Director Division of Water Quality DWQ Project # 05-1241 Perquimans County Approval of 401 Water Quality Certification (GC3400) with Additional Conditions Ladies and Gentlemen: You have our approval, in accordance with the attached conditions, to place fill material within or otherwise impact 0.037 acres of waters to construct a concrete boat ramp and protective rip rap, concrete boat ramp access, wooden courtesy dock/pier, boat lift/small vessel conveyor system, and rip rap shoreline stabilization on higher ground as described in your application received by the Division of Water Quality (DWQ) 401 Oversight/Express Review Permitting Unit on July 5, 2005. After reviewing your application, we have determined that the Division of Water Quality (DWQ) General Water Quality Certification Number 3400 covers these water impacts. This Certification allows you to General Permit No. 198000291 when issued by the US Army Corps of Engineers (USACE). In addition, you should get or otherwise comply with any other federal, state and local requirements before you go ahead with your project including (but not limited to) erosion and sediment control regulations and CAMA. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 or CAMA Permit. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h). (0.31 acres) (E) Primary Nursery Area - No (F) Water Classification - SC Open - No FIELD INVESTIGATION REPORT: Carolina Coast and Lakes, The Shores at Lands End Page 2 8 PROJECT SUMMARY: As a major permit modification to Major Permit #144-98, the applicant proposes to construct a 10' x 50' boat ramp with riprap stabilization and concrete approach, 100 additional feet of riprap stabilization around 404 wetland outflow, community "T" shape pier 118 feet waterward normal water level (NWL), a 176' x 12' small craft conveyer boat lift system with adjacent 170' x 5' wooden walkway at the common area on this property. The only current development within the common area tract is a vinyl bulkheaded man-made canal and lake with small pier and boat ramp, gravel driveway, and community building that is under construction, all being outside the 75-foot estuarine shoreline AEC. Other man-made features on the property, but outside the common area, are riprap shoreline, home, series of manmade canals and ponds with large culverts, dog shed, barn, and gravel roads. PROJECT SETTING The location of the proposed development site is within a 616.1-acre tract of farmland that is being converted to a 251-lot residential subdivision with a common access area, located near the end of New Hope Road (SR1300) in Drummonds Point of Perquimans County. The development site is located on the western shoreline of Little River near its mouth at Albemarle Sound. The width of Little River at this point is 1.372 miles (7,244 feet). The developer has dedicated a 13.03-acre lot for a community water access area between lots 89 and 122. The property has an elevation of approximately 12 ft. above NWL that gradually slopes down to the water and is vegetated with indigenous weeds and grasses. A portion of the approximate 70-acre lake and canal system with a 20' x 6' pier and 10' x 10' boat ramp, gravel access with cul-de-sac, and community building, which is under construction, is located outside the 75-foot estuarine shoreline AEC within the common area. A 404 wetland fringe borders the southeastern and northwestern property lines of the common area. The northwestern shorelines of the property consist of low banks (0-5 feet) with an average 2.5-feet wide strandplain sandy beach, while the southwestern shorelines of the property consist of higher banks (5-10 feet) that are protected with riprap. A total of 18.1 acres of cypress fringe 404 wetlands are intermittently scattered on the property, the majority being adjacent to the common area. The common area property has an irregular shoreline that is approximately 230 linear feet. The adjacent property to the north is farmland with an extensive cypress swamp along the shoreline, and the adjacent property to the west is residential along Soundside Drive adjacent to Albemarle Sound surrounded by farmland inland to the north. There was no observed presence of submerged aquatic vegetation or shellfish in the vicinity of the ramp/dock site on June 16, 2005. Reviews of available information suggest that there are historic grave stones around Stevenson Point; however, there are no grave stones near the common area, and no other known archeological sites or geologic formations associated with the applicant's property. The waters of Little River in this area are classified as SC by the Division of Environmental Management and are closed to shellfish harvesting. The water depths at the site range from 1 foot near shore, 2 feet around middle of pier, 2.3 feet at end of pier, and 3 feet at a distance of 405 feet waterward of NWL, and the bottom is