We wish to thank Mr: Matthew Long for notifying DWQ of this incident, As a result of this incident, you are hereby notified that, having been permitted to have a non -discharge permit for the subject animal waste disposal system pursuant to 15A NCAC 2T Section .1300, you have been found to be in violation of your Certified Animal Waste Management Plan and the Swine Waste System General Permit No. AWG 100000 that you are covered to operate under, as follows: Deficiency 1: Failure to maintain waste levels in your lagoon/storage }ponds in accordance with the facility's Certified Animal Waste Management Plan in accordance with Condition V. 2. ol'Swine Waste System General Permit No. AWG 100000. On August 24, 2012 a lagoon/storage pond level was documented at 18.00 inches in lagoon land 2. A level of 19 inches is the maximum level allowed by your permit and Certified Animal Waste Management Plan. The liquid levels of lagoons #1-4 were reported as 18 inches. General Permit condition V 2, states "The maximum waste level in lagoons/storage ponds shall not exceed that specified in the CAWMP. At a minimum, maximum waste level for lagoons/storage ponds must not exceed the level that provides adequate storage to contain the 25-year, 24-hour storm event plus an additional 1 foot of structural freeboard." On your farm, that is a maximum waste level of 19 or 19.5 inches freeboard. The Division of Water Quality will take no further action for this reported incident at this time. The Division recommends that you review your facilities and procedures with the goal of eliminating future high freeboards, which could lead to mandatory review of your Waste Utilization Plan by a Technical Specialist, Notices of Violation or monetary penalties. The Division appreciates your cooperation in self -reporting high freeboards, pumping down lagoon levels, and providing records. OF DEFICIENCY Storms Swine Facility Registration No. 09-25 Bladen County Dear Mr. Storms: On July 27, 2000, staff from the Fayetteville Regional Office of the Division of Water Quality inspected the Storms swine facility. It was observed that swine waste was either leaking at the rear of building 9 6 or waste had been removed and stockpiled at the real- of this house resulting in waste in the diversion ditch. In addition, waste samples had'not been collected within 60 days of waste application. In regard to the deficiencies noted during the inspection, the following actions are requested: 1. Inspect building # 6 for possible leaks and remove the animal waste stockpiled at the rear of the confinement building to prevent future disharges . 2. Collect waste samples within 60 days of waste application or every 120 days (quarterly) to insure compliance. On February 9, 2000, staff from the Fayetteville Regional Office of the Division of Water Quality performed an inspection of the Storms Farm #144 swine facility located in Bladen County. The inspection revealed that the freeboard level in one of the lagoons was 16 inches, which was determined to be less than the minimum required in the General Permit for this facility. Please be advised that your General Permit condition 111.6.e states that "The Permittee shall report by telephone to the appropriate Regional Office as soon as possible, but in no case more than 24 hours following first knowledge of the occurrence of any of the following events: (e) Failure to maintain storage capacity in a lagoon/storage pond greater than or equal to that required in Condition V(3) of this General Permit.". Based on the liquid level observed and by failing to report the level as required in your Permit, it has been determined that you are in violation of your General Permit. The Division of Water Quality requests that the following items be addressed: 1. On January 7, 1999, staff from the Fayetteville Regional Office of the Division of Water Quality performed a routine fly -over of the Storms Farm in Bladen County. During this routine fly -over it was noted that irrigation was being performed on what appeared to be saturated fields in which there was no cover crop planted. After the fly- over, DWQ staff arrived on site at approximately 2:00 p.m. to find that the irrigation was still in progress. The farm manager was advised as to the reason DWQ staff was on site. Upon further investigation it was noted that one of the four lagoons had less than the required nineteen inches of freeboard and that DWQ had not been notified as required by the General Permit condition 111.6,e., which states that "the Permittee shall report by telephone to the appropriate Regional Office as soon as possible, but in no case more than 24 hours following first knowledge of the occurrance of any of the following events: e. Failure to maintain storage capacity in a lagoon/storage pond greater than or equal to that required in Condition