Dear Mr. Brown:
The Division of Water Quality (DWQ) 401 Oversight and Express Review Permitting Unit has
reviewed the above-referenced application and Restoration Plan. We have several
questions/comments regarding this project. Our comments are as follows:
• On Page 5 of 11 of the PCN (Section C 1 a), you indicated that impacts to streams and
open waters are included in the application. However, the open water impacts were
entered in Section 2a as wetland impacts. These impacts should have been entered into
Section 4a (open water impacts - Page 6 of 11). Please provide a corrected Page 6 of the
PCN which list the open water impacts.
In the Restoration Plan Wetland 1 a is described as a 0.48-acre pond. The pond is
described as consisting of open water,with a fringe of wetland vegetation. Table lb states
that Wetland 1 a is to be enhanced through invasive species removal and supplemental
wetland plantings. The acreage is listed as 0.48 acres. This acreage is also included in
the Wetland Enhancement total listed:in Table 2 (Project Component summaries).
No wetland mitigation credit can be claimed for open water. This pond is predominantly
open water, as shown in the aerial photograph of the project site (Figure 2). Pleas revise
the wetland enhancement totals in the plan to exclude the open water portion of the pond
identified as Wetland I a.