fine sand and silt. FIELD INVESTIGATION REPORT: Carolina Coast and Lakes, The Shores at Lands End Page 3 DEVELOPMENT PROPOSAL In order to provide water access for the interior lots of the subdivision, the applicant proposes to construct a community boating access area that consists of a 6-foot wide by 110-foot long pier with an 8-foot wide by 12-foot long "T" platform, a 10-foot wide by 50-foot long concrete boat ramp with riprap, stabilization, a 540-foot long concrete approach to the boat ramp, 100-foot riprap upland and on both sides of 404 wetland overflow, 176-foot long and 12-foot wide small vessel conveyor system with 4 pilons of the system being in the water spaced 30 feet long by 12 feet wide with a 172-foot long and 6-foot wide tapered to 3.5-foot wide wooden elevated walkway to NWL adjacent to conveyor system. There is no request for restrooms, gasoline, sewage pumpout, dredging, or 404 wetland disturbance with this development proposal. The applicant indicates that approximately 6.1 cubic yards of riprap stabilization, 12 cubic yards of dirt fill material for the ramp foundation, and 2.68 cubic yards precast concrete will be required below the normal water level, and 7.2 cubic yards of dirt fill material will be required for the ramp foundation in the upland area. The "T" pier structure will not have mooring slips and is setback 84 feet from the nearest property line to the southeast. ANTICIPATED IMPACTS The proposed pier will project approximately 118 feet out into Little River, and will shade approximately 756 square feet of Public Trust Area (PTA) and Estuarine Waters (EW) Areas of Environmental Concern (AEC). The elevated wooden walkway adjoining the pier and adjacent to the vessel conveyor system will shade 440 square feet of uplands within the Estuarine Shoreline (ES) AEC and 368 square feet of high ground outside the ES AEC. The proposed boat`ramp, associated dirt fill and shoreline riprap stabilization required for construction will result in approximately 800 square feet of PTA, EW AEC being filled, and approximately 890 square feet of uplands within the ES AEC being filled by the boat ramp, dirt fill, riprap, and a portion of the concrete access. Approximately 11,558 square feet of high ground will be filled by the remaining concrete boat ramp access and turn around area. This constitutes 5.72 % of impervious surface coverage within the estuarine shoreline AEC. The proposed 100 linear feet of riprap along the overflow slopes of the 404 wetland area will fill approximately 440 square feet of uplands within the ES AEC and will not be placed in the PTA, EW AEC. The proposed small vessel conveyor system will project approximately 30 feet out into Little River, and the steel beams will shade approximately 60 square feet of PTA, EW AEC, 230 square feet of uplands within the ES AEC, 74 square feet of high ground outside the AEC, and 60 square feet of high ground outside the AEC and over the manmade canal. FIELD INVESTIGATION REPORT: Carolina Coast and Lakes, The Shores at Lands End Page 4 It is anticipated that approximately 21,000 square feet of ES AEC will be graded and seeded in the common area. Boating activity will increase in this area resulting in a possible increase in water turbidity, and may result in toxicants from hull paint and maintenance products to accumulate in the sediment near the boat slips. This will be the first pier along this shoreline. There are no expected navigational impacts due to the pier structure. Temporary water turbidity will occur during construction. The developer will have no legal rights or control over the majority of these lots by the time this permit might be issued by the Division of Coastal Management. PROPERTY: This 016.1 acre property nd is subject to high wind and wave energy due to the large fetch from both the Little River and Albemarle Sound. The nearshore environment is characterized by a broad non-vegetated shallow water shelf extending an average of 400 feet out into the Albemarle Sound and Little River. The shallow water in and of itself limits the type of craft that will be able to access the property. PROJECT HISTORY : The shoreline stabilization by rip rap (reference existing CAMA Major #144-98) was completed in April 2005. This stabilization curtailed the shoreline erosion occurring at a rate of approximately 4.7 feet per year on the (Albemarle Sound shoreline) and 1-2 foot per year on the Little River shoreline (Source-USDA Shoreline Erosion Inventory). Approximately 17 acres of shoreline was lost on the Albemarle Sound shoreline in the 31 year period between 1944 and 1975 alone (144 feet landward movement on 5,328 LF shoreline). During this 31 year period ALONE, approximately 150,000 CY of sediment has been introduced into the estuarine waters of the Albemarle Sound along this portion of the shoreline. The completed rip rap stabilization