It was observed that waste samples had not been collected within the required timeframes and the irrigation records were not adequate. In addition, the bermuda crop was not established in the waste application field as required by the conditional certification. In regard to the deficiencies noted during the inspection, the following actions are requested: I . Collect waste samples within 60 days of waste application or every 120 days (quarterly) to insure compliance and prevent over- application of nitrogen. 2. Box 1076 Rose Hill, NC 28458 February 14, 2000 Mr. Robert Heath NCDENR 225 Green Street, Suite 714 Fayetteville, NC 28301-5043 Dear Mr. Heath, I have taken the following action in response to your letter of January 14, 2000. 1: Water and soil samples - have been sent in to N.C.D.A. 2: Preplant requirements for sprigging Bermuda - a. soil samples b. apply lime and whatever else is necessary c. spray herbicides for crabgrass and other weeds d. till and landplane soil e. spraying on tilled soil for Bermuda cannot begin until March 1 1. spraying allowed for 30 days before planting 2. application of total PAN is allowed but not recommended 3. nutrients should be reserved for sprigs I have spoken to Greg Horrell ( Charles Murphy's son-in-law ) about sprigging date. They prefer to sprig between 3115 and 4115. They will sprig on 311 if 1 wish to. He thinks they can cut and bale hay also. I hope to have field prepared by 311 and sprigged by 3120 ( weather permitting ) 3: Recordkeeping - recording of all future spraying will be listed by individual hydrant instead of by field. On December 15, 1999, staff from the Fayetteville Regional Office of the Division of Water Quality conducted an annual inspection of your swine farm located off SRI 121 in Sampson County. During that routine inspection, it was noted that the Bermuda grass crop was to have been established on or before December 31, 1998. You were instructed to prepare all fields and have the required crop established early in the spring of 2000. The Division of Soil and Water conducted a compliance review of the farm on April 27, 2000 and noted that the Bermuda grass had not been sprigged. A referral was submitted to this Division on May 2, 2000, and a follow-up inspection was conducted on May 8, 2000. The liquid level of the lagoon No. 1 (LAG #1) was reported as 25 inches. General Permit condition V.3 states that "The maximum waste level in lagoons/storage ponds shall not exceed that specified in the CAWMP. At a minimum, maximum waste level for lagoons/storage ponds must not exceed the level that provides adequate storage to contain the 25 -year, 24-hour storm event plus as additional 1 foot of structural freeboard." Corrective Action for Violation I: Please take waste samples at a frequency so as to cover all waste application events within 60 days before and after sample date. Please be advised that this notice does not prevent the Division of Water Quality from taking enforcement actions for this violation or any past or future violation. Furthermore, the Division of Water Quality has the authority to levy a civil penalty of not more than $25,000.00 per day per violation. Facility Number 82-700 Sampson County Dear Mr. Blossom, On May 31, 2006, an operation review was conducted of Blossom, Inc., facility number 82- 700, in Sampson County. This review, undertaken in accordance with G.S. 143-215.10D, is one of two routine site visits scheduled for all subject animal operations in 2006. Staff from the Division of Water Quality will conduct a separate compliance inspection. During the operation review, the following item was noted: • According to the irrigation records, swine waste had been applied to the bermuda spray fields at the following rates and times: Field 2 = 20.7 lbs. of nitrogen per acre applied between 11!8105 and 11/12/05 Field 3 = 37.8 lbs. of nitrogen per acre applied between 10/20/05 and 1118105 The receiving crop of small grain was never planted on these fields. Since the small grain crop was never planted and these waste applications were outside of the application window for the bermuda a notice of referral to the Division of Water Quality is required. It was for this reason that your operation was referred to the Division of Water Quality for further investigation and possible enforcement action.
