it to your office. Following this action we received the September 2, 2005 letter from your office via mail. We concluded that the 9/2/05 letter was most likely what should have been attached with Ms. Dennison's 9/12/05 email instead of the 7/28/05 letter. Therefore, in our efforts to respond to your office in a quick manner, we had sent a duplicate copy of our initial response to your office which, in fact, had previously been received and enacted upon by your office as evidenced by the 9/2/05 letter. Upon receipt of this duplicate letter, I trust that your office must have assumed that this letter was our response to your 9/2/05 letter thereby precipitating your 9/21/05 letter that we received via email yesterday. Please note that it was not. Upon receipt of the correct correspondence from your office (i.e. the 9/2/05 letter), we complied with your request by revising the PCN form and submitting it to the City of Kinston for signature. As of the date of this email, we have not received the signed PCN form back from the City. It is important to note that this office is fully aware of the information that your office is requesting and that we are making all efforts to comply with your request in a timely manner. It is also important for our client to note that we are responsive to your requests and that your 9/21/05 letter was sent as a result of the confusion initiated by your office's 9/12/05 email instead of a lack of response by The Wooten Company. Please note that both crossings identified in this project are perpendicular to the stream disturbing less than 40 linear feet of riparian buffer with a maintenance corridor equal to 10 feet in width. Pursuant to the Neuse River Riparian Area Projection and Maintenance Rule (15A NCAC 2B .0233) for non-electric utility line perpendicular crossings for streams, each stream crossing we have identified is exempt from the rule and written concurrence by DWQ is not required. I apologize for the lengthy email, but I hope you can see where the confusion entered in to this situation. We will submit the requested information upon receipt from the City and hope that this will be adequate to resolve this situation. King St. Kinston, NC 28502 Subject Property: Phase I Sanitary Sewer Improvements to Serve the Smithfield Packing Co. REQUEST FOR MORE INFORMATION Dear Mr. Clark: On August 4, 2005, the Division of Water Quality (DWQ) received your additional information by fax dated August 4, 2005 to impact 10 feet of stream and 6000 square feet (ft2) of protected riparian buffers to construct the proposed sanitary sewer improvements. The "Request for more Information" letter dated July 28, 2005 was essentially for you to provide better maps for our review to confirm this activity would not require written concurrence from the DWQ for the use of WQC 3374. However, the new information that was provided indicated that the stream and buffer impacts are significantly different than those applied for in the original application dated June 16, 2005. This application will be submitted to numerous regulatory and commenting resource agencies. Therefore, the DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetland, streams and/or buffers on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H.0506 and 2B .0233(8) and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. Please provide five copies of an updated, accurate PCN application along with all corresponding site drawings, maps and site plans. Please Note: If the DWQ determines after the review of the additional information requested that written concurrence is required for the use of WQC 3374 then a fee would be required. Pond Creation If construction of a pond is proposed, associated wetland and stream impacts should be included above in the wetland and stream impact sections. Also, the proposed pond should be described here and illustrated on any maps included with this application. Pond to be created in (check all that apply): ? uplands ? stream ? wetlands Describe the method of construction (e.g., dam/embankment, excavation, installation of draw-down valve or spillway, etc.): Proposed use or purpose of pond (e.g., livestock watering, irrigation, aesthetic, trout pond, local stormwater requirement, etc.): Size of watershed draining to pond:_ Expected pond surface area: VII. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. Crossings will be as near as possible to perpendicular. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. Page 9 of 12 USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://li2o.enr.state.nc.us/ncwetiands/strmi,zide.litm1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. 2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration Program (NCWRP). Please note it is the applicant's responsibility to contact the NCWRP at (919) 733-5208 to determine availability and to request written approval of mitigation prior to submittal of a PCN. For additional information regarding the application process for the NCWRP, check the NCWRP website at http://h2o.enr.state.nc.us/wrp/index.litm. If use of the NCWRP is proposed, please check the appropriate box on page three and provide the following information: Amount of stream mitigation requested (linear feet): N/A Amount of buffer mitigation requested (square feet): N/A Amount of Riparian wetland mitigation requested (acres): N/A Amount of Non-riparian wetland mitigation requested (acres): N/A Amount of Coastal wetland mitigation requested (acres): N/A Page 10 of 12 IX.
