Dear Mr. Lowrance:
On August 4, 2009, the DWQ received your application dated August 3, 2009,to fill or otherwise impact
49 linear feet of perennial stream, 221 linear feet of intermittent stream, and 5,978 square feet of Zone 1
Neuse River basin protected riparian buffer, and 5,958 square feet of Zone 2 Neuse River basin protected
riparian buffer, to construct a residential development at the site. The DWQ has determined that your
application was incomplete and/or provided inaccurate information as discussed below. The DWQ will
require additional information in order to process your application to impact protected wetlands and/or
streams on the subject property. Therefore, unless we receive five copies of the additional information
requested below, we will place this project on hold as incomplete until we receive this additional
information. If we do not receive the requested information, your project will be formally returned as
incomplete. Please provide the following information so that we may continue to review your project.
Additional Information Requested:
1. 49 linear feet of compensatory stream mitigation is required for this project. Please provide a
compensatory mitigation plan. The plan must conform to the requirements of 15A NCAC 2H
.0500 and must be appropriate to the type of impacts proposed.
2. Please locate your project boundaries on the most recent bound and published Wake county soil
survey.
3. Please NOTE, if this 401 Water Quality Certification is issued you will need to provide
documentation of the local government's approval of the stormwater management plan(SMP)for
this project by providing EITHER:
• A valid approval letter and one copy of the approved SMP (including plans and calculations),
OR
• One set of stormwater plan details and calculations stamped as "Approved" by the local
government.

4. Please explain the need for a 20-foot wide pedestrian access in the buffer(Sheet 5)as twenty feet
seems excessive.
5. Buffer impacts for Zone 2 are shown for the pedestrian bridge. No impacts to Zone 1 are listed.
The bridge footprint is clearly shown in Zone 1. Please explain why no Zone 1 buffer impacts are
listed for this pedestrian bridge.
6. Impact Y is listed as 221 linear feet of imtermittent stream. Please explain why no buffer impacts
are associated with this stream impact.
7. Please justify the length of stream impact Q, as the impact is shown extending a significant
distance downstream of the road crossing.
Please submit this information within 30 calendar days of the date of this letter. If we do not receive this
requested information within 30 calendar days of the date of this letter,your project will be withdrawn and
you will need to reapply with a new application and a new fee.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters or
protected buffers. Please be aware that any impacts requested within your application are not authorized (at