V(3) of this General Permit.". The freeboard in this lagoon was seventeen inches at the time of the investigation. It was also noted that a Z-pipe at lagoon number one (first lagoon on left entering the farm) was leaking and causing waste to pond at the base of the lagoon and in the adjacent application Feld. There was a very good cover crop on other fields at this site which were not being utilized. A subsequent review of the irrigation records for the farm revealed that the pumping windows for the crops grown, as outlined in the CAWMP, were not followed. Irrigation on soybeans per the CAWMP is to be performed in the months of April to June. Stevens, Director of the Division of Water Quality (DWQ), make the following: I. FINDINGS OF FACT: A. William Storms owns and operates the Storms Farm #1 - 4, a swine operation in Bladen County. B. William Storms was issued Certificate of Coverage AWS090025 under General Permit AWG100000 for Storms Farm #1 - 4 on July 20, 1998, effective July 20, 1998, with an expiration date of April 30, 2003. C. Condition No. V. 3. of the "General Conditions" of the General Permit states in part that "The maximum waste level in lagoons/storage ponds shall not exceed that specified in the Certified Animal Waste Management Plan (CAWMP). At a minimum, maximum waste level for lagoons/storage ponds must not exceed the level that provides adequate storage to contain the 25-year, 24-hour storm event plus an additional one (1) foot of structural freeboard." D. The CAWMP for Storms Farm #1 - 4 requires that the waste level in the lagoon does not exceed nineteen (19) inches. E. Condition No. M. 6. e. of the "Monitoring and Reporting Requirements" of the General Permit requires that the permittee shall report by telephone to the appropriate Regional Office as soon as possible, but in no case more than 24 hours following first knowledge of the occurrence of failure to maintain storage capacity in a lagoon/storage pond greater than or equal to that required in Condition V. 3. of the issued permit. F. DWQ staff from the Fayetteville Regional Office inspected Storms Farm #1 - 4 on February 9, 2000 and observed that the waste level of the lagoon was sixteen (16) inches which exceeded the level specified in the CAWMP. G. The Fayetteville Regional Office had not received notification from William Storms that the waste level exceeded the level specified in the CAWMP. H. The costs to the State of the enforcement procedures in this matter totaled $135,36. Based upon the above Findings of Fact, I make the following: II. CONCLUSIONS OF LAW: A. William Storms is a "person" within the meaning of G.S. 143-215.6A pursuant to G.S. 143-212(4). B. A permit for an animal waste management system is required by G.S. 143-215.1. C. William Storms violated Condition No. V. 3. of the General Permit by failing to maintain the liquid level in the lagoon at the level specified in the CAWMP. D. The above -cited failure to report by telephone to the appropriate Regional Office as soon as possible, but in no case more than 24 hours following first knowledge of the occurrence of failure to maintain storage capacity in a lagoon/storage pond greater than or equal to that required in Condition No. V. 3 violated Condition No. III.6. e. of the General Permit. E. William Storms may be assessed civil penalties pursuant to G.S. 143- 215.6A(a)(2) which provides that a civil penalty of not more than ten thousand dollars ($10,000.00) per violation may be assessed against a person who violates or fails to act in accordance with the terms, conditions, or requirements of a permit required by G.S. 1`43-215.1. F. The State's enforcement costs in this matter may be assessed against William Storms pursuant to G.S. 143-215.3(a)(9) and G.S. 143B-282. I (b)(8). G. The Director, Division of Water Quality, pursuant to delegation provided by the Secretary of the Department of Environment and Natural Resources, has the authority to assess civil penalties in this matter. We greatly appreciate the effort that you made in compiling this information and sending it to our Fayetteville Regional Office by the date required. We also appreciate the fact that you reported the problem with high freeboard to our staff as required by your permit and worked with our staff to manage the problem once it occurred. Upon review and consideration of the information submitted, the Fayetteville Regional Office has determined that no further compliance/enforcement actions will be taken by the Division for these high freeboards. Also, based on your actions to properly operate your facility, the Division of Water Quality hereby rescinds the Notice of Violation that was issued to you on April 16, 2003, and replaces it with this Notice of Deficiency. In the future, please continue to evaluate ways to maintain freeboard levels in the required range.
