On June 28, 2005, at your request I conducted an on-site d~iermination to review one feature
located on the subject property for applicability to the Neuse Buffer Rules (15A NCAC 2B
.0233). The feature is labeled as "A" on the attached maps initialed by me on July 5,2005.
Division of Water Quality (DWQ) Staff from the Raleigh Regional Office (Mike Horan) had
previously conducted an on-site determination of the stream, In your letter to the Director dated
June 10,2005, you requested an appeal of their determination as provided within 15A NCAC
02B ,0233(3)(a).

At your request, I conducted an appeal of their determination as stated above, During my review
I evaluated the stream using the DWQ Stream Classification Form. I evaluated the stream reach
labeled as "A" and calculated the score to be 23 points. The form states that if the score is
"greater than or equal to 19 points the stream is at least intermittent",

The DWQ has determined that the stream labeled as "A" on the attached maps is at least
"intermittent" and is subject to the Neuse Buffer Rule, The origin of feature "A" was
identified by the Raleigh Regional Office on May 18,2005 and re-confirmed by the 401
Oversight/Express Permitting Unit, the origin identification flagging rem,ains at its original
location. This original location is approximately 50 feet from the western property
boundary at a strong grade control point (tree roots), This stream feature has moderate to
strong geomorphology characteristics with signs of hydrology and biology, This determination
shall replace the determination originally performed by the Regional Office, This stream and its
associated buffers should be identified on any future plans for this property, The owner (or
future owners) should notify the DWQ (and other relevant agencies) of this decision in any
future correspondences concerning this property.

Dear Ms. Karoly:

On behalf of my client, I would like to appeal the NBRB detennination made by Mr.
Mike Horan on an unnamed tributary of east branch of Turkey Creek in Pat's Branch
Subdivision and adjacent to Ebenezer Church Road. On Wednesday, May 18,2005, Mr.
Mike Horan conducted a NRB determination on the property.

1. Mr. Horan detennined that there was no groundwater flow or discharge
present along the stream channel.
2. Mr. Horan detennined that water was absent in the channel.
3. Mr. Horan used a probe to dctennine that hydric soils were present below the
aquatic bed ofthe stream. He did not auger into the soil adjacent to the stream
channel to whether the soils are indicative of a groundwater at or above the
aquatic bed.
4. Upon Mr. Scott Mathies' (my assistant) request, Mr. Horan refused to review
my data and to inspect three monitoring holes that I had previously dug
adjacent to the stream channel to detennine the depth to saturation in
relationship to the aquatic bed. These holes were placed upstream and
downstream of what I believe to be the transition between an ephemeral and
intermittent channel; the data clearly depicts a transition between groundwater
below to above the aquatic bed.

I therefore submit that Mr. Horan did not properly and adequately distinguish between an
ephemeral stream channel and an intermittent stream channel as defined in the rule. I
believe that Mr. Horan lacked an accurate factual basis to determine that the groundwater
was above the aquatic bed of the stream in the upper portion of this first order stream for
some time during a nonnal year. Further, he refuse to consider my data showing that
much of the stream channel was in fact above the groundwater and therefore ephemeral

as defined in the rule. On this basis, I therefore request an appeal of the decision made on
May 18,2005.