by Carolina Coast & Lakes of the shoreline will serve to stem the rapid erosion, thereby protecting estuarine waters from sedimentation, turbidity and fill. The applicant is also in continual process of seeding and stabilizing the disturbed areas and upland portions of the agricultural lands within the 75 ft AEC (under CAMA Major 144-98) to stabilize the shoreline and end the turbidity, siltation and sedimentation of the surface waters adjacent to the shoreline. The conversion of the agricultural lands into vegetated residential lawns will limit land disturbance within the 75 ft AEC to pennitable uses and allow the future land disturbance activities to be controlled under the Division of Coastal Management Program. This will abate future wind and water erosion of topsoil occurring from previous biannual plowing and tilling of fields within the AEC, adjacent uplands. Extensive portions of the property were formerly sloughing off into the estuarine waters, causing frequent extensive turbidity events leading to siltation and sedimentation of the estuarine waters and causing extensive turbidity plumes within the Little River and Albemarle Sound prior to its stabilization by rip rap. J• ?^r LAKE A 70+/- acre private lake has been excavated entirely in uplands. This private lake will serve to provide a recreational area for the lots of the subdivision adjoining the canal. This lake will be stocked with bluegills and Largemouth Bass once water clarity settles out from the original excavation. This lake will be self-contained and not connected to surface waters. This lake was designed and has been modeled studied using HEC RAS stormwater computer programs. This was required by Dwayne Hinson of the Pasquotank/Perquimans/ Camden County Soil and Water Conservation Office prior to its construction. The lake has been designed from it conception to contain and filter all stormwater runoff from this subdivision as could be feasibly drained into this lake. In addition to containing the runoff from the subject property, offsite runoff that is currently draining through the existing ditch system traversing this property will be stored and treated in the lake system WETLANDS: NO 404 WETLAND IMPACTS PROPOSED. The site was investigated for the presence of 404 wetlands were delineated by Kendall Turnage (during October 5-16, 2003) and the wetland alignment was confirmed and documented by the US Army Corps of Engineers on December 11, 2003. No Coastal Wetlands were claimed on the site by the Division of Coastal Management in November of 2003. DREDGING: No excavation or dredging in estuarine waters will be required by the project as proposed. The developer does not propose or desire to dredge any areas of the Little River or Albemarle Sound as maintenance will be a long term, costly and futile prospect. It is fully disclosed to potential property owners that the nearshore environment is very shallow. LAND DISTURBANCE The remaining uplands will be either covered by lawns homes or roadways, almost the entire upland portions of the site have been under agriculture for at least a minimum of the last one hundred years. By stabilizing the shoreline, the applicant has ceased the previously unchecked erosion along the immediate shoreline. The NC Division of Land 'Resourccs has an approved Sedimentation and Erosion Control Plan for this site. PROJECT SUMMARY: As a major permit modification to Major Permit #144-98, the applicant proposes to construct a 10' x 50' boat ramp with riprap stabilization and concrete approach, 100 additional feet of riprap stabilization around 404 wetland outflow, community "T" shape pier 118 feet waterward normal water level (NWL), a 176' x 12' small craft conveyer boat lift system with adjacent 170' x 5' wooden walkway at the common area on this property. The only current development within the common area tract is a vinyl bulkheaded man-made canal and lake with small pier and boat ramp, gravel driveway, and community building that is under construction, all being outside the 75-foot estuarine shoreline AEC. Other man-made features on the property, but outside the common area, are riprap shoreline, home, series of manmade canals and ponds with large culverts, dog shed, barn, and gravel roads. PROJECT SETTING The location of the proposed development site is within a 616.1-acre tract of farmland that is being converted to a 251-lot residential subdivision with a common access area, located near the end of New Hope Road (SR1300) in Drummonds Point of Perquimans County. The development site is located on the western shoreline of Little River near its mouth at Albemarle Sound. The width of Little River at this point is 1.372 miles (7,244 feet). The developer has dedicated a 13.03-acre lot for a community water access area between lots 89 and 122. The property has an elevation of approximately 12 ft. above NWL that gradually