Dear Mr. Smith:
On October 26, 1995, staff from the Fayetteville Regional Office of the Division of
Environmental Management inspected your animal operation. It was observed that the animal
enclosures were located in open earthen -floor pens. Also, these pens were on a sloping flood
plane adjacent to a stream (waters of the state). Not only is there evidence of surface run-off,
seepage and leechage to these waters, but there are objects in the streambed which obviously
were used in your swine operation (plastic, cans, barrels, and etc.).
_ On October 10, 1995, after receiving numerous complaints, your swine operation (site)
was visited. An inspection of the premises was conducted and also photographs were taken.
By chance, you happened to be on site (about 5:00 p.m.). You indicated that by the next
inspection, the operation would either be moved or that remediation of the operation's
deficiencies would at least be underway. A follow-up inspection of the premises was conducted
about 4:30 p.m., on October 27, 1995. It appeared that nothing had been done.
The animal operation needs to be moved away from the stream far enough to prevent
surface "run-off" during times of heavy precipitation. Also, solid objects need to be removed
from the stream and its banks. After removal of the animals, a thorough clean-up of a buffer
zone needs to be accomplished.
To remain a deemed permitted facility, all corrective actions must be made within 30
dW. Failure to do so may result in the facility losing its deemed permitted status, requiring
a certified waste management plan and certification form for the facility to be submitted prior
to the December 31, 1997 deadline, and being required to obtain an individual non -discharge
permit for the facility.

Please be aware it is a violation of North Carolina General Statues to discharge
wastewater to the surface waters of the State without a permit. The Division of Environmental
Management has the authority to levy a civil penalty of not more than $10,000 per day per
violation.
When the required corrective actions are complete, please notify this office in writing at
the address below:
