SUBJECT: Notice of Violation
NCGS 143-215.1
Operation of a Disposal
System Without a Permit
On May 2, 1997 our office conducted an inspection of your. farm
with your representative. This inspection revealed that a
subsurface method of waste disposal is performed on this facility.
The current nitrification system is not an approved waste disposal
method per Natural Resources Conservation Services (MRCS) technical
guidelines for animal waste management. The Division of Water
Quality does not consider this subsurface system as DEEMED
PERMITTED under 15A NCAC 2H Part .0217. Continued use of this
system would require an individual nondischarge permit through this
Division. Mr. John Hasty was informed by your representative that
a new spray field is currently being cleared for a surface solid
set irrigation system. It is recommended that you contact your
technical specialist and consulting engineer for development of a
waste management plan and irrigation design for certification.
Operation of the current animal waste management system is
unacceptable and constitutes a violation of NC General Statutes
143-215.1(a) 2 which states the following:
11143-215.1. Control of sources of water pollution;
permits required. --(a) No person shall do any of the
following things or carry out any of the following
activities until or unless such person shall have applied
for and shall have received from the Environmental
Management Commission a permit therefore and shall have
complied with such conditions, if any, as are prescribed
by such permit:

(1) Make any outlets to the waters of the state;
(2) Construct or operate any sewer system, treatment
works, or disposal system within the State
Provisions are made in this statute for assessment of civil
penalties of up to $10,000 per day for so long as the violation
continues.
Provisions must immediately be made to correct the current
permit inadequacies at the Carlisle Hog Farm. Please notify this
office by June 20, 1997 in writing as to your "Plan of Action" to
comply with the NC General Statutes.
Please be advised that this letter in no way absolves the
Carlisle Hog Farm of damages to private property owners or the
waters of the State which could occur as result of the unpermitted
disposal system and stormwater discharge.
The timeliness in which you implement this plan will be
considered, should an enforcement action be deemed necessary.
