The information you provided us indicated that your operation's animal population does not exceed the number set forth by 15A NCAC 2H .0217, and therefore does not require registration for a certified animal waste management plan. Under 15A NCAC 2H .0217, your facility is deemed permitted if waste is properly managed and does not reach the surface waters of the state. Any system determined to have an adverse impact on water quality may be required to obtain a waste management plan or an individual permit. You are reminded that a discharge of wastes to the surface waters of the state will subject you to a civil penalty up to S 10,000 per day. Should you decide to increase the number of animals housed at your facility beyond the threshold limits listed below, you will be required to obtain and implement a certified animal waste management plan and notify the Division of Water Quality prior to stocking animals to that level. Dear Mr. Matthis: On September 12, 1995, staff from the Fayetteville Regional Office of the Division of Environmental Management inspected your animal operation and the lagoon serving this operation. It was observed that waste was leaking from the flushing system on one of your hog houses. A sample taken of the leaking substance confirmed that this was, in fact waste. This leak was noted in a previous inspection on January 11, 1995, and has not been fully repaired. It is strongly recommended that you take the proper corrective action to repair the leaking problem behind the hog house to preclude possible contamination of ground water. Steps should also be taken to ensure that future discharges from piping around the lagoon Is prevented. - Finally, general maintenance of area around the lagoon (grass cutting, upkeep of houses) needs to be greatly improved. To remain a deemed permitted facility, all corrective actions must be made within 3030 days. Failure to do so may result in the facility losing its deemed permitted status, requiring a certified waste management plan and certification form for the facility to be submitted prior to the December 31, 1997 deadline, and being required to obtain an individual non -discharge permit for the facility. Please be aware it is a violation of North Carolina General Statues to discharge wastewater to the surface waters of the State without a permit. The Division of Environmental Management has the authority to levy a civil penalty of not more than $10,000 per day per violation. Please find enclosed a copy of our Compliance Inspection Report for your information. It is the opinion of this office that this facility is in compliance with 15A NCAC 2H, Part .0217, and that Animal Waste Management is being properly performed. Your attention is drawn to Item IV of this inspection report. Please be advised that should any discharge of animal waste from your lagoon system occur, this office will recommend enforcement action for violations of 15A NCAC 2H, Part .0217. (Approx. 1.5 ft.) S. Is the general condition of this animal facility, including management and operation, satisfactory? X SECTION IV Section II #4 Matthie Farms does not have a certified plan at present and was advised to complete a formal plan in accordance with SCS requirements. This office will follow-up to verify completion of this pian. #5 At present there are no records maintained in regards to waste management. A copy of a proposed log is attached to this report for future use. section III #5 No discharge was noticed at time of inspection, however, immediate repair of PVC flushing system is required in one instance. #7 Recommend operator maintain sufficient freeboard to prevent runoff in case of access, or unexpected accumulation of waste, rain, etc. 08 Recommend operator properly remove and dispose of dead animals from farm in a timely manner. Additionally it is recommended that vegetation around lagoon be properly maintained (cut) as to prevent oversight of possible leakage. A VII.
