During the 1999 session, the North Carolina General Assembly passed a law directing the North
Carolina Department of Environment of Natural Resources (DENR) to develop an inventory and
ranking of all inactive lagoons and storage ponds in the State. In order to meet this directive, a
representative of DENR has recently evaluated the inactive lagoon(s) and/or storage pond(s) on your
property. Inactive lagoons and storage ponds were defined by the Statute as structures which were
previously used to store animal waste but have not received waste for at least one year.
The information collected on your property is contained in the attached field data sheets. Using
this field data, staff ranked your. inactive waste structures as high, medium or low according to its
potential risk for polluting surface and/or groundwater. Your waste structure(s) was ranked as
follows:

This ranking is based in part on the conditions existing on the day of the site visit. Changes in
these conditions or the collection and evaluation of additional data may modify the ranking of your
waste structure(s) in the future.
Information on your facility along with over 1000 others contained in the inventory has been
provided to the General Assembly. During this year's session, the General Assembly will consider
additional requirements for future management of these structures which may include requiring
proper closure of inactive lagoons and storage ponds according to current or alternative standards.

Regardless of their ranking, owners of all waste lagoons and storage ponds have certain
management responsibilities. These include taking appropriate actions to eliminate current
discharges, prevent future discharges and to insure the stability of their structures. Staff of the
Division of Water Quality will be in contact with owners of all inactive structures that have been
determined to pose a serious environmental risk, based on its ranking and/or additional field data
collected by the Department.
All liquids and waste removed from these structures must be land applied at a rate not to exceed
the agronomic needs of the receiving crops. Any major modifications made to the dike walls or
structure must be done in accordance with current standards and under the direction of a technical
specialist designated for structural design. Your local Soil and Water Conservation District is an
excellent source for information and guidance related to proper waste application practices, structure
operation and maintenance, and other related animal waste management standards and/or
requirements.
Nothing in this letter should be taken as removing from you the responsibility and liability for
any past or future discharges from your lagoon(s) and/or storage pond(s) or for any violations of
surface water or groundwater quality standards.
Thank you for your cooperation and assistance in this process. If you have questions concerning
your inactive structures, please contact the staff of either in the Division of Water Quality or the
Division of Soil and Water Conservation in the Fayetteville Regional Office at (910) 486-1541.

This is to acknowledge receipt of your request that your facility no longer be registered as an animal waste
management system per the terms of 15A NCAC 2H .0217. The information you provided us indicated that your
operation's animal population does not exceed the number set forth by 15A NCAC 2H .0217, and therefore does not
require registration for a certified animal waste management plan.
Under 15A NCAC 2H .0217, your facility is deemed permitted if waste is properly managed and does not
reach the surface waters of the state. Any system determined to have an adverse impact on water quality may be
required to obtain a waste management plan or an individual permit. You are reminded that a discharge of wastes to the
surface waters of the state will subject you to a civil penalty up to $10,000 per day.
Should you decide to increase the number of animals housed at your facility beyond the threshold limits listed
below, you will be required to obtain a certified animal waste management plan prior to stocking animals to that level.

As you requested, during my inspection on June 30, 1997, I am
sending you this letter to address some -questions concerning your
farm. Since your farm is under the threshold of 250 swine, you are
not required to have a certified animal waste management plan.
Additionally, you do not have to be a certified operator of a waste
management system. However, it would be a good course for you to
attend when the time comes for you to pump down your lagoon. In
order to find out about scheduling for the course, you should
contact your local agricultural extension office. I am also
enclosing a copy of the .0200 rules concerning threshold numbers
and permitting for your information.
Please be aware that this does not relinquish you from fines
or enforcement actions if there is a discharge from your facility
which impacts surface waters of the state, or from complaint calls
about your farm.

(a) The following nondischarge facilities are deemed to be permitted pursuant to G.S. 143-215.1(d) and it shall
not be necessary for the Division to issue individual permits far crostruction or operation of the following facilities:
(1) Animal waste management systems for which waste does not reach the surface waters by runoff, drift,
direct application or direct discharge during operation or land application and which meet the following
criteria:
(A) Systems which are designed for, and actually serve, leas than the following number of animals and
all other systems not specifically mentioned in this Rule:

