On-Site Determination for Applicability to the Neuse River Riparian Area Protection Rules
(15A NCAC 2B.0233)
Dear Ms. Taylor-Hall:
On July 15, 2005, at your request I conducted an on-site determination to review a stream
channel/roadside ditch located on the subject property for applicability to the Neuse Buffer Rules
(15A NCAC 2B .0233). The channel is labeled as "A" on the attached map initialed by me on
July 20, 2005. Orange County Planning and Inspection Department staff had previously
conducted an on-site determination of the stream. In your letter to the Director dated July 15,
2005, you requested an appeal of their determination as provided within 15A NCAC 02B .0233
(3)(a)•
At your request, I conducted an appeal of their determination as stated above. During my review
I evaluated the stream using the DWQ Stream Classification Form. I evaluated the stream reach
A and calculated the score to be 23 points. The form states that if the score is "greater than or
equal to 19 points the stream is at least intermittent".
The DWQ has determined that the stream labeled as "A" on the attached map and at the
blue pin flag located on the site is at least "intermittent" and is subject to the Neuse Buffer
Rule. This determination shall replace the determination originally performed by the Orange
County Planning and Inspection Department although this field work confirms their origin point.
This stream and it's associated buffers should be identified on any future plans for this property.
The owner (or future owners) should notify the DWQ (and other relevant agencies) of this
decision in any future correspondences concerning this property.
This letter only addresses the applicability to the buffer rules and does not approve any activity
within the buffers. As stated in our site visit, the Division would not have any objection to
impact of Zone 2 (the outer 20 feet of the protected buffer) if needed to construct a home on this
site since the lot is fairly narrow. Nor does this letter approve any activity within Waters of the

This letter serves as confirmation of an on-site stream determination made by Orange
County Erosion Control Division staff on June 15, 2005 for the referenced property. Orange
County is the local delegated authority for enforcing the Neuse Buffer Rule (Neuse River
Basin: Nutrient Sensitive Waters Management Strategy Protection and Maintenance of
Riparian Areas Rule (15A NCAC 26.0233)).
An on-site stream determination was requested by Ms. Hall on behalf of the potential
buyer after a objection to the initial Neuse Buffer stream determination dated
06/09/2004. One unnamed perennial spring to the Eno River shown on the Soil Survey
of Orange. County, N.C. (June, 1977), but not on the USGS 7.5-minute quadrangle map,
was evaluated to determine the water features' subjectivity to the Neuse Buffer Rule.
The on-site field evaluation supported the initial stream determination that (Feature A on
the attached aerial map) is present and therefore subject to the Neuse Buffer Rules
,from the flagged point down stream.
Please note that this letter only addresses the applicability of the Neuse Buffer Rules. If
you have any questions or would like a copy of the Neuse Buffer Rules, please feel free