slopes down to the water and is vegetated with indigenous weeds and grasses. A portion of the approximate 70-acre lake and canal system with a 20' x 6' pier and 10' x 10' boat ramp, gravel access with cul-de-sac, and community building, which is under construction, is located outside the 75-foot estuarine shoreline AEC within the common area. A 404 wetland fringe borders the southeastern and northwestern property lines of the common area. The northwestern shorelines of the property consist of low banks (0-5 feet) with an average 2.5-feet wide strandplain sandy beach, while the southwestern shorelines of the property consist of higher banks (5-10 feet) that are protected with riprap. A total of 18.1 acres of cypress fringe 404 wetlands are intermittently scattered on the property, the majority being adjacent to the common area. The common area property has an irregular shoreline that is approximately 230 linear feet. The adjacent property to the north is farmland with an extensive cypress swamp along the shoreline, and the adjacent property to the west is residential along Soundside Drive adjacent to Albemarle Sound surrounded by farmland inland to the north. There was no observed presence of submerged aquatic vegetation or shellfish in the vicinity of the ramp/dock site on June 16, 2005. Reviews of available information suggest that there are historic grave stones around Stevenson Point; however, there are no grave stones near the common area, and no other known archeological sites or geologic formations associated with the applicant's property. The waters of Little River in this area are classified as SC by the Division of Environmental Management and are closed to shellfish harvesting. The water depths at the site range from 1 foot near shore, 2 feet around middle of pier, 2.3 feet at end of pier, and 3 feet at a distance of 405 feet waterward of NWL, and the bottom is fine sand and silt. FIELD INVESTIGATION REPORT: Carolina Coast and Lakes, The Shores at Lands End Page 3 DEVELOPMENT PROPOSAL In order to provide water access for the interior lots of the subdivision, the applicant proposes to construct a community boating access area that consists of a 6-foot wide by 110-foot long pier with an 8-foot wide by 12-foot long "T" platform, a 10-foot wide by 50-foot long concrete boat ramp with riprap stabilization, a 540-foot long concrete approach to the boat ramp, 100-foot riprap upland and on both sides of 404 wetland overflow, 176-foot long and 12-foot wide small vessel conveyor system with 4 pilons of the system being in the water spaced 30 feet long by 12 feet wide with a 172-foot long and 6-foot wide tapered to 3.5-foot wide wooden elevated walkway to NWL adjacent to conveyor system. There is no request for restrooms, gasoline, sewage pumpout, dredging, or 404 wetland disturbance with this development proposal. The applicant indicates that approximately 6.1 cubic yards of riprap stabilization, 12 cubic yards of dirt fill material for the ramp foundation, and 2.68 cubic yards precast concrete will be required below the normal water level, and 7.2 cubic yards of dirt fill material will be required for the ramp foundation in the upland area. The "T" pier structure will not have mooring slips and is setback 84 feet from the nearest property line to the southeast. ANTICIPATED IMPACTS The proposed pier will project approximately 118 feet out into Little River, and will shade approximately 756 square feet of Public Trust Area (PTA) and Estuarine Waters (EW) Areas of Environmental Concern (AEC). The elevated wooden walkway adjoining the pier and adjacent to the vessel conveyor system will shade 440 square feet of uplands within the Estuarine Shoreline (ES) AEC and 368 square feet of high ground outside the ES AEC. The proposed boat`ramp, associated dirt fill and shoreline riprap stabilization required for construction will result in approximately 800 square feet of PTA, EW AEC being filled, and approximately 890 square feet of uplands within the ES AEC being filled by the boat ramp, dirt fill, riprap, and a portion of the concrete access. Approximately 11,558 square feet of high ground will be filled by the remaining concrete boat ramp access and turn around area. This constitutes 5.72 % of impervious surface coverage within the estuarine shoreline AEC. The proposed 100 linear feet of riprap along the overflow slopes of the 404 wetland area will fill approximately 440 square feet of uplands within the ES AEC and will not be placed in the PTA, EW AEC. The proposed small vessel conveyor system will project approximately 30 feet out into Little River, and the steel beams will shade approximately 60 square feet of PTA, EW AEC, 230 square feet of uplands within the ES AEC, 74 square feet of high ground outside the AEC, and 60 square feet of high ground outside the AEC and over the manmade canal. Boating activity will