Pitt County
Thank you for your letter dated August 24, 2005 (received August 26, 2005) that
requested a clarification of our letter of July l8, 2005. Our July letter addressed a stream origin
determination made by this office on June 20 and July 18, 2005. As stated in our July 18, 2005
letter, the feature subject to the Tar-Pamlico River Riparian Area Protection Rules in 15A NCAC
2B .0259 begins at the confluence of a ditch that enters the main stream feature from the east.
The location shown in your August 24, 2005 letter is not accurate. Please modify your map to
relocate the stream origin location northward about 200 feet to the location of the intersection of
the side ditch and this main channel.
As discussed in the field, I am enclosing copies of the field evaluations that I conducted

On-Site Determination for Applicability to the Tar-Pamlico River Riparian Area
Protection Rules (15A NCAC 2B .0259)
Dear Mr. White: '
On June 20,2005 and July 18,2005, at your request John Dorney and I conducted an on-site
determination to review one feature located on the subject property for applicability to the Tar-
Pamlico Buffer Rules (15A NCAC 2B .0259). The feature is labeled as "A" on the attached map
initialed by me on June 27,2005. Division of Water Quality (DWQ) Staff from the Washington
Regional Office (Kyle Barnes) had previously conducted an on-site determination of the stream.
In your letter to the Director dated May 11, 2005, you requested an appeal of their determination
as provided within 15A NCAC 02B .0259(3)(a).
At your request, John Dorney and I conducted an appeal of their determination as stated above.
During my review we evaluated the stream using the DWQ Stream Classification Form. We
evaluated the reach of the stream approximately 500 feet above and below the original
determination made by Kyle Barnes on August 20, 2004, the stream reach above the point of the
original determination and calculated the score to be 10.25 points and we evaluated the stream
reach below the original determination and calculated the score to be 24.50. The form states that
ifthe score is "greater than or equal to 19 points the stream is at least intermittent". The USGS
topographic map does not show a stream feature. However topographic lines are present which
indicate a natural valley in which a natural stream could be present. The Pitt County Soil Survey
shows the presence of a linear soil series, which are indicative of alluvial deposits. The Pitt
County Soil Survey also shows a stream feature. With this information and the condition of the
stream feature we made, the determination was made that this feature was a modified natural
stream.
Through further evaluation on site, it was determined that the stream feature followed the natural
i drainage way within the landscape of the area. In addition, DWQ's experience is that the linear

Rains soil units typically contains a stream feature in the lower portion ofthe series and Bibb soil
units typically contain stream features throughout the series.
The DWQ has determined that the stream labeled as "A" on the attached map is at least
"intermittent" and is subject to the Tar-Pamilco Buffer Rule. The origin of the stream A is
located at the confluence of a ditch that flows into this stream feature from the east. This
determination shall replace the determination originally performed by the Regional Office. This
stream and its associated buffers should be identified on any future plans for this property. The
owner (or future owners) should notify the DWQ (and other relevant agencies) of this decision in
any future correspondences concerning this property. This on-site determination shall expire
five (5) years from the date of this letter.
Landowners or affected parties that dispute this determination made by the DWQ or Delegated
Local Authority that a surface water exists and that it is subject to the buffer rule may request a
hearing from the Office of Administrative Hearings. To ask for a hearing, send a written
petition, which conforms to Chapter l50B of the North Carolina General Statutes to the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-67l4. This
determination is final and binding unless you ask for a hyaring within 60 days.

This letter only addresses the applicability to the buffer rules and does not approve any activity
within the buffers. Nor does this letter approve any activity.within Waters of the United States
or Waters of the State. If you have any additional questions' or require additional information

3 & 4 ofG.S. 150B.

Merge onto US-264 E toward NC-97/WILSON/GREENVILLE. 58.7 miles
As you come into town the hospital will be on your left. At light past
hospital turn left on Memorial (Hwy13). Now heading north turn right on
Martin Luther King (5th st) and head into downtown. When downtown,
approaching university, turn left on Read St. Head north few blocks and
turn left on 2nd. Drive one block.

2nd St and Cotanche

Dear Ms, Evans,
The current owner of the subject site desires to appeal the determination of jurisdiction
upon the aquatic feature referenced in correspondence attached as: Project # KB-04-004.
Upon field review of this feature Rivers & Associates, Inc. (R&A) concurs with the
owners observations. Furthermore, application of North Carolina Division of Water
Quality, Identification Methods for the Origins of Intermittent and Perennial Streams,
Version 3.1 supports our position that the feature may have been erroneously identified as
a jurisdictional aquatic feature.
I have attached correspondence from the NCDENR, DWQ, Washington Regional office
documenting this determination and copies of a topographic map and soil survey
depicting the subject area.
Please contact our Greenville office at your convenience to discuss a meeting date so that
we may discuss this issue further.