If a third party applicators is used, records must be maintained of the name, address and phone
number of the third party applicator,
(C) Land application sites under separate ownership from the waste generator, receiving animal waste
from feedlots which is applied by either the generator or a third party applicator, when all the
following conditions are met:
(i) the waste is applied at no greater than agronomic rates;
(ii) it vegetative buffer (separation) of at least 25 feet is maintained from perennial waters as
indicated on the most recent published version of U.S.G.S. 1:24,000 (7.5 minute) scale
topographic maps and other waters as determined by the local soil and water conservation
district, if a wet waste application system is used.
(D) Existing animal waste management systems serving equal to or greater than the number of animals
as listed in Part (aXl)(A) of this Rule until December 31, 1997. In addition, a registration form
for the system must be submitted to DEM on forms supplied or approved by DEM pursuant to
Paragraph (c) of this Rule. Systems that are determined to have an adverse impact on water quality
may be required to obtain an approved animal waste management plan or to apply for and receive
an individual nondischarge permit from DEM.
(E) Existing animal waste management systems serving equal to or greater than the number of animal
as listed in Part (a)(1)(A) of this Rule, which have an approved animal waste management plan by
December 31, 1997. Systems that do not have an approved animal waste management plan or are
determined to have an adverse impact on water quality may be required to apply for and receive
an individual-nondischargepermit from DEM.

Senate Bill 1217, An Act to Implement Recommendations of the Blue Ribbon Study
Commission on Agricultural Waste, enacted by the 1996 North Carolina General Assembly,
requires a certified operator for each animal waste management system that serves 250 or more
swine by January 1, 1997. The owner of each animal waste management system must submit a
designation form to the Technical Assistance and Certification Group which designates an
Operator in Charge and is countersigned by the certified operator. The enclosed form must be
submitted by January 1, 1997 for all facilities in operation as of that date. Failure to designate a
certified operator for your animal waste management system is a violation of 15A NCAC 2H
.0224 and may result in the assessment of a civil penalty.
If you have questions concerning operator training or examinations for certification, please
contact your local North Carolina Cooperative Extension Service agent or our office.
Examinations have been offered on an on -going basis in many counties throughout the state for
the past several months and will continue to be offered through December 31, 1996.

Per our meeting January 29, 1996 in your office I would
request that I have until March 1, 1996 to complete all
construction on the waste handling items at my farm. My work has
been delayed due to wet weather and unless the weather prohibits my
work I should have all construction completed by March 1, 1996.
Two days after your inspection (11/30/95) I stopped
discharging onto the ground and started pumping into my lagoon. My
lagoon dike has been raised one foot and now has the capacity
called for in my waste management plan. Mr. David Faircloth with
Soil Conservation Service has inspected the lagoon and has
indicated that the additional lagoon height meets his approval.
I will contact you and Mr. Faircloth as soon as all the work
is completed.

Dear Mr. Hollingsworth,
On 11/30/95 staff from the Fayetteville Regional Office of the
Division of Environmental Management inspected your animal
operation and the lagoon(s) serving this operation. It was
observed that animal waste from your swine operation was being
transferred from the livestock houses to a unlined septic pit via
PVC pipe and a man-made ditch. The waste was then removed from the
septic pit with a sump pump and discharged on the ground adjacent
to your uncompleted lagoon. Such operations threaten the quality
of surrounding surface waters and groundwater, although no animal
waste appeared to have reached any such waters at the time. It was
also observed that additional acreage was needed for waste
application and an active cover crop was not present on existing
land designated for waste application.
In order.to properly correct the deficiencies listed above, it is
recommended that the waste management plan provided by the Hoke
County Natural Resources and Conservation Service be fully
implemented to include the completion of the waste lagoon as
outlined in the plan. This would require that all generated animal
waste be deposited in the completed lagoon and land applied in
accordance with the plan. The discharge of animal waste onto the
surrounding grounds as observed during the inspection does not
appear to be in accordance with the plan. Based on the above,
discharges of waste onto the ground should cease immediately.

To remain a deemed permitted facility, all corrective actions must
be made within 60 days. Failure to do so may result in the
facility losing it's deemed permitted status, requiring a certified
waste management plan and certification form for the facility to be
submitted prior to the December 31, 1997 deadline, and being
required to obtain an individual non -discharge permit for the
facility.
Please be aware it is a violation of North Carolina General
Statutes to discharge wastewater to the surface waters of the State
without a permit. The Division of Environmental Management has the
authority to levy a civil penalty of not more than $10,000.00 per
day per violation.
When the required corrective actions are complete, please notify
this office in writing at the address below. If you have any