increase in this area resulting in a possible increase in water turbidity, and may result in toxicants from hull paint and maintenance products to accumulate in the sediment near the boat slips. This will be the first pier along this shoreline. There are no expected navigational impacts due to the pier structure. Temporary water turbidity will occur during construction. PROJECT AREA: only the 13.03 Acre C031,410NAREA Located on the Little River Shoreline between lots 89 and 122 only Almost all other waterfront lots and areas within the CAMA AEC have been sold or are under contract prior to this application. The developer will have no legal rights or control over the majority of these lots by the time this permit might be issued by the Division of Coastal Management. PROPERTY: is 616.1 acre property r sPoint peninsula?and ?ssah}ect'°high -" wind and wave energy due to the large fetch from both the Little River and Albemarle Sound. The nearshore environment is characterized by a broad non-vegetated shallow water shelf extending an average of 400 feet out into the Albemarle Sound and Little River. The shallow water in and of itself limits the type of craft that will be able to access the property. PROJECT HISTORY : The shoreline stabilization by rip rap ( reference existing CAMA Major #144-98) was completed in April 2005. This stabilization curtailed the shoreline erosion occurring at a rate of approximately 4.7 feet per year on the (Albemarle Sound shoreline) and 1-2 foot per year on the Little River shoreline (Source-USDA Shoreline Erosion Inventory). Approximately 17 acres of shoreline was lost on the Albemarle Sound shoreline in the 31 year period between 1944 and 1975 alone (144 feet landward movement on 5,328 LF shoreline). During this 31 year period ALONE, approximately 150,000 CY of sediment has been introduced into the estuarine waters of the Albemarle Sound along this portion of the shoreline. The completed rip rap stabilization by Carolina Coast & Lakes of the shoreline will serve to stem the rapid erosion, thereby protecting estuarine waters from sedimentation, turbidity and fill. The applicant is also in continual process of seeding and stabilizing the disturbed areas and upland portions of the agricultural lands within the 75 ft AEC (under CAMA Major 144-98) to stabilize the shoreline and end the turbidity, siltation and sedimentation of the surface waters adjacent to the shoreline. The conversion of the agricultural lands into vegetated residential lawns will limit land disturbance within the 75 ft AEC to permitable uses and allow the future land disturbance activities to be controlled under the Division of Coastal Management Program. This will abate future wind and water erosion of topsoil occurring from previous biannual plowing and tilling of fields within the AEC, adjacent uplands. Extensive portions of the property were formerly sloughing off into the estuarine waters, causing frequent extensive turbidity events leading to siltation and sedimentation of the estuarine waters and causing extensive turbidity plumes within the Little River and Albemarle Sound prior to its stabilization by rip rap. 'r j Cl "J Y LAKE A 70+/- acre private lake has been excavated entirely in uplands. This private lake will serve to provide a recreational area for the lots of the subdivision adjoining the canal. This lake will be stocked with bluegills and Largemouth Bass once water clarity settles out from the original excavation. This lake will be self-contained and not connected to surface waters. This lake was designed and has been modeled studied using HEC RAS stormwater computer programs. This was required by Dwayne Hinson of the Pasquotank/Perquimans/ Camden County Soil and Water Conservation Office prior to its construction. The lake has been designed from it conception to contain and filter all stormwater runoff from this subdivision as could be feasibly drained into this lake. In addition to containing the runoff from the subject property, offsite runoff that is currently draining through the existing ditch system traversing this property will be stored and treated in the lake system. WETLANDS: NO 404 WETLAND IMPACTS PROPOSED. The site was investigated for the presence of 404 wetlands were delineated by Kendall Turnage (during October 5-16, 2003) and the wetland alignment was confirmed and documented by the US Army Corps of Engineers on December 11, 2003. No Coastal Wetlands were claimed on the site by the Division of Coastal Management in November of 2003. DREDGING: No excavation or dredging in estuarine waters will be required by the project as proposed. The developer does not propose or desire to dredge any areas of the Little River or Albemarle Sound as maintenance will be a long term, costly and futile prospect. It is fully disclosed to potential property owners that the nearshore environment is very shallow.
